Cor Schilder, Mill Hill Kenya Sex abuse bishop was quietly retired

A Missionary order has pledged to cooperate with the authorities in investigations into a bishop who left Kenya after being accused of sexual abuse.

Responding to questions by the Nation into the circumstances surrounding the retirement and departure of Ngong Catholic Bishop Cornelius Schilder, the General Superior of the St Joseph’s Missionary Society Rev Anthony Chantry replied:
“With regard to recent allegations that have been made in the Kenyan Press, our Society will cooperate with any civil enquiry which may be initiated in the best interests of safeguarding children and vulnerable adults.”
The Archbishop of Nairobi John Cardinal Njue, who has been directly responsible for administering the Ngong Diocese since Bishop Schilder left, said he did not know the reasons behind the 2009 departure.
The Cardinal said he only knows that the bishop was allowed by the Vatican to retire early on health grounds. He also said he was not the Archbishop of Nairobi at the time.
During the period that claims against Bishop Schilder were investigated, the Catholic church was under Archibishop Ndingi Mwana a’ Nzeki.


Efforts to reach Archbishop Ndingi were not successful as staff at his office said he was ill and could not talk to the press.

Since taking over the Ngong diocese, Cardinal Njue said, no issues about the conduct of the former bishop had been brought to his attention; and therefore he would not comment.

The Cardinal asked why the issue was being raised long after it was concluded and Bishop Schilder left the country.

However, there is credible information that a church inquiry initiated locally and then referred to the Vatican had found the allegations against Bishop Schilder, a Dutchman affiliated with the Mill Hill missionaries, as credible.
The alleged offences were committed when he served as a priest in Ngong diocese before taking over as Bishop in November 2003.
The Ngong diocese comprises Kajiado, Transmara and Narok districts with 29 parishes with an estimated 101,870 Catholics out of a population of 960,303.

That Bishop Schilder faced such accusations was confirmed by Fr Alphons Eppink, who was the Superior of the Mill Hill Missionaries in Kenya between 2005 and 2008 during the period of investigations.
Reached in Oosterbeek, Netherlands, where he is now based, Fr Alphons confirmed that there were investigations against Bishop Schilder.

However he said the matter was finalised at the Vatican and therefore he was not in a position to give any information. “I was in Kenya during the investigations but I don’t want to comment, really,” he concluded, “I am afraid I cannot comment because the case was handled by Rome”.

Fr Alphons however confirmed that Bishop Schilder was no longer allowed to publicly celebrate Mass, an indication that he left the pulpit in disgrace rather than by ordinary retirement.

Approached by the Nation, Javier Herrera Corona, Secretary of the Apostolic Nunciature— the Vatican representative office—in Nairobi, denied any knowledge that Bishop Schilder was edged out because of unacceptable activities.
However, he insisted that the activities of one individual should not be used to besmirch the church.

“We have to distinguish the public life of a person and the private side. What a person does in private should be left to him to answer and not drag a whole community to answer on his behalf,” said Fr Javier.

Fr Javier would neither confirm nor deny that Bishop Schilder faced such accusations, but asked that the matter be left alone. ‘‘It is not the right time to bring this matter to the public,” he said.


The Vatican envoy however defended the Nunciature from any blame, explaining that there is little it can do where a member of the clergy is accused of sexual abuse.

The Vatican representative said that church rules require that a priest found engaging in sex abuse should face secular law.

However, this did not happen in the case of Bishop Schilder. It was never reported to the police according to Ngong DC Hiram Kahiro.

Is me dat effe mazzel dat die Belgen nederlands spreken en die Commissie daar even tijd had voor Deetman.



Tjeenk Willink is bepaald de eerste de beste niet, maar een man waardoor ik zo'n honderdduizend jaar geleden ontdekte dat er een soort volk bestaat waaraan ander volk briefjes schrijven die beginnen met: Amice. Dat schijnt te helpen.
Dat betekent wanneer zo'n mijnheer zegt: jongens het stinkt, de kans vrij groot is dat het ook stinkt ook!!
Da's het handige van dat soort volk en daar zijn ze voor.

En nu heeft die mijnheer dus gezegd: het stinkt.
Nu heb ik er geen flauw idee of die man katholiek is. En dat interesseert me geen fluit ook. Maar wat me wél interesseert is dat het OM even gaat uitzoeken hoe het eigenlijk zit, of het stinkt en hoe dan.

Wat me bovendien buitengewoon interesseert is het feit dat zo'n mijnheer die aangesproken kan worden met Amice géén uitspraken doet -althans niet in het openbaar en ik wens hem een zeer comfortabeel achterkamertje toe - over wat het dan betekent voor de onderzoekscommissie van die Heer Deetman naar wiens onafhankelijk van die Nederlandse wetgeving een onderzoek dient plaats te vinden.

