Kerkbelasting ontduiking, collega's treiteren ?
Of flink wat verstopte priesters?

Fairbanks Catholic Diocese Receives Complaints
Associated Press, carried in Juneau EmpireDecember 25,

FAIRBANKS - The Diocese of Fairbanks, which is under bankruptcy protection, received 288 claims from people who said they had been molested by Roman Catholic clergy.

A Dec. 2 deadline for claims was imposed when the diocese filed for Chapter 11 bankruptcy earlier this year. The number of claims was reported by Catholic News Service.

The diocese said it sought bankruptcy protection this past February because it could not reach a financial settlement over the 150 or so abuse claims it had received at the time. The claims related to cases largely dating between the 1950s and 1980s.

In 2007, the Oregon Province of the Society of Jesus, or Jesuits, agreed to pay $50 million to more than 100 Alaska Natives who said they had been molested as children by Jesuit priests.

However, the cases did not include claims of negligence against the Fairbanks diocese, which owned and managed the parishes in the rural Alaska villages where the Jesuit priests worked.

Fairbanks was the sixth U.S. diocese to seek bankruptcy protection in the face of sex abuse claims. The Fairbanks diocese oversees 47 parishes and 14,500 parishioners in what is - geographically - the largest diocese in the U.S. It spans more than 400,000 square miles.

Sexual Abuse of Natives

Dozens of Alaska Natives have joined forces and filed a lawsuit accusing the president of Seattle University of trying to cover up sexual abuse crimes.

tekst van de aanklacht (PDF file)

In all 43 alledged victims have filed suit saying Stephen Sundborg knowingly sent sex offenders, or what they call predator priests to remote Alaska villages because it was believed that they had little access to law enforcement and would not report the crimes.

The suit alleges the victims lived in Nulato, Hooper Bay, Stebbins, Chevak, Mountain Village, Nunam Iqua, and Saint Michael.

The suits are against the Jesuit Order Sundborg served as head of the order in the Northwest from about 1990 to 1996. He has denied any involvement.

The lawsuit was filed in Alaska Superior Court Bethel Judicial District. The abuses allegedly took place from around the 1950's into the early 1990's.

A lawsuit filed Tuesday accuses Seattle University President the Rev. Stephen Sundborg of knowing about an abusive Jesuit priest yet allowing that priest to remain in ministry when Sundborg served as provincial — or head — of the Jesuit order in the Northwest from about 1990 to 1996.

Sundborg is one of several defendants named in the lawsuit, filed by more than 40 men and women who say they were sexually abused as children or teens in Alaska years ago by Jesuits or those supervised by Jesuits.

The suit claims that as provincial, Sundborg had access to something called "hell files" — files containing information about Jesuit priests that was "not public," and "not good."

As such, Sundborg should have known that the Rev. Henry Hargreaves, one of the accused priests, had abused children, the suit says. Hargreaves could not be reached Tuesday evening. According to the lawsuit, he resides with the Jesuit community in Spokane.

"Father Sundborg remains steadfast in the belief that all victims of clerical abuse be treated with compassion and justice," Seattle University spokesman Casey Corr said Tuesday evening. "He has not been served with the lawsuit.

"The lawsuit says Native villages in Alaska were essentially a "dumping ground" for Jesuit priests unsuited to serve anywhere else.

That characterization has repeatedly been denied by the Jesuits. However they also have paid out millions of dollars in recent years to settle sexual-abuse claims in Alaska.

Several of the plaintiffs and their attorneys plan to hold a news conference this morning near Seattle University. The lawsuit, filed in Alaska Superior Court's Bethel Judicial District, accuses six Jesuits or those supervised by Jesuits, of sexual abuses ranging from fondling to rape. The abuses allegedly took place from around the 1950s into the early 1990s in remote Alaskan villages.

All the plaintiffs are Alaska Natives.

Other defendants in the suit include the international Jesuit order, and the Society of Jesus, Oregon Province — the formal name of the Jesuits in the Northwest. The province covers Washington, Oregon, Alaska, Montana and Idaho.

In recent years, the Oregon Province has received numerous allegations of past sexual abuse, most of them involving Jesuits in Alaska. In November 2007, the province agreed to pay $50 million to 110 Alaska Natives — believed to be the largest settlement by a religious order in the Catholic Church abuse cases.

