Een priester uit Rijpwetering verkrachtte meermalen een minderjarig meisje en wordt veroordeeld, maar mag zich nog steeds priester noemen. Een dominee uit Eindhoven heeft seks met een psychiatrische patiënt en wordt overgeplaatst, maar niet ontslagen.


Twee voorbeelden van seksueel misbruik waarbij ambtsdragers uit de kerk betrokken zijn. In Nederland worden per jaar bij de kerken ruim veertig meldingen gedaan door slachtoffers van seksueel misbruik. In verschillende landen moet de kerk overgaan tot het betalen van grote bedragen aan slachtoffers, in Nederland probeert de kerk zoveel mogelijk te zwijgen.

Vooral kwetsbare gelovigen zijn het slachtoffer.
Annet was zo’n kwetsbare vrouw die haar predikant om hulp vroeg. Het begon met troosten, met praten en liep uiteindelijk uit op seksuele handelingen. Annet: “Als ik vroeg waarom hij dat deed, zei hij omdat hij me wilde leren dat aanraking en seksualiteit ook fijn kon zijn. Aan het eind van zo’n gesprek, zei ik altijd dat hij niet weer hoefde te komen, maar als hij dan wegging, dacht ik: "Dan heb ik ook niemand meer om mee te praten".


Tweede kans

Volgens de Nederlandse kerken is alles goed geregeld. Maar slachtoffers van seksueel misbruik durven nauwelijks over hun ervaringen te praten en voor de kerkelijke daders worden vaak de begrippen vergeving en tweede kans uit de kast gehaald.




Slachtoffer Hans: “Christenen hebben een wasautomaat en daar gooien ze al hun zonden in en het wasprogramma heet vergeving. Dan komt alles er weer wit uit.”


Moeilijk te geloven



Als de dominee of priesters seksuele grenzen overschrijden, kunnen andere kerkgangers dat maar moeilijk geloven.
In 2002 wordt tegen een dominee uit Eindhoven een klacht ingediend. De dominee maakt misbruik van een psychiatrische patiënt die hulp bij hem zocht. Tot ongeloof van het slachtoffer en haar omgeving wordt de dominee niet ontslagen maar overgeplaatst. De kerkgemeenschap kiest de kant van de dominee en het slachtoffer en haar familie worden uitgesloten van de kerkgemeenschap.


De affaire Rolduc begin jaren ’90 brengt voor het eerst aan het licht dat ook in de Nederlandse katholieke kerk misstanden plaatsvinden. Een priesterstudent wordt onder druk gezet door een invloedrijke conrector om een seksuele relatie aan te gaan. Na jaren klapt de priesterstudent uit de school omdat hij de situatie niet meer aankan. De conrector wordt met ziekteverlof gestuurd. ZEMBLA ontdekte dat hij al jaren als priester in Duitsland werkt. Na deze affaire, komen slechts enkele zaken aan het licht. De meeste zaken worden intern afgehandeld mede dankzij de klachteninstellingen die de kerken sinds halverwege jaren ’90 hebben opgericht. Kerk beschermen tegen aansprakelijkheid

De katholieke kerk scherpte in 2007 de regels aan voor haar klachteninstelling, Hulp en Recht. Dit was aanleiding voor de voltallige onafhankelijke commissie die de klachten van katholieke slachtoffers behandelden, om op te stappen, hetgeen door de katholieke kerk werd stilgehouden.


Voormalig voorzitter Y. van Kuijck in ZEMBLA: “De commissie kreeg de indruk dat het veel belangrijker werd om ook de kerk te beschermen tegen allerlei aansprakelijkheidsrisico’s. Daardoor stond de positie van het slachtoffer niet meer centraal en dat was toch het uitgangspunt.”