Wat mij bovendien buitengewoon interesseert is wat vervolgens die RKKN dan doet met het feit dat die mijnheer die uitspraak doet over die heer Deetman.
Nu ben ikbepaald niet de snuggerste, maar wat die mijnheer Tjeenk Willink wél heeft gezegd, behalve jongens het stinkt, uitzoeken die handel, is dat de Heer Deetman, ons door de RKKN én zichzelf voorgeschoteld als, jongens kijk 's, onafhankelijk!!
wel 's volstrekt onafhankelijk zou kunnen zijn.

En daar als RKKN dan vervolgens naar slachtoffers helemaal niets over laten weten is een meer dan grove vorm van minachting! Meck toch hoe sterck, ik aarzel nog even of ik mij een grovere vorm van minachting kan voorstellen, gezien de eigen bevindingen van diezelfde Heer Deetman.

Het gaat hier over duizenden mensen, waarvan ik er één ben, die na jaren en jaren door die RKK en z'n instellingen, als Hulp en Recht, besodemieterd zijn.
Maar het zijn niet alleen directe slachtoffers en hun gezinnen/families, en zeker niet alleen de mensen die slachtoffer werden van seksueel misbruik.

De ramp van het RKK seksueel misbruik gaat niet over een zak die zijn of haar poten niet thuis kon houden.
Maar over zakken die volstrekte schijt konden hebben aan het recht van bestaan van kinderen, de noodzakelijke veiligheid en bescherming die daartoe nodig zijn en een Kerk die, met gebruikmaking van en onder verwijzing naar de hoogste norm, God, dit legitimeerde zelfs mogelijk maakte.

En de volstrekt lege handen die de samenleving hiertegen overstelde.

Of je nu gelovig was of bent of niet. Die bede, of je daar nu wel of geen waarde aan toekent of kende, zat er ieder jaar weer op Prinsjesdag niet voor niks in. En dat plaatje van de koningin hangt niet overal omdat ze niks leukers konden bedenken.
Aan die norm heeft dus ook de grootst mogelijke atheist zich onderworpen, zelfs een republikeinse.

Het seksueel misbruik in de RKK, als in andere kerken, gaat dus iedereen aan.
Zoals dat het alleen over seksueel geweld gaat slechts een politieke keuze is.
Het seksueel misbruik is slechts een onderdeel van geweld tegenover kinderen, hoe je dat aanpakt een keuze van prioriteiten, politieke keuzes. En smoelen! En geld!
Je kunt een samenleving tenslotte niet in één keer in elkaar laten donderen omdat er zoiets bestaat als Het Kind, of een internationaal verdrag.

En dan uitgerekend over de oplosser van een deel van dat ontkennen van het bestaan van kinderen en wat zij nodig hadden en hebben roept de Heer Tjeenk Willink dat hij kennelijk geen boodschap had aan een deel van de Nederlandse wetgeving.

O cynisme, uitgerekend dan ook nog 's over een deel van de wetgeving wat de centen in publieke functies regelt.
Laat het nu toch precies diezelfde centen zijn geweest die zoveel kinderen en hun gebrek aan noodzakelijke veiligheid en bescherming heeft onthouden.
O cynisme, het antwoord van de Heer Deetman is dan: gossie wist ik niet, weet je wat, Amice...als het zo is, dan betaal ik het wel effe terug......., groetjes.

En dan houdt de RKKN en de KNR de mond dicht, laat niets weten.

Daarmee is de vraag van de onderzoekscommissie: hoe was het in godshemelsnaam mogelijk, dus beantwoordt!

Een Nederlandse bisschop mocht twee jaar op zijn post in Kenia blijven zitten terwijl het Vaticaan wist dat hij een minderjarige jongen seksueel had misbruikt. Dit blijkt uit nieuwe verklaringen van betrokkenen.

In 2009 ging bisschop Cor S. met vervroegd pensioen. Officieel werd gezegd dat het vanwege zijn gezondheid was, maar eerder dit jaar werd bekend dat hij in werkelijkheid wordt beschuldigd van verkrachting. Het hoofd van zijn Mill Hills congregatie heeft nu laten weten dat Rome destijds sneller had kunnen handelen.
'Hij gaf me koffie, liet me mijn kamer zien en zat onmiddelijk aan me', zegt slachtoffer Michael Ole Uka in een beschrijving van zijn eerste ontmoeting met S.. De nu 32-jarige Keniaan heeft zijn beschuldigingen begin deze week voor het eerst publiekelijk geuit. Dat deed hij in een tv documentaire van het Ierse televisie network RTE.


In dezelfde documentaire kwam ook het internationale hoofd van de Mill Hill congregatie, Anthony Chantry aan het woord. De Wereldomroep heeft van RTE de beschikking gekregen over ruw interviewmateriaal van beide mannen, dat grotendeels nog niet is uitgezonden.