The Fairbanks Diocese, which owned and managed the churches in the villages where Jesuit priests, brothers and volunteers were assigned, filed for bankruptcy protection last March.

About 300 people — including those who filed earlier lawsuits — have filed abuse claims with the diocese.

In Washington state, the Oregon Province agreed in January 2008 to pay $4.8 million to 16 Native Americans who were abused years ago when they were students at a boarding school near Omak.

Settlements in the state have also involved the Rev. John Leary, former president of Gonzaga University, and the Revs. Michael Toulouse and Englebert Axer, both former Seattle U. professors.

The second-highest-ranking Jesuit at Seattle University resigned Thursday from his post as vice president for ministry and mission after allegations publicly surfaced that he sexually harassed a trainee priest in the 1990s.

The Rev. Tony Harris will relinquish his prominent role immediately but continue working on special projects at Seattle U. through the remainder of the academic year before leaving altogether, said the Rev. Stephen Sundborg, the university's president. In a letter to faculty and students, Harris said he retains a "deep and abiding love" for Seattle U. but doesn't want his role to become a distraction.

And earlier this week, Seattle U. revealed that another former Jesuit professor and ethics expert, the Rev. Englebert Axer, is believed to have molested a boy in northern California in 1956. Axer died in 1989.Seattle U. has been under a spotlight in recent weeks as new alleged victims and information have surfaced in a federal lawsuit involving a well-known, longtime Seattle U. professor, the Rev. Michael Toulouse, who died in 1976. Toulouse is accused of molesting a 12-year-old boy in the campus Jesuit residence in 1968.

OTTAWA — Thousands of native children suffered sexual abuse in Indian residential schools, newly disclosed figures show – a human tragedy so pervasive it's being called “monstrous.”

The federal government has quietly paid out more than $350-million in abuse settlements over the last decade, the majority for sexual abuse, to 7,011 former students.

Several thousand more claims for sexual abuse at the hands of church and school officials have been filed over the last year under a 2006 agreement to compensate surviving students, the government and victims' lawyers say.

Both sides predict about 12,000 fresh compensation claims in total will be filed under the agreement – and that the “vast majority” will be for child sexual abuse.

All told, the figures suggest that at least one of every five students suffered sexual abuse at the schools, established in the 19th century to assimilate First Nations children and strip them of their aboriginal culture and language.

Liberal MP Todd Russell, an aboriginal, said the numbers were shocking.

“In meeting residential school survivors, I mean across the country, I am not surprised at the percentage – but when you say it as a number, that is astounding.”

Mr. Russell said he's heard many accounts of sexual abuse in discussions as a member of the Anglican Council of Indigenous People.

The high rate of sexual abuse suggests the isolated schools, which paid teachers and other staff poorly and failed to screen them properly, likely attracted pedophiles who saw the dismal institutions as a “gold mine,” said one lawyer involved in past litigation on behalf of students.
...
Court evidence in lawsuits by former students suggests the churches that ran the schools on behalf of Ottawa may have transferred sex offenders to different locations to protect them and to prevent word leaking out about the extent of sexual abuse, the lawyer said.

Another lawyer, lead counsel in court proceedings that led to judicial approval of the 2006 compensation agreement, agreed.

“You've got an extremely vulnerable group of children who are isolated from their parents, who are dehumanized, who have no one to turn to, and they're in remote locations and you've got sub-par teachers,” said Kirk Baert of Toronto.

“What better recipe could you have for exploitation than that? It's like a checklist of all the things you would need to have it happen a lot.”

Mr. Baert also agreed the schools actively suppressed evidence of the abuse.

“They used various forms of intimidation to silence anyone who complained.”
...
The grand chief of the Assembly of First Nations, Phil Fontaine, said aboriginal negotiators and leaders expected a high number of sexual abuse claims under the settlement agreement.

“Don't forget that the initial claims that precipitated all of this were for sexual abuse,” said Mr. Fontaine. “We anticipated this would be like opening the floodgates.”

The Liberal government of the day issued a reconciliation statement following a scathing report in 1996 from a royal commission on aboriginal peoples, which included a chapter on residential schools.

The reconciliation statement included an official apology to residential school survivors, followed by Prime Minister Stephen Harper's statement of apology on behalf of Canada in Parliament last June.