Volgens P. Nissen, hoogleraar cultuurgeschiedenis van het christendom van de universiteit Tilburg, worden zelden tot nooit priesters uit het ambt gezet. Strenge straffen zijn uitzondering. Nissen: “Ik ken meer voorbeelden van priesters die geschorst zijn en na een tijdje in kerkelijke functies en zelfs weer pastoraal werk kunnen doen, zelfs met jongeren”.

En als die RKK Nederand zoveel (verzekerings) geld wenst uit te sparen?
Dan kunnen ze maar beter dank je wel tegen de Ierse belastingbetalers zeggen en vervolgens eens met die burgervader van Maastricht gaan praten. Maar vooral héél goed naar hem luisteren. Da's het enige geheim van het Ikon én van Diarmuid Martin. Ervan uitgaande dat Mgr. Martin ook celibatair is
hoeft het dus zélfs dáár niet aan te liggen, slechts aan de mogelijkheid tot luisteren.
Politiek hoeft niet ten koste van mensenlevens te gaan.

Die goede naam en faam van de RKK ; damage control Uit de Katholieke Illustratie.

KN-redacteur vraagt heropening zaak Bär geplaatst: vrijdag, 24 april 2009, 15.07 uur

Er zou opnieuw onderzoek gedaan moeten worden naar de achtergronden van het vertrek in 1995 van mgr. Philippe Bär als bisschop van Rotterdam. Dat zei Jan Peeters, redacteur geestelijk leven bij het Katholiek Nieuwsblad afgelopen vrijdag in zijn wekelijkse column voor Radio Maria.

Aanleiding is de commotie rond de vroegere bisschop en huidige president van Paraguay, Fernando Lugo. Die is in opspraak geraakt doordat tot nu toe drie vrouwen hebben geclaimd een foto: KDC
kind van hem te hebben dat verwekt is toen Lugo nog bisschop was. In twee gevallen ging het om meisjes die zestien en zeventien jaar oud waren toen de bisschop er een seksuele relatie mee aanging.

Peeters vindt het een goede zaak dat een van de Paraguayaanse bisschoppen bekend heeft gemaakt dat hij en zijn collega’s wisten dat bisschop Lugo seksuele relaties had. “Die zaak moet naar buiten worden gebracht opdat slachtoffers van seksueel misbruik makkelijker gehoor vinden en een proces van genezing kan beginnen.” Als de Kerk vindt dat zij moet opkomen voor het meest kwetsbare en stemmeloze leven dan geldt dat evenzeer voor slachtoffers van seksueel misbruik, aldus de KN-redacteur. “Al helemaal wanneer zo’n slachtoffer financieel niet in staat is zo’n kind groot te brengen.”

Peeters vindt dat in geval van seksueel misbruik de allereerste aandacht uit moet gaan naar de slachtoffers. Hij erkent dat het kerkrechtelijk ingewikkeld is een misbruikplegende bisschop aan te pakken. Daardoor dreigen zaken in de doofpot te raken.

De KN-redacteur verwees naar de nooit opgehelderde situatie rond het vertrek van de vroegere bisschop van Rotterdam, Philippe Bär. In een latere reconstructie van de zaak kwam Peeters in de jaren negentig tot de conclusie dat geruchten van seksueel misbruik de bisschop de das om hebben gedaan. “Doordat bisschop Bär door kopstukken als Hirsch Ballin en Ruud Lubbers enorm werd geprezen werd het slachtoffers vrijwel onmogelijk gemaakt met hun verhaal naar voren te komen.”

Hij noemt het een “kwestie van rechtvaardigheid” dat de zaak wordt uitgezocht zodat slachtoffers “niet hun hele verdere leven met hun verhaal in een hoekje hoeven te kruipen”. En indien het niet waar is, dan is bisschop Bär zelf het slachtoffer dat van iedere blaam gezuiverd en gerehabiliteerd dient te worden. In beide gevallen geldt dat de zaak moet worden geklaard omwille van de slachtoffers, omwille van de gerechtigheid, aldus Peeters. (KN)

KN wil heropening kwestie Bär

KN-redacteur Peeters komt op het idee een oude koe uit de sloot te halen en de kwestie Bär uit te gaan zoeken, "omdat "het een “kwestie van rechtvaardigheid” is dat de zaak wordt uitgezocht zodat slachtoffers “niet hun hele verdere leven met hun verhaal in een hoekje hoeven te kruipen”.