Alle priesters doen dit

Uka zegt dat zijn leven in puin ligt, 'terwijl de bisschop van zijn pensioen in Europa geniet'. Hij zegt dat het misbruik door S. begon toen hij 14 was. Daarnaast beschuldigt Uka tenminste één ander geestelijke van Mill Hill van verkrachting. Deze geestelijke, een Ier die 'Gerry' heet, is vanwege het misbruik uit het ambt gezet.


Het misbruik door S. zou zijn begonnen begin jaren 90. Toen was S. nog priester in Ngong, Kenia. 'S. vroeg me of ik Gerry had aangeraakt en ik zei ja', vertelt Uka. 'Daarna vertelde hij me ook hem aan te raken en hetzelfde te doen wat ik bij Gerry deed. Ik dacht toen dat alle priesters dit soort dingen deden. Ik wist dat het slecht was.'


Cor S. (69), die nu in een Mill Hill verzorgingshuis in Nederland woont, ontkent de beschuldigingen en heeft geweigerd met de media te spreken. S. mag sinds 2009 niet langer de werkzaamheden van een priester of bisschop uitvoeren. Hij is de eerste Nederlandse bisschop die door het Vaticaan wordt bestraft voor seksueel misbruik van een minderjarige.


Te langzaam



De beschuldigingen tegen S. zijn in Kenia onderzocht door zijn eigen congregatie en in 2007 doorgegeven aan het Vaticaan. Toch bleef de bisschop nog twee jaar op zijn post voordat Rome hem met pensioen stuurde.


De overste van Hill Mill, Anthony Chantry, zegt over het optreden van het Vaticaan: 'Persoonlijk moet ik zeggen, uit mijn eigen ervaring, dat het waarschijnlijk te lang heeft geduurd. Uiteindelijk reageren ze wel, maar ze nemen hun tijd.' Chantry vertelde RTE dat hij zich daar aan heeft gestoord en dat hij hoopt dat het Vaticaan de 'processen gaat versnellen.'


Schaamte

Pas later besefte Uka dat er -naar eigen zeggen- spelletjes met hem werden gespeeld. 'Toen ik bij hem overnachtte liet S. me mijn kamer zien. Pas later kreeg ik door dat het zijn kamer was. Ook werd duidelijk dat de priesters elkaar kenden en dat S. wist wat er tussen Gerry en mij voorviel. Het is alsof iemand anders jouw leven bezit. Ik voel grote schaamte', aldus Uka.


Overste Chantry verdedigt het besluit van het Vaticaan om de Keniaanse kerkgangers niet te vertellen wat de echte reden voor het vertrek van S. was. 'Ik veronderstel dat de prioriteit was om hem weg te krijgen uit de diocees en hem ergens onder te brengen waar hij onder toezicht stond en verzorging kreeg.'



Angst voor vergelding

Chantry zegt dat hij de kerkgangers zelf ook niet heeft geinformeerd over het misbruik omdat hij vergelding van het Vaticaan vreesde. 'Ik denk dat mij zou worden gevraagd waarom ik in mijn eentje had besloten de mensen te informeren. Er zijn verhalen verschenen in de lokale kranten, dus een deel van de informatie heeft het publieke domein wel bereikt', aldus Chantry.


Uka zegt dat hij zich alleen voelt staan, nu hij zijn beschuldigingen ook publiekelijk heeft uitgesproken. 'Soms heb ik er spijt van dat ik mijn mond heb open gedaan. Het spijt me niet dat S. is weggestuurd. Maar het is heel zwaar omdat mensen nare dingen tegen me zeggen. Ze vragen me waarom ik heb gesproken.'
Uka zegt ook dat hij vreest dat zijn kinderen ontdekken wat er in zijn verleden speelde en denkt dat hij zonder deze ervaringen een betere vader had kunnen zijn.


Ontmoeting

De Mill Hill congregatie in Kenia heeft volgens Uka een ontmoeting geregeld tussen S. en hem. Daar weigerde S. het misbruik te bevestigen. De zaak is daarna overgedragen aan het Vaticaan.
Uka zegt dat S. kort na die ontmoeting wel contact heeft gezocht en hem een koe heeft aangeboden. Dat is volgens Uka gebruikelijk bij de Masaï als verontschuldiging voor het onrecht dat iemand is aangedaan.


Geen recht

Volgens Anthony Chantry hebben de Mill Hill Missionarissen Michael Ole Uka geholpen door hem psychologische en medische hulp te bieden. Uka zegt dat hij ook financiële hulp heeft ontvangen van de kerkgemeente in Ngong.