A spokesman for the United Church said it has been named in 1,100 claims, but he said the church had not done a “statistical analysis” to tabulate the number of claims for sexual abuse.

A spokesperson for the Roman Catholic church could not be reached and the Anglican Church of Canada did not respond to a request for an interview.

Beschuldigd van medeplichtigheid aan Argentijnse dictatuur
Kardinaal Pio Laghi overleden

(tb)

As attorneys across the nation press countless clergy sex abuse cases against the church, two critical questions they most often ask are: “What did the bishop know?” and “When did he know it?” At stake is episcopal culpability. Also at stake in thousands of lawsuits, many filed and many others still being planned, is potentially billions of dollars in payments to victims.

In light of these developments, a 92-page report on clergy sex abuse, distributed to the U.S. bishops in May 1985, warning them of the trouble ahead, has been repeatedly cited by victims’ attorneys as a hard measure of episcopal negligence. The document, reportedly referred to in more than 100 lawsuits, is well known to the bishops.

Among the insights in this document are clear statements that while help can be provided for abusive priests, there is “no hope” for a cure for some of them, that a bishop “should suspend immediately” a priest accused of sexual abuse when “the allegation has any possible merit or truth,” and that “In this sophisticated society a media policy of silence implies either necessary secrecy or cover-up.” It said, “clichés such as ‘no comment’ must be cast away.” [Note that the first two quotations are not from the report, but from an essay by one of its authors, Rev. Michael R. Peterson, written in December 1985 to accompany the report when he sent it to the bishops.]

In some ways this is a story of what might have been or, perhaps, what might have been avoided.

As the bishops prepare for their June meeting in Dallas at which they are expected to formulate their responses to the clergy sex abuse scandal, the names of two priests and an attorney, Fr. Michael Peterson, Dominican Fr. Thomas Doyle and Ray Mouton, are likely to haunt them. These are the names of the men who attempted to warn the bishops in 1985, pleading with them to take firm actions on the sex abuse cases.

The authors maintained that the bishops ignored their recommendations. For their part, the bishops deny that claim.

It was in January 1985 that Peterson, then director of St. Luke Institute in Silver Spring, Md.; Doyle, a canonist at the office of the papal nuncio, or pope’s representative, in Washington D.C.; and Mouton, a civil attorney representing a priest, Fr. Gilbert Gauthe, then charged with pedophilia, began their collaboration. The collaboration continued over five months and resulted in the report, backed with more than 100 pages of supporting evidence. The report covered the civil, canonical, and psychological aspects of priest sexual involvement with children.
When the men turned over their findings to the bishops, it might have seemed extreme to some; today it reads as a prophetic document.

The Catholic church, the three men wrote, faces “extremely serious financial consequences” and “significant injury” to its image as a result of the “sexual molestation of children by clerics, priests, permanent deacons and transient deacons, nonordained religious, lay employees and seminarians.”

Postponing the day of reckoning
In Lead Us Not Into Temptation, Jason Berry furnished abundant evidence to explain why critics are so skeptical. Beginning with the case of Father Gilbert Gauthe—who was suspended from priestly duties in the Diocese of Lafayette, Louisiana, after assaulting a number of altar boys—Berry slowly uncovered a pattern of sexual abuse. Still more troublesome, he found that through most of the 1980s, church authorities refused to grapple with the problem directly, instead treating each complaint on a quiet, ad hoc basis. Time after time, diocesan officials—often responding to advice from their lawyers—refused to acknowledge that a problem existed.

While the bishops concentrated on “damage control,” Berry found an oddly mixed triumvirate in individuals pressing for a concerted national effort to grapple with the pedophilia problem. Father Thomas Doyle, OP, was a canon lawyer, assigned to the office of the apostolic pro-nuncio, Archbishop Pio Laghi, in Washington. Ray Mouton was a Louisiana lawyer, who became involved with Gauthe case in Lafayette. Father Michael Peterson was a psychiatrist, specializing in the treatment of troubled clergy, who was dying of AIDS as the scandal unfolded. Together, they pushed the US bishops to recognize the growing problem of sexual abuse, and to set up consistent policies to handle the legal, psychiatric, and pastoral implications of the scandal.