Nu ken ik wel meer gevallen waarin het slachtoffer geacht wordt "zijn hele verdere leven met zijn verhaal in een hoekje te kruipen", en waarin voor de binnenkerkelijke omgeving de vraag naar gerechtigheid geen enkele rol speelt. Het KN kent ongetwijfeld ook wel meer van dergelijke verhalen - als zij daarin al niet zelf een van de actoren was. Persoonlijk heb ik daarom de illusie al lang laten varen dat gerechtigheid een relevante waarde is in het binnenkerkelijk milieu, inclusief in het R.K. verenigingsleven.

Vraag rijst of het KN zich nu echt zo druk maakt over tardieve slachtofferhulp of dat het KN in het wangedrag van een Zuid-Amerikaanse voormalige bisschop een aanleiding zoekt om zelf in de publiciteit te komen. Persoonlijk houd ik het op het laatste. Als die veronderstelling juist is, lijkt het mij beter dat het KN zich onthoudt van activiteiten waarmee de goede naam en faam van de R.K. Kerk in Nederland bepaald niet zijn gediend.

Was Paul Shanley railroaded?

I've no doubt that the notorious Boston "street priest" Paul Shanley (now defrocked) was a bad man. He's sitting in prison for having sexually abused victims. But did he get a fair trial? Was his guilty verdict based in part on pseudo-science? The Nation writes:

Sex panics make for bad law. It could be said that they make for bad science,
too, except that what has driven some of the most notorious legal cases to
emerge from such panics has been more a masquerade of science, a belief tricked
out in the language of medicine and social science to distract from the mumbo
jumbo at its core. The Massachusetts Supreme Judicial Court is set to be the
latest arena to test that belief, taking up the admissibility of "dissociative
amnesia," or "repressed memory," in a case that some powerful interests no doubt
hoped was as settled as the grave. The petitioner is Paul Shanley, a once famous
"street priest" who became infamous in the sex abuse scandal in the Catholic
Church, was tried in 2005, convicted and sentenced to twelve to fifteen years in
prison. Because the media, particularly the Boston Globe, were central to the
allegations and the frenzy that provided the context, it has always been
difficult to see the case plainly. But because justice, as opposed to its many
stand-ins, is blind, imagine yourself or one you love as the defendant at the
bar.
In October 2004 Dr. Daniel Brown, a Boston psychologist, took the
witness stand in a pretrial hearing at Middlesex Superior Court and offered what
would become the state's only foundation for its prosecution. There was no
evidence in the case, just a claim that depended entirely on faith. Dr. Brown
was in the courtroom to give it the imprimatur of science.
The accuser asserted that from the age of 6, in 1983, he had been raped and otherwise indecently assaulted by the defendant for three years in a busy church on Sunday mornings. Each assault, it was alleged, instantly erased his memory of what had just happened, so that the boy re-approached the defendant in a state of
innocent unknowing, to be assaulted again, to forget everything again and again,
and then move on in life without the slightest inkling of the experience until
twenty years later, when it all came back to him.
Dr. Brown had appeared as a certified expert in courtrooms for years, stating that the mind's capacity for such "massive repression" was generally accepted as demonstrable fact in the psychological professions. That was always false. By 2004, however, as compellingly detailed in documents now before the Supreme Judicial Court, the literature in major scientific publications questioning the validity of
repressed memory was weighty. Many of the therapists whose work Brown
recommended had been disgraced, stripped of their licenses and revealed as
dangerous frauds in successful malpractice suits.


Imagine yourself or one you love as the defendant at the bar. That has a way of making a despicable man caught in such circumstances a lot more human.