Daarover zegt Uka: 'Mill Hill heeft het geprobeerd, maar ik zie geen gerechtigheid. Ik geloof nog steeds en ik bid nog steeds tot God. Maar niet in de kerk.'

Deetman Ich habe es nicht gewusst



Ik zat vorige week in een politiecel, o.a.
Omdat ik in staat was mijn hersens te gebruiken en voor mijzelf te zorgen, in staat was mijn mond open te doen en de hulp te vragen die ik op dat moment nodig had.
Ik was goddank geen 12/13 (meer).
Een deel van de politie had daar een paar uur later wat andere meningen over. En een standaard procedure als antwoord op de vraag over het gebruik van een telefoon. Dankzij het bestaan van (niet eenduidige) protocollen was het niet nodig te luisteren laat staan na te denken.
Niet voor hen.

Diezelfde dag werd er een man door een zich blijkbaar in het nauw gedreven voelende agent van de Amsterdamse politie doodgeschoten, 2 anderen verwond. Er loopt een intern onderzoek, die dood zal ongetwijfeld verschrikkelijk zijn ook voor de ambtenaar die schoot, dus de vraag naar de procollen ongetwijfeld een belangrijk instrument ook voor hem.

Hoewel kennelijk nog kantje boord waneer een agent meent dat een protocol voorschrijft bij tegenstrijdigheid in het protocol - al dan niet met daartoe aanwezige toegezegde assistentie - gehandschoent aan mijn lijf te moeten zitten, weet ik dankzij 2 isolatiecellen en vele uren dat ik ook protocollen heb.
Om mijn PTSS, een in ruil voor afwezigheid van Recht ongevraagd en ongewenst cadeautje van Rooms Katholieke Kerk en de Nederlandse Staat, de baas te zijn. Door heel goed te luisteren en na te denken. Naar mijzelf en over mijzelf. Mijzelf te kunnen weg houden van een grens waarachter ik weet dat de hel en haar kelders bestaat.

De prijs hiervoor betaald is op geen wijze te verantwoorden.

Aan wie had U willen terugbetalen, Mijnheer Deetman?

Wim Deetman, lid van de Raad van State, overtreedt sinds 2008 wettelijke regels voor neveninkomsten uit publieke functies. Hij ontving ten minste 75.000 euro ten onrechte aan inkomsten uit met name voorzitterschappen van overheidscommissies.
Dat blijkt uit onderzoek van NRC Handelsblad.

Het ministerie van Binnenlandse Zaken onderzoekt of Deetman de regels heeft overtreden. Deetman zegt terug te betalen als blijkt dat hij onterecht geld heeft geïnd.

Herman Tjeenk Willink, vice-president van de Raad van State, heeft Deetman aangesproken op het feit dat hij verzuimd heeft al zijn bijbanen op te geven. De betreffende bijbanen zijn daardoor nooit gepubliceerd op de nevenfunctielijsten van de Raad van State.
Dat is in strijd met de wet.

Volgens Deetman ging het om incidentele klussen.

Wim Deetman, vaak in het nieuws als voorzitter van de onderzoekscommissie naar het seksueel misbruik in de Rooms-Katholieke Kerk, blijkt de staatsraad met de meeste bijbanen. Een deel daarvan zijn voorzitterschappen van ministeriële advies- en onderzoekscommissies. Deze bijbanen vallen onder de regels van het Besluit vergoedingen adviescolleges en commissies.
Volgens dit besluit heeft een lid van een rijkscommissie geen recht op een vergoeding als de optelsom van de inkomsten uit al zijn publieke banen en bijbanen meer is dan een ministerssalaris (123.910 euro). Deetman verdiende in 2010 alles bij elkaar meer dan 180.000 euro, grotendeels uit publieke middelen. Hij had volgens de regels zelf “terstond” moeten melden dat hij boven de norm uitkwam en dat hij geen recht had op de commissievergoedingen.

Dat hij dat niet deed, kwam omdat hij zich “niet bewust” van de regels was, zegt Deetman.
Vorig jaar ontving hij tenminste 35.000 euro in strijd met de regels. Sinds 2008 minimaal 75.000 euro.

Ook is Deetman, terwijl hij zich privé liet inhuren door de provincie Limburg, als staatsraad opgetreden in bestuursrechtelijke beroepsprocedures tegen de provincie Limburg. Volgens de wet mogen staatsraden geen nevenfuncties hebben als daardoor hun onpartijdigheid en onafhankelijkheid, of het vertrouwen daarin, in het geding is.

Tjeenk Willink vindt dat Deetman niet over de schreef is gegaan met zijn adviseurschap voor Gedeputeerde Staten. De nevenactiviteiten hadden “feitelijk noch juridisch” een relatie met de zaken waarover de Raad van State uitspraak heeft gedaan. Willink wil van Binnenlandse Zaken “uitleg” over het vergoedingenbesluit.