For years their efforts were ignored—or worse. In 1987, Bishop A. James Quinn of Ohio wrote to Archbishop Laghi, complaining that Father Doyle’s public statements on the issue were inflaming public opinion. Others charged that the three would-be reformers were merely looking for consulting contracts. Mark Chopko, the general counsel to the US bishops’ conference, later admitted, “There was a feeling that those guys wanted to set themselves up for work.”

“What explains the deception of bishops confronted with child-molesting priests?” Berry wondered. “What is it in the ecclesiastical mind that reaches out to lawyers rather than parents?”

Review of An Irish Tragedy: How Sex Abuse by Irish Priests Helped Cripple the Catholic Church

A number of books have been written about sexual abuse by Catholic clerics. Some are the gut-wrenching stories of victims themselves, told in their own words or through another. Some are polemical in that they confront the official Church for its hypocritical response while demanding both recognition and action to help solve the problem. Still others are scholarly ventures into the mysterious depths of this unique socio-cultural phenomenon by academics from a variety of disciplines. All are seeking answers as to “why.” The answers are much more complex and elusive than simply saying “celibate priests are sexually dysfunctional” or “bishops only want to protect their turf.” Both are true statements but there are many more “whys.”

Joe Rigert is an investigative journalist with an uncanny ability to ask the right questions and a tireless capacity to find the answers. With An Irish Tragedy he has moved into territory not yet explored by those seeking answers, namely the ethnic component to clergy abuse.
The Irish clergy are natural subject of inquiry.

I must admit that I underestimated and undervalued the causal relationship between the Irish Catholic culture and the fact that a significant number of clergy abusers in the U.S. are either Irish immigrants or of Irish descent.

The author did much more than simply provide a well documented exposition of sexual abuse by Irish priests in the U.S. He went to Ireland to look at the roots and in doing so he became immersed in the Irish expression of Catholicism, especially the rather bizarre brand of sexual morality.

An Irish Tragedy is an apt title for this book because it describes precisely the end result of the continuum of excessive and superstitious piety, toxic clerical control and a twisted sexual morality which has all converged into too many cases of sexual abuse of minors and deceitful cover-up by bishops.

Sex abuse by Catholic clergy is not limited to a “church” problem. It is a deeply rooted, complex flaw in society in general because the results impact so many aspects of our daily lives.

Many have arrived at the conclusion that expecting the official Roman Catholic Church to accomplish anything like a basic change of attitude marked by an honest recognition of the problem followed by concrete and realistic steps to help bind the wounds and reduce the chances of future abuse is completely futile. It is left to writers like Joe Rigert to probe deeply into the dark, mysterious and malignant shadows of the Church to find more answers.

This book is foundational to comprehending the breadth of sexual abuse, the rank duplicity of the hierarchy from the popes on down and the deep roots the causality has in our culture, both religious and secular.

An Irish Tragedy will have a long shelf life because it will remain an invaluable resource for those who are compelled to probe deeply in order to find the answers to the “whys”. The answers are pivotal as we strive to move past the institutionalized dishonesty of the Catholic Church in order to create a religious environment where children and the vulnerable are safe, not only from dysfunctional clerics but from a dysfunctional Church.

Thomas Doyle, a Dominican priest, canon lawyer and author, is an international authority on clergy sex abuse; he has testified in hundreds of legal cases on behalf of abuse victims.

Cardinal lands Church back in Dark Ages

THERE'S an episode of Father Ted in which Dermot Morgan makes a painful attempt to put the Catholic Church's most serious problem in some sort of perspective.

"We're not all like that," he explains. "Say there's 200 million priests in the world and 10 per cent of them are paedophiles. That's still only 20 million!"

After the tragic and sickening revelations of the last few weeks, that joke suddenly seems a lot less funny.

The report into child abuse in the diocese of Cloyne, which definitively shows that Archbishop John Magee failed to follow his own church's rules on how allegations of child sex abuse by priests should be dealt with that the church's problems in this area are as grave as ever.

Even more depressing in some ways, however, has been the response of Magee's fellow bishops.
Instead of showing some moral leadership by calling on the man to resign, most of them seem to believe this is a troublesome little incident that will blow over if they can just brazen it out for another few days.

INSULT
Their craven attitude proves once and for all that despite everything the public has learned over the last 15 years, the church itself has yet to learn the first thing about its own cardinal sins.

Now Sean Brady, the Catholic Primate of All Ireland, has added insult to injury by describing Magee as a "dependable and reliable" man who should stay on to ensure that proper child protection guidelines are put in place.

