Abuse in Dutch Catholic care: more evidence

Serious abuses went on unreported for years in Dutch Roman Catholic homes for the mentally disabled. They included sex offences, castration, secret medical experiments and possibly murder. One Catholic brother was banished to Africa for doing unethical brain research. Radio Netherlands Worldwide tracked him down.
Until recent years, most abuses in Dutch institutional care were kept out of the public eye. One exception was a scandal in 1978 involving medical experiments at 'Huize
Brain x-rays
The home's medical doctor and a Catholic nurse known as Brother Dionysius performed spinal taps on approximately 180 patients, including minors. They injected fluid and air into the patients' brains in order to take x-rays of the cerebral cortex. These were used for brain research which was quietly being carried out. After the injections, the patients suffered nausea and headaches for days. Their parents were neither asked for permission nor notified of the procedures.
Sent to Africa
When former employees blew the whistle, the doctor was sacked and ordered to pay a fine. Brother Dionysius was sent to Tanzania by his congregation. The case was discussed in the Dutch parliament, where MPs complained that the health inspector had given private institutions such as Huize Assisië a free hand.

"Nothing untoward"
Radio Netherlands Worldwide has discovered that Brother Dionysius is still working as a hospital nurse in the Tanzanian village of Sengerema, near Lake Victoria. Speaking to RNW by telephone, the 76-year-old brother said he had done "nothing untoward".

"What we did was happening at other institutions too," he said. "As the x-ray technician, I was carrying out the doctor's orders. It was none of my business whether the parents knew. I was fired after the story got out, but that was just to put a stop to all the fuss."

Lurid secrets
It was a rare example of institutional abuse becoming public knowledge. More often than not, such cases are swept under the rug where they remain for decades. But lately, some lurid secrets have come out in the open.

Cor Schilder Ngong ; OM onderzoekt misbruik Nederlandse (ex) bisschop Kenia

Cor Schilder, Mill Hill Kenya Sex abuse bishop was quietly retired

By WALTER MENYA and GIUSEPPE LIGUORI
February 27, 2011
The Daily Nation

A Missionary order has pledged to cooperate with the authorities in investigations into a bishop who left Kenya after being accused of sexual abuse.

Responding to questions by the Nation into the circumstances surrounding the retirement and departure of Ngong Catholic Bishop Cornelius Schilder, the General Superior of the St Joseph’s Missionary Society Rev Anthony Chantry replied:
“With regard to recent allegations that have been made in the Kenyan Press, our Society will cooperate with any civil enquiry which may be initiated in the best interests of safeguarding children and vulnerable adults.”
The Archbishop of Nairobi John Cardinal Njue, who has been directly responsible for administering the Ngong Diocese since Bishop Schilder left, said he did not know the reasons behind the 2009 departure.
The Cardinal said he only knows that the bishop was allowed by the Vatican to retire early on health grounds. He also said he was not the Archbishop of Nairobi at the time.
During the period that claims against Bishop Schilder were investigated, the Catholic church was under Archibishop Ndingi Mwana a’ Nzeki.

Efforts to reach Archbishop Ndingi were not successful as staff at his office said he was ill and could not talk to the press.

Since taking over the Ngong diocese, Cardinal Njue said, no issues about the conduct of the former bishop had been brought to his attention; and therefore he would not comment.

The Cardinal asked why the issue was being raised long after it was concluded and Bishop Schilder left the country.

However, there is credible information that a church inquiry initiated locally and then referred to the Vatican had found the allegations against Bishop Schilder, a Dutchman affiliated with the Mill Hill missionaries, as credible.
The alleged offences were committed when he served as a priest in Ngong diocese before taking over as Bishop in November 2003.
The Ngong diocese comprises Kajiado, Transmara and Narok districts with 29 parishes with an estimated 101,870 Catholics out of a population of 960,303.

That Bishop Schilder faced such accusations was confirmed by Fr Alphons Eppink, who was the Superior of the Mill Hill Missionaries in Kenya between 2005 and 2008 during the period of investigations.
Reached in Oosterbeek, Netherlands, where he is now based, Fr Alphons confirmed that there were investigations against Bishop Schilder.

However he said the matter was finalised at the Vatican and therefore he was not in a position to give any information. “I was in Kenya during the investigations but I don’t want to comment, really,” he concluded, “I am afraid I cannot comment because the case was handled by Rome”.

Fr Alphons however confirmed that Bishop Schilder was no longer allowed to publicly celebrate Mass, an indication that he left the pulpit in disgrace rather than by ordinary retirement.

Approached by the Nation, Javier Herrera Corona, Secretary of the Apostolic Nunciature— the Vatican representative office—in Nairobi, denied any knowledge that Bishop Schilder was edged out because of unacceptable activities.
However, he insisted that the activities of one individual should not be used to besmirch the church.

“We have to distinguish the public life of a person and the private side. What a person does in private should be left to him to answer and not drag a whole community to answer on his behalf,” said Fr Javier.

Fr Javier would neither confirm nor deny that Bishop Schilder faced such accusations, but asked that the matter be left alone. ‘‘It is not the right time to bring this matter to the public,” he said.

The Vatican envoy however defended the Nunciature from any blame, explaining that there is little it can do where a member of the clergy is accused of sexual abuse.

The Vatican representative said that church rules require that a priest found engaging in sex abuse should face secular law.

However, this did not happen in the case of Bishop Schilder. It was never reported to the police according to Ngong DC Hiram Kahiro.