O’Gorman to address top clerics in Rome on abuse

One of this country’s most vocal abuse victims has been invited to Rome to address some of the world’s top archbishops and bishops on how best to respond to victims of clerical abuse.

Colm O’Gorman, who was abused by Fr Sean Fortune in the diocese of Ferns in the 1980s, is the first survivor to have received an invitation specifically to discuss the Church’s response to such complaints.

It’s understood that more than 100 clerical and lay representa
tives working in the field of child protection will attend the Anglophone Conference in Rome this summer.


Last year’s Anglophone Conference was scheduled to take place in Athlone but was cancelled and transferred to Paisley in Scotland.


Dublin Archdiocese Auxiliary Bishop Eamon Walsh will also attend as will the director of Child Protection and Safeguarding, Andrew Fagan. It’s believed six clergy and lay people will represent Ireland.

Yesterday, Mr O’Gorman, who was speaking in a personal capacity, said his speech to the conference will address "effective listening, the experience of those who have been abused by priests and their bad experiences with the Church’s response".

"There are challenging things that need to be said. I value frank engagement and I expect the church leaders will question me so that we have a frank upright conversation. Often with church leaders, you find a strong sense of concern but that does not necessarily lead to meaningful engagement thereafter," he said.

Last year, Mr O’Gorman was one of a number of survivors who met American Cardinal Sean O’Malley as part of Pope Benedict’s Apostolic Visitation to this country.

Silence continues to shroud the case of the Dominican nun who was questioned by the police after allegations of abuse at Lourdes Home in Gozo, as the Archbishop’s Curia yesterday told this newspaper it is not their policy to make public comments on such cases.

Questions were sent by this newspaper to the Archbishop’s Curia regarding the whereabouts of the nun who was questioned by the police, after allegations of abuse at Lourdes Home in Gozo emerged.

However the replies followed the line that the alleged case referred to the Gozo Diocese, not the Maltese Diocese, and that it was the policy of both dioceses not to make public comments about individual cases.

Commenting on reports that there had been attempts to keep the case hushed up, as it causes great damage to the Church on the eve of a referendum on divorce, the spokesperson said “neither the Curia of Malta nor of Gozo did anything to keep the case from becoming known.”

Back in April 2006 sister newspaper The Malta Independent on Sunday, together with Bondiplus, revealed allegations of abuse at Lourdes Home that mainly concerned Sr Josephine Anne Sultana and Sr Dorothy Mizzi.

These related to the period between 12 December 1975 and 30 October 1984, when Sr Carmelita Borg was Mother Superior.

A second case of abuse by the clergy also shrouded in secrecy is that of a teenager which emerged recently, when the youth also came forth with a story of sexual advances by a priest in the past months, as was reported in the media last Sunday.

It was reported that the abuse used to happen when the teenager attended youth group meetings in a convent in the South of Malta, supposedly where the family thought the youth was in a safe environment.

It was also reported that the case is being investigated by the Curia Response Team, although it appears not by the police.

Last week Pope Benedict XVI issued guidelines telling bishops around the world to report suspected cases of abuse of minors to the police.
“Sexual abuse of minors is not only a canonical crime, but also a crime that necessitates legal action,” Pope Benedict XVI wrote in the letter.

UN committee hears ‘vast majority’ of women entered Magdalene Laundries voluntarily or with consent

THE DEPARTMENT of Justice has told the UN that, as far as it is aware, the vast majority of women who went to Magdalene Laundries run by Catholic institutions in Ireland “went there voluntarily or, if they were minors, with the consent of their parents or guardians”.
Today was the second day Ireland appeared at the UN hearings to discuss how it is implementing the provisions of the UN Convention against Torture.

Speaking on behalf of the Department of Justice, the department’s secretary general Sean Aylward told the UN’s Committee Against Torture that because the alleged events happened “in most cases” a long time ago in privately-run instutitions, information is limited.The committee had asked how the Irish government intends to provide justice for women who were held in the Magdalene Laundries.
Aylward said that the only situation where women were ordered to be detained at the centres by law related to just one institution in Dublin, which was used as a remand centre and subject to inspection by the state. He said the government has not found any evidence to date of a complaint of mistreatment of women remanded there.
He said that the Irish government is considering “how best to resolve the issues raised by the women”, particularly as some of the organisations which ran the laundries still exist. Aylward said the government would be making a decision “on this matter in a matter of weeks”.


The Justice for Magdalenes group had submitted a report to the UN committee claiming that the “Irish state was complicit in the incarceration of women and girls” in the laundries, where the women worked without pay. It also said that the state dealt commercially with the laundries without inspecting them.
The group says that while the laundries were in operation between 1922 and 1996, an estimated tens of thousands of women and girls “were imprisoned, forced to carry out unpaid labour and subjected to severe psychological and physical maltreatment”.
It also accused the government of failing to “promptly and impartially investigate” the allegations made against the laundries.