For the victims who suffered in silence while the "dependable and reliable" bishop sat on his hands for so many years, the insensitivity of Brady's language is breathtaking.

Incredibly, however, all the signs are that his statement of support has the full backing of the Vatican - and, by extension, Pope Benedict himself.

The evidence against John Magee is overwhelming. Despite being fully aware of what the Ferns inquiry had revealed about clerical child abuse in Ireland and the outrage at the way abusers were moved around, he ignored the systems put in place to ensure the same couldn't happen again.

The effect of this news coming out is predictable - fury, hurt and a suspicion that the church has learned nothing.

This is not the first time, of course, that Magee has found himself the centre of controversy. A former secretary to three Popes, in 1978 he famously claimed to have been the person who discovered John Paul 1 dead in bed.
When it eventually became clear that, in fact, a nun had been first on the scene, he brushed it aside by declaring: "I did find him -- I just didn't find him first."

This latest scandal is of a completely different moral order, of course, but Magee's attitude clearly hasn't changed in 30 years -- the smugness, the weasel words, the abject refusal to accept any culpability for his own actions.
Even now, he apparently cannot bring himself to appear on camera and give a proper explanation (or even a simple sorry) to the victims who suffered for his sins. To be fair to the church, it is clear that many ordinary, decent priests are shocked by these revelations and are desperate for their leaders to take some sort of stand.

The Augustinian monk Fr Michael Mernagh voted with his feet by travelling from Cobh to Dublin in a "walk of atonement" that was joined by hundreds of concerned Catholics along the way.

PAINFUL
He was later greeted at the Pro-Cathedral by Diarmuid Martin, the Archbishop of Dublin who has dropped several hints that Magee should quit.

By now, however, it should be clear hints are not enough.
Martin must unite with other Irish clergymen, politicians such as the Minister for Children Barry Andrews and lay Catholic groups in making a clear statement calling for Magee to do the decent thing.

That might or might not have the desired effect -- but it would at least be a positive step in the long and painful process of dragging the church into the 21st century.

Or at least out of the Dark Ages into which the Cardinal has now plunged it.

Mexican Priest Accused of Sexually Abusing Boys

VERACRUZ, MEXICO -- Authorities in the eastern Mexican town of Boca del Rio rescued 20 boys from an institution run by the Catholic Church where allegedly they were the targets of sexual abuse by a priest.

Mayor Miguel Angel Yunes Marquez told a press conference that they had received complaints and statements from boys who were mistreated and subjected to sexual abuse by the Rev. Jose de Jesus Sandoval Gonzalez with the connivance of Sister Maria Guadalupe Zaragoza Barajas.

Yunes said that the mothers of two alleged victims complained that the nun accepted payments of 500 pesos ($36.20) to take boys to the house of the priest, where he then abused them.

Any boys who dared to mention what happened at the house were punished by making them eat hot peppers or spoiled food, or they were forced to kneel in the yard for four hours in the sun or on top of metal bottle caps and sleep with dogs all night or out in the open air.

During his meeting with reporters, the mayor presented videotapes of the testimony of several boys who were rescued from the church-run institution and who are now being taken care of by the municipal family services agency.

Yunes said that the city hall presented the criminal complaint on Dec. 15 and but decided to go public with the matter because prosecutors have dragged their feet.

When consulted about it, the deputy attorney general of Veracruz state, Jose Luis Peri Perez, told reporters that the medical exams doctors conducted on the boys show no indications of penetration, but the investigation is continuing because the suspicion exists that the priest at least fondled the boys.

Forgive us father, for you have sinned.

Zonder oorlog, zonder vrede,
Zonder moraal, zonder moreel,

(tb)

Clerical Whispers ...Commentary on Cloyne Child Sex Abuse

Sorry. Dag!

...
We have built false models of God and we have built false models of Church which become ideology or rule book or power structure rather than the place where in our vacillation we can turn to a God who is always faithful and who will bless us and protect us. We have to understand God as a God to whom we can turn and who will allow his face to shine on us in such a way that it changes us into becoming like the face of God, through allowing God’s healing love to break into our hearts and to turn us into people who love.