Maar wat het dan ook was: het was een meer dan vreselijk proces.
Op een voor mij meer dan gruwelijk moment: ik probeerde, voor de 2e keer mijn klacht in te dienen. Dom. Ik had buiten de kerk en haar hooligans gerekend. Goddank!

De Kerk schopte Paul Shanley én zijn slachtoffers kapot.
De rest? Een zooitje vet betaalde wetenschappers die met hun door de kerk toegeworpen kluif "hij is een monster" aan de rol gingen.
De liegende kerk die haar pondje vlees opeiste, zelfs in Nederland, waar ik mijn twijfels over de gang van zaken niet mocht uitspreken van een rk mediaman.

GRANADA (RKnieuws.net) - Aartsbisschop Francisco Javier Martínez van Granada moet zich als eerste hoge gezagsdrager in de Spaanse kerk voor de rechter verantwoorden, meldt het ANP. De aartsbisschop wordt ervan beschuldigd dat hij een priester van het Zuid-Spaanse bisdom het werken onmogelijk heeft gemaakt.

Aartsbisschop Martínez is aangeklaagd voor belediging, ongeoorloofde dwang en het toebrengen van lichamelijk letsel. De priester die de klacht heeft ingediend, is door de aartsbisschop als pastoor ontslagen.


Volgens berichten in de Spaanse pers verdacht aartsbisschop Martínez de betrokken priester van het achteroverdrukken van goederen van de kerk.


Aartsbisschop Martínez spreekt de aantijgingen tegen. Hij zegt de pastoor te hebben ontslagen, omdat hij geen vertrouwen meer in hem had.



Archbishop accused of bullying fails to avoid being tried in secular court

The Archbishop of Granada has caused a stir in the Catholic hierarchy by becoming the first Spanish cleric of his rank to stand trial in a secular, rather than religious, court.


Archbishop Francisco Martinez made his historic appearance at Granada's criminal court, accused of bullying, moral assault, insults and slander against a fellow priest.


The case, which finally reached court this week after months of obstructions by religious authorities, was brought by the former archivist and canon of Granada cathedral, Javier Medina, whom the archbishop had stripped of all religious duties.


The ousted priest told the court on Tuesday that the archbishop had said: "You are not boss here. You are a bad, disobedient priest and I'm going to teach you obedience with the whip."


The priest sued the archbishop in February for having falsely accused him of illicitly appropriating funds and church property, and of obtaining copyright of a book that Fr Javier wrote about the history of the cathedral.


According to the dismissed priest, the archbishop sacked him for "disobedience", changed the locks on his office and instructed cathedral employees to watch him remove his belongings.


Mgr Martinez has been a controversial figure since he took over the archbishopric. Last year 132 priests signed a document critical of his conservative management of the diocese.


Mgr Martinez denies all charges, and said at a tense court session on Wednesday he was "a victim of assault by the media".



If found guilty, he faces a €45,000 (£32,000) fine.

He has also invested €1,940 on newspapers adverts protesting his innocence, and publicising his latest sermon – on religious persecution.







Spanish parishioners on hunger strike after church removes priest

Eighteen parishioners in the town of Albuñol near Granada have started a hunger strike in protest at the removal of their popular young priest. Up to 300 neighbours have joined the strikers in a church sit-in, holding placards declaring their love for Fr Gabriel Castillo and demanding his return.
"We call the Archbishop in Granada every day asking for an explanation, but they seem to live in another world, very far from the likes of us who are poor and ill-educated," said Consuelo Manzano, a spokeswoman for the campaign.


In his two years at Albuñol, Fr Gabriel, 27, introduced forward-looking practices, such as letting homeless Senegalese live in his house, holding Sunday school on a hillside and appointing disabled altar boys. But his methods antagonised traditionalists, including a local community of nuns who defected to a village about six miles away to hear mass.