Aylward told the committee today that the government was not in a position to restore funding cut from the Human Rights Commission and the Equality Authority because of the current economic situation, according to a report from the committee after today’s hearing. He said that the government would work with the two bodies to help them work within their budgets.

The committee is due to present its report on Ireland on 3 June.

State defends response to Ryan report

The government has defended its response to reports of clerical child sexual abuse and the committal of women to Magdalene laundries, saying it can’t “rewrite its history”.

It has also rejected criticism of its human rights record and announced it will ratify a United Nations protocol enabling more international scrutiny over places of detention.

At Ireland’s first hearing before the UN Committee Against Torture in Geneva yesterday, Department of Justice secretary general Seán Aylward said human rights were central to Ireland’s domestic and foreign policies.

He addressed criticism made by several committee members about the Government’s response to the Ryan report into clerical child sex abuse and its failure to agree to calls for a statutory inquiry and redress for women committed to Magdalene laundries.

“Some of the issues that are raised and looked at in the Ryan report and that have been raised in relation to the Magdalene laundries relate to a very distant, far-off time,” said Mr Aylward in his initial response to the committee’s questions and observations.

“Many of the people who suffered in that period or were victims of it are no longer with us and it would be very difficult for the State to rewrite its history or right the wrongs that were done,” he said.

Mr Aylward, who told the committee he would give a detailed response to their questions today, said there was “a need to have a sense of proportion in what people say” about these issues.

Magdalene laundries were institutions for “fallen women” who broke the conventions of society by bearing a child out of wedlock. Some of these women have made allegations of abuse against these mainly church-run institutions, the last of which in Dublin was shut in 1996.

The Irish Human Rights Commission has recommended the Government establish a statutory inquiry into the treatment of women and girls in the laundries. It has also recommended that redress be provided as appropriate.

The Government is still considering its response to the commission’s report and lobbying by survivors advocacy group Justice for Magdalenes.

The UN committee is holding two days of hearings to question the Government on its record on the rights of those held in detention.

On the opening day of the hearing yesterday committee member Xuexian Wang said he agreed with submissions to the committee by human rights groups that the Government should carry out an inquiry into the committal of women to Magdalene laundries.

“This is not just a historical wrong – this is an ongoing wrong. It seems to me that the Government is duty bound to redress the situation of those still alive and suffering,” he said.

Committee rapporteur Nora Sveaass said it was the State’s responsibility to punish those responsible and suggested the State consider a redress scheme for victims. “My question is when will it happen,” she asked.

Several committee members also questioned the Government on its failure to implement all the recommendations of the Ryan report into clerical child sex abuse.

There were also questions raised about prison overcrowding, the State’s policy on abortion, the low acceptance of asylum claims, the independence of the Garda Ombudsman’s office and the administration of drugs to people with mental illnesses.

Mr Wang questioned the effectiveness of the State’s policy on preventing rendition flights, which he said relied too much on the public supplying information about rendition to the Garda. “I think it is up to the Government to clear up this issue,” he said.

The hearing continues today and will conclude this evening.

UN Committee to question Ireland on human rights record calls on Ireland to investigate Magdalene Laundries abuse

THE UNITED NATIONS’ Committee Against Torture will question the Irish government about its human rights record in Geneva today: questions will revolve around prison conditions, the treatment of asylum seekers, children in detention and the treatment of women sent to the Magdalene laundries.

The committee was briefed by the Irish Human Rights Commission and human rights NGOs lat Friday, according to the Irish Times. It is the first time that Ireland will be questioned about its human rights record by the UN.

Justice for Magdalenes (JFM), the survivor advocacy group, is calling on the Irish government to act immediately on foot of calls from members of the United Nations Committee Against Torture (UNCAT) for an independent investigation into human rights violations in the Magdalene Laundries and redress for the women who suffered.

The United Nations Committee Against Torture (UNCAT) today examined Ireland for the first time in Geneva, Switzerland. Today’s examination follows the “closed” NGO Briefing Session on Friday last, when JFM was invited to make a statement before the Committee (copy attached, below). Tomorrow afternoon, the Committee will hear responses from the Irish government delegation to the questions asked today.

At today’s examination, Committee members asked numerous questions of the Irish government about its intentions to investigate the Magdalene laundries abuse promptly, impartially and comprehensively, in accordance with its obligations under articles 12 and 13 of the Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment. The Committee also requested information from the state as to how it will ensure redress and compensation for the women who suffered in the Magdalene Laundries, in line with its obligation under Article 14 of the Convention.

