Belgie Canada Eric DeJaeger; Bolletje Bolletje Beyond Borders
Bron Beyond Borders
"The work of journalists and documentary filmmakers is key to getting the message to the public that child sexual exploitation must stop," says Rosalind Prober, president of Beyond Borders ECPAT Canada. "These individuals have helped expose the unfortunate situations children all over the world face. With this knowledge, Beyond Borders can help solve the issue and continue our efforts to prevent the problem from occurring any further."
This year's nominees have covered a variety of issues ranging from child sex abuse within the Catholic Church, child brides within polygamous communities, child sex tourism and the human trafficking of children for sexual purposes.
The awards ceremony, taking place on November 21, will feature a keynote address by Beyond Borders, co-founder, Mark Erik Hecht, which underlines how valuable an ally the media is in the fight against child sexual exploitation.
Hecht will tell the incredible story of how in 1995, Catholic priest and convicted pedoph
ile,
Eric Dejaeger, fled Canada to escape new charges for sexually abusing children in Igloolik, Nunavut. He lived freely in his native Belgium for over 15 years until two women, Canadian Sylvia McEachern and Belgian Lieve Halsberghe, teamed up via the Internet to expose the injustice.
"Having met these women and getting them to tell me their story on video, I'm struck by their tenacity in bringing this man to justice," states Hecht. "Through thoughtful investigative work, untiring advocacy and contact with media, they were able to get this man back in Canada to face his crimes. It's really quite remarkable."

Versoepeling van het beroepsgeheim, instrument of dillemma? Horen, zien en spreken
isbruik is uitgebreid.

Danneels en z'n Europeese primeur: Church faces liability ruling by court in priest sex abuse case, RK bedrijfsongevalletjes Wir habes es nicht gewußt
Yorkshire Post

Die zaak in België stinkt!
stap voor stap
namens de feestcommissie: dank U wel.
THE High Court has been asked to give a ruling on whether the Catholic Church can ever be held liable for the wrongdoings of its priests.
A judge in London is to determine what was described yesterday as “an issue of wide general importance in respect of claims against the Catholic Church”.
Although the point to be decided has arisen in a damages action over alleged sex abuse by a priest, any decision will affect other types of claims made against the Church.
Mr Justice MacDuff was told by Elizabeth-Anne Gumbel QC, who represents the woman at the centre of the sex abuse claim, the issue to be determined was whether the Church “can ever be vicariously liable in any situation for any tort at all”.
It was, she said, “a very wide issue indeed”.
Lawyers for the alleged victim say it is the first time a court has been asked to rule on whether the “relationship between a Catholic priest and his bishop is akin to an employment relationship”.
It is being dealt with as a preliminary issue in the damages action brought by the 47-year-old woman, who cannot be named for legal reasons. She claims she was sexually assaulted as a child by the late Father Wilfred Baldwin, a priest of the Portsmouth Diocese, at a children’s home in Hampshire run by an order of nuns.
Ms Gumbel told the judge the preliminary issue was “essentially whether Fr Baldwin should be treated as having been in the position of an employee” of the trustees of the Portsmouth Roman Catholic Diocesan Trust.
“The preliminary issue is intended to determine an issue of wide general importance in respect of claims against the Catholic Church,” she said.
“That is whether any priest carrying out his work as a Roman Catholic priest is in a position akin to an employee for the purposes of imposing vicarious liability on the relevant diocesan trustees or bishop of the Roman Catholic diocese.”
If the answer was yes, then the next issue would be whether the priest was carrying out the actions complained of in circumstances which were “closely connected” with his role and/or work as a priest.
If the answer was no, she said, there would be “no circumstances where the Roman Catholic Church is liable for the actions of one of its priests whether deliberate or careless and however closely connected those actions were to the role of priest”.
Ms Gumbel told the judge this would “place the Catholic Church in a unique position as far as avoiding responsibility for the acts or omissions of any priest working within the church organisation in whatever role”.
The woman’s solicitor, Tracey Emmott, said in a statement the Church claimed the relationship “between the bishop of the diocese and the parish priest in question does not amount to anything akin to a relationship of employment and therefore there cannot be any ‘vicarious’ responsibility for the priest’s acts”.
“That is to say, whatever sexual abuse their priests might commit, it is not their responsibility.
“They are absolved of blame,” she said.
The consequence of the Church winning the preliminary issue “is that they will be able to avoid compensating all victims of sexual abuse by priests, whether in the past or the future”.
She added: “No other organisation has such immunity”.
The solicitor said it was known that several other people who claim abuse at the hands of Fr Baldwin, who died in 2006, are also likely to bring civil claims against the Church depending on the outcome of the proceedings before Mr Justice MacDuff.
The hearing continues.