Villagers believe the nuns' mother superior complained to Granada's hardline Archbishop, Francisco Javier Martinez, and asked that Fr Gabriel be transferred. "I'm sure they are behind this," says Ms Manzano, who dismisses the Archbishopric's assurance that the transfer is a routine matter. "We want to know the real reasons," she insists.


Parishioners vow to maintain their hunger strike at least until Saturday, when they will send a delegation to the Archbishop of Seville, "since our own Archbishop keeps ignoring us,"

Ms Manzano says.



Seville's Archbishop, Cardinal Carlos Amigo, is renowned for his openness. Archbishop Javier Martinez is embroiled in a lawsuit with another priest, who accuses him of bullying and "moral assault".

Mientras se producía, un grupo de fieles se concentró a las puertas del edificio para rezar el rosario. El pleito entre ambos, que curiosamente se llaman igual, arranca en diciembre, cuando el canónigo pidió al arzobispo que se retractara de las acusaciones realizadas en una carta sobre una supuesta apropiación indebida de los derechos de propiedad intelectual de un libro sobre la catedral encargado por el anterior arzobispo, Antonio Cañizares, cuya publicación paralizó el demandado hace un año. Medidas disciplinares El libro fue encargado por el anterior arzobispo a 35 profesores de siete universidades españolas y una francesa. Tras la paralización de la obra, los autores presentaron una demanda civil por incumplimiento de contrato contra el arzobispo. La denuncia fue retirada la pasada semana tras llegar las partes a un acuerdo que incluye llevar a cabo dicha obra. Sin embargo, el arzobispo inhabilitó al clérigo para ejercer sus funciones sacerdotales, lo destituyó como canónigo y lo retiró de su acceso a la cátedra de Teología. El Arzobispado dijo ayer en un comunicado que Francisco Javier Martínez declaró que su actuación ha estado «siempre dentro del gobierno interno de la Iglesia» y que ha actuado según la normativa de la misma y en el libre ejercicio de su ministerio. El arzobispo se negó a responder a las preguntas de la acusación y dijo que la suspensión al sacerdote de sus funciones se debe a otras actuaciones previas del querellante que le «obligaban a tomar medidas para preservar la libertad o los derechos de la Iglesia». En este sentido, recordó que «jamás ha dado publicidad alguna a las medidas disciplinares que le ha sido preciso tomar, que hubiera sido más cómodo no tomar y que también hubiera deseado no tener que tomar». La remoción en el oficio de canónigo está vinculada, según la nota, a la «negativa del querellante» a entregar al arzobispo y al Cabildo -con el fin de que pudieran disponer de forma adecuada sobre su publicación- un libro de la catedral en sus «aspectos teológicos y pastorales» que le había sido encargado en el año 2000. El sacerdote interpuso la querella después de haber apelado a la Santa Sede, quien le impuso unas condiciones que «nunca cumplió». Por eso, dice el Arzobispado, abandonó ese ámbito jurisdiccional y se dirigió a los tribunales civiles.

Limburgse kranten stimuleren discussie rol RK-Kerk

SITTARD (RKnieuws.net) - Dagblad De Limburger en het Limburgs Dagblad
hebben maandag op internet een discussieplatform geopend over de rol van de
Rooms-Katholieke Kerk in de Limburgse samenleving. Dat heeft het ANO
gemeld.

Lezers en niet-lezers van beide kranten kunnen permanent met elkaar in discussie gaan over de positie van de kerk. Dat hebben beide kranten maandag
laten weten.
Het platform biedt bijvoorbeeld ruimte voor reacties op de manier waarop het bisdom Roermond met de affaire van oud-deken Joep Haffmans van Gulpen is
omgegaan. De zaterdag overleden geestelijke werd van verduistering van kerkgeld en belastingontduiking beschuldigd en zat enkele dagen gevangen.