JFM PRO Claire McGettrick said: “JFM believes the State can fulfil its responsibilities by obtaining reparations from the Catholic Church for its part in the women’s abuse. The majority of survivors are aging and elderly, and adversarial models of inquiry and redress would have the opposite effect of adding to their pain and sense of injustice.”

Maeve O’Rourke, who presented JFM’s submission to the Committee, said: “The UN Committee against Torture, along with the Irish Human Rights Commission, has taken an extremely serious view of the abuse of women and girls in the Magdalene Laundries and the state’s responsibility for it. Today’s comments by the Committee members unequivocally recognise the rights of the women who are still alive to an investigation, an apology, redress and treatment with dignity. I am hopeful that the Irish government will now take this opportunity to respect the human rights of these women, which for so long have been disregarded.”

Professor James Smith (Boston College), member of JFM’s advisory committee, said: “JFM today calls on the Irish state, to offer a formal state apology to all survivors of the Magdalene laundries and that the government immediately establish a statutory inquiry into these abuses. To do otherwise is to cause additional pain and suffering to the women and thereby bring further shame on our nation. The women and their children deserve justice now.”

UN torture body to examine Irish record

THE GOVERNMENT will face questioning by the UN’s Committee Against Torture in Geneva today and tomorrow on its record on the rights of those detained by the State.

This is the first time Ireland has been asked about its record as part of the monitoring process carried out by the UN committee.

The Government will be asked about conditions in prisons, the treatment of asylum seekers and of the women who were sent to work in the Magdalene laundries.

Last Friday the committee was briefed privately by the Irish Human Rights Commission and by a group of human rights NGOs.

ROME (RKnieuws.net) - De congregatie van de salesianen van Don Bosco heeft afstand genomen van de verklaringen en de houding van één van haar confraters in Nederland inzake pedofilie. Het centrale bestuur van de congregatie heeft maandag aangekondigd disciplinaire maatregelen te zullen nemen tegen pater B. Deze Nederlandse pater had verklaard lid te zijn van de pedofielenvereniging Martijn.

Het hoofdbestuur van de congregatie heeft ook kritiek geuit op de verklaringen van Herman Spronck, de verantwoordelijke van de salesianen in Nederland, die begrip had getoond voor pater B.

‘Lid zijn van een vereniging als Martijn is absoluut onverenigbaar met de principes, waarden en tradities van de congregatie’, zegt Francesco Marracani, procureur-generaal van de salesianen. De congregatie betreurt dat pater B. veel mensen heeft gekwetst. ‘Wij begrijpen hun pijn en wij verontschuldigen ons’, aldus de procureur-generaal. ‘Het totale respect tegenover kinderen, adolescenten en jongeren is voor ons fundamenteel en onherroepelijk’, besluit de congregatie in een mededeling.

Inmiddels raakte bekend dat Jos Claes, provinciale overste, pater B. op non-actief heeft geplaatst in afwachting van verdere maatregelen.

Verklaring pastoresteam en bestuur in verband met berichten over pater van B. destijds werkzaam in St.Martinus, Hoogland.
Opnieuw wordt de parochie geconfronteerd met een bericht dat een destijds in de parochie werkzame pater in relatie brengt met het niet in acht nemen van de verantwoordelijkheden die het pastorale ambt met zich meebrengt. De zaken hebben zich afgespeeld in de jaren dat de parochie St.Martinus nog zelfstandig functioneerde.


de feiten

Navraag bij de bestuursleden van die tijd maakt het volgende duidelijk.
Pater van B. woonde van 1990 – 1994 in Hoogland. Hij had, zoals gebruikelijk, een bisschoppelijke benoeming voor de parochie Sint Martinus. Toen het parochiebestuur kennis kreeg van beschuldigingen van ‘seksuele intimidatie’ heeft het bestuur onmiddellijk de banden met pater van B. verbroken en hem aangezegd te vertrekken. Hij kreeg eveneens ontslag vanuit het bisdom en vertrok in mei 1994 uit Hoogland.
Later, van 1999- 2001, heeft hij opnieuw in Hoogland gewoond uitsluitend als lid van de Salesianer communiteit aldaar. Op geen enkele manier was de parochie Sint Martinus bij zijn terugkomst betrokken. Toen hij in 2001 opnieuw in de fout ging, is hij gaan wonen bij de Salesianer-communiteit in Soest.

standpunt pastores en bestuur
Pastores en bestuur keuren de opstelling en de handelwijze van pater van B. ten sterkste af. Ze zijn het volstrekt oneens met de beweringen van pater van B. zoals die in de pers zijn gekomen.
Het (bestuurs)lidmaatschap van een vereniging voor pedofielen en het uiting geven aan deze opvattingen zijn naar het oordeel van pastores en bestuur niet te verenigen met het kerkelijk ambt en de zorgvuldigheid en betrouwbaarheid waartoe een ambtsdrager zich heeft verplicht en is gehouden.