Opheffing stichting Don Bosco Groep Nederland
4 juni 2011
bron

suing three of his former attorneys, saying they gave him bad legal advice and left him with no part of a $900,000 settlement paid by the Roman Catholic Archdiocese of Portland nearly eight years ago.In the lawsuit filed this week in Multnomah County Circuit Court, the man identified only by the initials G.B. says his former lawyers managed to claim most of the settlement - $877,000, The Oregonian reported.
That still should have left him with $23,000. But G.B. says he has not been paid a penny so far and has been living off Social Security disability payments of about $400 to $500 a month.
His complaint seeks close to $700,000, plus interest.
"He was supposed to get some compensation for what happened to him as a kid, and he didn't," said the man's new lawyer, Jack Polance.
Polance notes the lawsuit is against G.B.'s second set of attorneys, not the lawyer who initially handled the case.
Little else was disclosed about G.B., other than he's suffered a lifetime of damage because of the abuse. G.B. was abused by the Rev. Thomas Laughlin while a student at All Saints School in Portland, the lawsuit said.
Laughlin was kicked out of the priesthood in 1983 after being convicted of molesting boys
The lawsuit outlines a complicated sequence of events that it says left G.B. with next to nothing.
In 2001, G.B. hired attorney Michael "Mickey" Morey to represent him in a suit against the Archdiocese of Portland.
Morey worked on the case for more than two years, and got a $650,000 settlement offer from the archdiocese.
He continued to negotiate for a higher amount, but in July 2003, G.B. fired Morey and hired Portland attorney Frederick T. Smith.
Three days later, Smith negotiated a $900,000 settlement offer, which G.B. accepted. Smith took one-third of the settlement - or $300,000 - as his fee. But Morey believed he was due a large chunk of that fee because he'd done virtually all the work leading up to the settlement.
Smith wouldn't share.
Morey, who is now retired, said Tuesday he was willing to split legal fees for G.B.'s sexual abuse settlement with Smith, but Smith refused to negotiate.
"I worked very hard on that case for G.B. for nearly 2 1/2 years, and literally at the 11th hour and 59th minute, (Smith) comes in, settles the case and says I was entitled to zero," Morey said.
Morey sued his former client.
And in 2004, Multnomah County Judge John Wittmayer ruled Morey had "substantially performed his contractual duties" under his written fee agreement with G.B. and should get $300,000 of the settlement.
The judge also ruled G.B. must pay $72,000 in interest, Morey's costs in litigating the sexual abuse case and Morey's costs to hire an attorney to pursue what G.B. owed him.
The lawsuit filed this week claims Smith and two other attorneys - Jeffrey Boly and Jaculin Smith - gave him bad legal advice by encouraging him to fight Morey every step of the way.
The complaint states that upon advice of the three attorneys, G.B. appealed the case to the Oregon Court of Appeals and the Oregon Supreme Court. The Court of Appeals again sided with Morey, and the Supreme Court refused to rule on the case.
But both courts awarded Morey additional money for his costs.
By the time it was all over, G.B. was ordered to pay Morey $527,000 and Frederick Smith kept the $300,000 he claimed he was due.
The suit also alleges that without G.B.'s permission, Smith gave $50,000 from the settlement to the Portland French School, where Boly is listed as a member of the board of directors.
Frederick Smith and Boly did not return calls Tuesday seeking comment. Jaculin Smith could not be reached.