Love is strong word. Love is not a superficial emotion. When we are loved and when we love, that love shakes us up and changes us and changes the way we act and live in society. Love is the opposite not just of hatred, but of indifference. We reject love not just through hating or disliking someone, but through opting out of caring, opting out of responsibility, of protecting, of nurturing or of nourishing.

We need a Church which protects and we need a Church which becomes a model and a partner of protection. I would hope for example that in the year to come it would be possible to take up the appeal made by Pope Benedict at his Christmas Mass and work on the basis of partnership to eliminate all the various forms of abuse of children wherever they exist in our nation and around the world. As Archbishop of Dublin I recognise the faults of the Church in this area and I ask for pardon at the beginning of a New Year, especially where I personally have caused hurt. As Archbishop of Dublin I also know of the desire of many to work for a Church and a society more robust in their care and protection of children – right across the board and working together.

Erfgoed: De rk harde schijf en ervaringsdeskundige zieners.

Jantje zag eens pruimen hangen.
Alweer een raadsel opgelost

...

Checkpoint Charly.

Getting to the grim truth
SOME people would have us believe that protecting children from paedophile priests is a deeply complex thing, that Catholic clergy need detailed guidelines, in writing, to tell them what is the right thing to do, and that bishops are legally constrained from telling the Government the whole truth about priests in their dioceses who have been accused of sexually abusing children.

For those reasons, the Health Service Executive's "audit" of Catholic dioceses has turned out to be a lame document, as had been widely predicted.
bronThe audit, published yesterday, is essentially a questionnaire which asked the diocesan clergy whether or not they were complying with the recommendations of the Ferns Inquiry Report.
Unsurprisingly, having examined all the ticked boxes, the HSE has found "no prima facie case of serious non-compliance".

Missing from the audit are details of allegations of abuse against an unknown number of individual priests. More than 20 Catholic bishops refused to provide those details, supposedly for fear of being sued.

The audit is, therefore, "anonymous", as the minister with responsibility for the protection of children, Barry Andrews, put it yesterday.
The minister said that he would enlist the assistance of the National Board for Safeguarding Children in an attempt to elicit the relevant information from the bishops -- the missing 'Section 5' of the HSE audit.

And this is where a straightforward procedure becomes complicated. A spokesman for the NBSC, a Catholic Church body, immediately rejected the minister's suggestion, declaring that the HSE and the bishops would have to work it out between themselves.
The National Board and the minister also appear to disagree about who originally commissioned the investigation into the Cloyne diocese, but that is a puzzle that can wait for another day.
In view of the inherent contradictions contained in the HSE audit, the minister has wisely decided to direct the Commission of Investigation into the Dublin Archdiocese to investigate and report on child protection in the Cloynes diocese.

In view of such a clear vote of no confidence by the minister, together with blatant messages from the Archbishop of Dublin and victim support groups, it is clear that the Bishop of Cloyne, John Magee, should consider resigning and let the investigators get on with their job.

Spain is battleground for church's future

The Macías Picavea primary school hardly looks like the seat of revolution. But this unassuming brick building in a sleepy industrial town has become a battleground in an intensifying war between church and state in Spain.

Cardinal Antonio María Rouco Varela of Madrid watched the pope’s address from the Vatican at the Dec. 28 Mass and rally.
In an unprecedented decision here, a judge ruled in November that the public school must remove the crucifixes from classroom walls, saying they violated the “nonconfessional” nature of the Spanish state.

Although the Roman Catholic Church was not named in the suit, it criticized the ruling as an “unjust” attack on a historical and cultural symbol — and a sign of the Spanish state’s increasingly militant secularism.

If the judge’s ruling was the latest blow to the Catholic Church’s once mighty grip on Spain, the church’s response showed Spain to be a crucible for the future of church-state relations in Europe.
For Pope Benedict XVI, who has staked his three-year-old papacy on keeping Europe Catholic, Spain, with its 90 percent Catholic population and rich history, represents a last hope in an increasingly irreligious continent.

That hope is quickly dimming. Since 2004, the Socialist government of Prime Minister José Luis Rodríguez Zapatero has legalized gay marriage and fast-track divorce, and it is seeking to loosen laws on abortion and euthanasia.
But in response, the church and religious Catholics have been pushing back, seeking a greater voice in public life. The result is that the church is in a full-throated war with the government.