visie en gevolgen
Bij de start van de parochie van Onze Lieve Vrouw hebben wij de contouren geschetst die ons als katholieke kerk in Amersfoort voor ogen staan. We willen duidelijk aanwezig zijn in en bijdragen aan de Amersfoortse samenleving. We willen ruimte maken voor elkaar en voor wat ons overkomt, we willen dienstbaar zijn in het bijzonder aan mensen die gekwetst worden en we willen dit alles realiseren vanuit aandacht voor de diepere dimensies van het leven die de katholieke geloofsbeleving aanreikt.
Op grond van deze visie voelen bestuur en pastores van deze parochie zich verplicht tot buitengewone inzet voor personen of groepen in de parochie die door de berichten van vandaag worden geraakt, ja wellicht het vertrouwen in de katholieke kerk kwijtraken. Het pastoresteam en het parochiebestuur zullen nader onderzoeken of nog speciale maatregelen nodig zijn in verband met deze kwestie en zullen indien nodig ook nadere stappen zetten.

Ouders en kinderen moeten in onze parochie een absoluut veilige context vinden.
Waar dat nodig blijkt zullen bestuur en pastores zelf ondersteuning geven of bemiddelen in contacten tot een doeltreffende pastorale hulpverlening.

werken aan een betrouwbare kerk
De parochie Onze Lieve Vrouw van Amersfoort is bijna een jaar oud, veel is nog in opbouw. De berichten van vandaag, zijn een trieste realiteit. Maar pastores, bestuur en de medewerk(st)ers in de parochie voelen zich nog meer gemotiveerd om samen te bouwen aan een betrouwbare kerk waarin ieder meetelt en waar ieder, van jong tot oud, zich veilig en geborgen kan voelen.

"Een rotte appel in de mand maakt al het overige fruit te schand" Dat is een uitdrukking, die een juf van mij op de lagere school nog wel eens wilde hanteren. Ze gebruikte hem meestal op een wat dreigende toon. En met reden, want ze deed het op het moment dat één van de kinderen de orde in het lokaal dreigde te verstoren. Eén iemand die zich niet aan de regels houdt, daar heeft de hele klas last van.

Sexueel misbruik door priesters van jonge, weerloze, onschuldige kinderen. De schande ervan straalt af op de gehele katholieke kerk.
Rotte appelen zijn het, die priesters. En het spreekwoord klopt als een bus: als katholiek wordt je hierop aangesproken, aangekeken, soms zelfs aangevallen.

Nee, het is geen gemakkelijke tijd om katholiek te zijn, zeker niet als je daar gewoon rond voor uit wilt komen. "Dus jij behoort tot die kerk waar ze..." en maakt u het zelf maar af.
In het spreekwoord is het één rotte appel in een hele mand. Zo is het in de kerk ook. Die priesters hebben het leven van honderden mensen beschadigd. Niets op af te dingen, helemaal waar.

Un prêtre du Haut-Rhin condamné pour agressions sexuelles

Un prêtre de la communauté de paroisses de Willer-sur-Thur (Haut-Rhin) a été condamné le 19 mai à deux ans de prison, dont un avec sursis mise à l’épreuve, pour des agressions sexuelles commises sur deux adolescents en 2003 et 2004.

Le prêtre, âgé d’une quarantaine d’années, a été jugé à huis clos par le tribunal correctionnel de Mulhouse. Relevé de ses fonctions pastorales au moment de la révélation des faits en juillet 2009, il ne pourra plus exercer d’activité en rapport avec les mineurs.

L’évêché de Strasbourg attend la notification de la décision de justice pour la transmettre à Rome, qui a publié par ailleurs le 16 mai une circulaire pour lutter contre les abus commis par les clercs sur des mineurs.

FOR DEALING WITH CASES OF SEXUAL ABUSES OF MINORS
PERPETRATED BY CLERICS



Among the important responsibilities of the Diocesan Bishop in his task of assuring the common good of the faithful and, especially, the protection of children and of the young, is the duty he has to give an appropriate response to the cases of sexual abuse of minors by clerics in his diocese. Such a response entails the development of procedures suitable for assisting the victims of such abuse, and also for educating the ecclesial community concerning the protection of minors. A response will also make provision for the implementation of the appropriate canon law, and, at the same time, allow for the requirements of civil law.

Conclusion:

The Guidelines developed by Episcopal Conferences seek to protect minors and to help victims in finding assistance and reconciliation. They will also indicate that the responsibility for dealing with the delicts of sexual abuse of minors by clerics belongs in the first place to the Diocesan Bishop. Finally, the Guidelines will lead to a common orientation within each Episcopal Conference helping to better harmonize the resources of single Bishops in safeguarding minors.