Cor Schilder sexueel misbruiker-fraudeur-leugenaar-voormalig bisschop Mill Hill Ngongo Kenia

Cor Schilder: Cordaid shocked by news of abuse

Cordaid.nl
4-3-2011

On March 1, 2011 we learned from the media that the Vatican has banned the Dutch bishop Schilder from his function in 2009.

This was confirmed by Schilder’s superior of the Netherlands Mill Hill congregation. Schilder, bishop of the Diocese of Ngong in Kenya, was relieved from his post after allegations of sexual abuse. Cordaid is shocked by this news because in recent decades they have been actively involved in development projects in the diocese of Ngong.

Cordaid has supported, like many other (international) development agencies, the programs in the diocese for some time. In 2003, these projects were carried out under the responsibility of Schilder. During the years 2000-2009 Cordaid supported six different projects in this diocese, investing in the areas of health, water and sanitation. The regular audits showed that the programs met the quality of Cordaid, including the financial management. The projects, focusing on land rights, water and micro-credits, were completed successfully and yielded direct results for the local population.

In their frequent contacts with the staff of the diocese, Cordaid never had any indications of sexual abuse on the part of the bishop. Cordaid deeply regrets that while the abuse was known both to Mill Hill and the Vatican, they were not informed. This is in conflict with Cordaid’s ethics, which are based on openness and transparency.

Our trust in the Mill Hill Congregation has been damaged severely. Cordaid has suspended all funding of Mill Hill.

Cordaid requires organizations that receive funding, to have a code of conduct on the prevention of sexual abuse. If an (employee of an) organization funded by Cordaid is known to be involved with sexual abuse, Cordaid immediately suspends funding.

The Pastoral Relationship

Boundaries:
Boundary violations are committed when we knowingly or unknowingly cross the emotional, physical or sexual limits of

another
We are always responsible for maintaining appropriate behaviour
We never initiate sexual behaviour and refuse it when another initiates it
We are prudent in physical touch
We are familiar with the dynamics of transference and counter-

transference and their consequences (a person seeking pastoral help can project on to the minister their own unmet needs or unresolved conflicts which hark back to earlier relationships with others. This is called transference. When the minister does the same and projects his or her unmet needs and unresolved conflicts onto the person seeking help, this is called counter-transference).
If we are ordained priests we clearly distinguish the Sacrament of Reconciliation from other relationships such as counseling
We always satisfy our needs for affection, intimacy and friendship outside the pastoral relationship
We avoid anything in speech or behaviour that might involve sexual harassment of another
We choose an appropriate physical environment in which to exercise ministry
We are discerning and prudent in showing expressions of regard and in the giving and receiving of gifts
Where the bond of trust is jeopardized by encroachment on the boundaries, we take steps to bring the relationship to a close and arranges referral to another minister.

Confidentiality

If we are ordained priests we respect the absolute secrecy of the seal of confession
We keep confidential, information which is disclosed to us while acting as pastoral ministers
we are aware that there are circumstances in which confidential information can or must be revealed
We seek the permission of the discloser before sharing private information with others and have serious reasons for seeking that permission
When the condition and behaviour of a person seeking help indicate clear and imminent danger to self or others, or when abuse is involved, we must take reasonable action to inform potential victims and/or inform proper responsible authorities.

Crisis hits home for orphans after director is jailed

By OTIENO OWIDA, newsdesk@ke.nationmedia.com
Posted Monday, October 11 2010 at 20:42

The Home of Champions orphanage in Rachuonyo South District is in a crisis after its director and founder was sentenced to 20 years in jail mid last month over child sexual abuse.

Bishop Joseph Hawkins Agutu was charged in an Oyugis court towards the end of last year with three counts of defilement of a 16-year-old orphan at the home.
He was accused of committing indecent acts on diverse dates between September 8 and 14 last year while in a position of authority.

Seduced girl under his care
Bishop Agutu is said to have seduced the girl under his care at the children’s home and had sex with her within the institution, contrary to section 24 (1) of the Sexual Offences Act No.3 of 2007.

The orphanage, home to more than 25 school-going orphans, currently has been left without anyone in charge. The children now fend for themselves.

A visit to the home by a Nation team on Monday revealed a grim situation for the children, following the director’s imprisonment.
They lack food, security and other basic items.

The children, including candidates, who are due to sit the Kenya Certificate of Primary Education (KCPE) examinations and some in secondary school, have not been going for lessons for the past two weeks after they were allegedly sent home for non-payment of fees. However, enquiries by the Nation at Oriang Primary School showed that the children were not sent home over fees as they alleged but had absconded classes out of the frustration they are facing.

The headteacher of Oriang Primary School, Mr Henry Odhiambo, denied sending any child home over levies, which include Sh30 for three sets of examinations per term and Sh30 for the community teacher.

“We have not sent any child home. The children from the home have a tendency of absenteeism, but this time round, it could be as a result of what has happened,” he said.

According to one of the children, Maxmilla Moraa, a Form Two student, some the orphans have gone back to live on the streets.

Others who remained behind have joined hands in their bid to make ends meet.

The deputy district children officer, Mr Caleb Ochar, said the situation had degenerated into a crisis as the children lacked food and other basic items, besides being left alone without a caretaker, exposing them to more risks.

“This is failure on our part. These children cannot be left like this, they must be moved. But in the meantime, short-term solutions to provide food and other basic needs are being sought to ease the situation,” he said.