As such, Spain represents not only the Catholic Church’s past in Europe, but perhaps also its future: an increasingly secular country with a muscular Catholic opposition, or what Benedict has called a “creative minority,” smaller in number but more ardent in faith.
At stake is the vision of the country: Will Spain join the rest of secular Europe or stand as a final Catholic foothold?
“I’d say that certainly there’s a worry; it would be naïve to deny it,” the Vatican spokesman, the Rev. Federico Lombardi, said of Spain. “It’s a critical point in the church’s confrontation against secularization in Europe and in the Western world.”

For the Feast of the Holy Family, an estimated 158,000 people on Dec. 28 attended a Mass and rally in Madrid “in favor of the family.”

The march appeared to be more low-key than past events. Before the 2007 elections, the church got into hot water when some of its rallies were seen as endorsing Mr. Zapatero’s right-wing opposition.

Today, the Spanish prelates are trying hard to be “for the family” rather than against the government, but it is a delicate balance.
If the church becomes too hostile to the government, it could compromise the logistics and public financing required for Madrid to host the Vatican’s biennial World Youth Day in 2011, a choice of venue that underscores the church’s focus on Spain.
In a recent interview in Madrid, the secretary general of the Spanish Bishops Conference, Msgr. Juan Antonio Martínez Camino, said it was important for the church “to use all the means at its disposal to promote and defend its fundamental rights.”

He called the 2005 law legalizing gay marriage and adoption “very strange and very irrational and very unjust.”The implications are broader, since Spain, with its 42 million Catholics, remains a touchstone for Latin America. South America alone has 324 million Catholics, the world’s largest concentration.

The church is also concerned that Spain could set a precedent for European Union legislation.

The Vatican last week said it would reassess its relationship with Italian law, so as to avoid adhering to Italian and European Union social polices that it opposed.

The church also fills a vacuum in the Spanish right. The center-right Popular Party is weak and has never been particularly engaged in religious issues.

Today, one of Mr. Zapatero’s strongest and most persuasive right-wing opponents is a Rush Limbaugh figure: Federico Jimenez Losantos, a former Communist turned right-winger and a professed nonbeliever who hosts a morning radio show on La Cope, the country’s second most popular radio station — which happens to be owned by the Spanish Bishops Conference. With his harsh criticism of Mr. Zapatero’s policies, Mr. Losantos is inevitably seen as fanning the flames of church-state tensions.
Mr. Losantos acknowledged that his show “creates problems” between the bishops and the government. “But at the same time, a lot of regular people say, ‘Good thing there’s the Cope; at least someone is in the opposition.’ ”

History looms large. During the Spanish Civil War from 1936 to 1939, left-wing Republican forces killed many clerics. But during Franco’s four-decade dictatorship, Catholicism was the official state religion.

Until after Franco’s death in 1975, women could not open bank accounts without their fathers or husbands co-signing. Today, they hold many of the highest political offices in the country.

“Spain changed very, very quickly,” said José María Contreras Mazarío, the director of religious affairs at the Justice Ministry. Today, he said, “Spain isn’t Catholic theoretically, culturally or politically.”

In an increasingly multicultural society, he said, the government wants to revise its definition of religious liberty so all religions are effectively equal.

Indeed, many see the church as a reactionary force trying to hold the country back.

“The army evolved after Franco,” said Carlos Parrado, the president of the Association of Secular Schools, which filed the lawsuit asking that the crosses be removed from the Valladolid school. “The church never evolved in this way.”

In many ways, Spain represents “a profound paradox,” said George Weigel, a Vatican expert and biographer of Pope John Paul II. “On the one hand, the ancient altar-and-throne alliance in Spain ill prepared the church to withstand the hurricanes of modernity, so when the winds hit after the death of Franco, just about everything collapsed.”

“On the other hand,” he said, “it’s striking that many of the new and vital renewal movements and new Catholic communities emerged out of Spain.”

Opus Dei, founded in Spain in 1928, has 30,000 members in Spain. More than 70 percent of Spaniards baptize their children, even if far less than 30 percent of the public regularly attends Mass. In spite of its social policies, the Spanish government continues to direct significant state financing toward Catholic schools and hospitals.

Some say the intense debate benefits both sides: the church can raise its voice, and the government can change the subject from the economic crisis.

It remains to be seen how the debates will play out. Media reports said fast-track divorce had not taken off, but not because of church pressure. Times are tough, and divorce is expensive.