Stimulans
De affaire-Haffmans heeft volgens Johan van de Beek, lid van de
hoofdreactie van beide kranten, de discussie sterk gestimuleerd. Veel Limburgers
bleken in het reine te willen komen met hun ervaringen in de tijd dat de zeer
behoudende bisschop Jo Gijsen (1972-1993) het bisdom Roermond bestuurde. De
krant bundelde in april de reacties in een bijlage.Een eyeopener was de
discussie die de kranten in diezelfde maand organiseerden, zegt Van de Beek.

Veel gelovigen verhaalden toen over hun pijn, teleurstellingen en ook
traumatische ervaringen met priesters en de kerk.

Sommigen noemden pastoors "net inquisiteurs’’.

De algemene stemming was: "Wij zijn de kerk. De kerk is niet het probleem, de leiding is het probleem’’.
Bisschop Frans Wiertz van Roermond had geweigerd aan het debat deel te
nemen. Volgens zijn woordvoerder zag hij het belang ervan niet in.

Zoals ik al eerder schreef: katholieken zeg het abonnement op het Limburgs Dagblad of de Limburger op. Dat is de enige taal die ze verstaan!

Zal hij het nihil obstat verkrijgen van de Limburgse pastoor?

Of wordt met bischoppelijke steun en het populariteits-metertje in de Mazen van het net hij toch een amicaal-confronterende zij? Zullen de aartsbisschoppelijk ingewijdde digitale kaarsen hier tegen opgewassen zijn?
Naar verluid is inmiddels ook Mokum-tv al druk bezig met een nieuw Staats-testbeeld.


Dezer zijds vooral mijn medeleven met slachtoffers -en in het bijzonder nu een aantal vrouwen die "zelf zouden hebben ingestemd" - van dit soort RK smeerkezerij
En dat zullen er ook in Nederland heel wat zijn.
Moge de Limburger nu eens niet regionaal blijven!

These days, a day hardly passes before another scandal involving clergymen hits the pages of a newspaper. The frequency with which it happens suggests that either the media is now ever more vigilant in scouring for news about an otherwise existing problem, or that the clergymen we have today are degenerating so badly, so fast, that very soon they will not have the moral pedestal to stand on and preach to their congregations because of ethical deficiencies.

These scandals are so diverse in nature to include alleged practicing of witchcraft, breaking of the celibacy vows, adultery, polygamy, polyandry, bigamy, wife and husband snatching, extortion, murder, obtaining money, goods and services by false pretence, sodomy, murder e.t.c.

Matters are not helped by the extremely flamboyant and opulent lifestyles they lead, in deep contrast to the majority of the poor, tithe-abiding congregations they lead. Apart from the flashy cars, clothes and mansions, many a clergyman is alleged to have extensive loads of cash stashed away in accounts in banks abroad, courtesy of their perennial begging sprees from unsuspecting and only too willing foreign donors under the guise of using funds to look after Aids orphans, spreading the good word of the Lord through radio and television, building schools, hospitals, churches e.t.c.

Our countrymen are certainly God-fearing and will not hesitate to contribute their hard earned cash to Godly causes

This seems to be the Achilles heel that some of these clergymen have discovered and are now on rampage to fleece their unsuspecting flock, under the guise of using the Lord's name.

Honestly, it is only a shameless manipulator who will stand in front of a church and suggest that for people to get God's blessings for either prosperity or good health, they should put specific sums of cash in the church basket. As a matter of fact, with tongue in cheek, the manipulators will even advise on the lowest accepted amounts one should put in the basket! Where does this leave the very poor that Jesus so much loved in his ministry?

As if this is not bad enough, some of these fellows are lecherous and have broken many homes. This they have done by invoking the Lord's name to suggest that unhappy couples were mismatched from the word go. To circumvent this situation, the wives need to free themselves from the yoke of a loveless marriage.

They should then come to the church, where the clergymen will "pray" for them to obtain truly ordained husbands from God. Fast forward and you will find that these clergymen are maintaining harems of unsuspecting victims, each one thinking that she alone has an illicit affair with the clergyman, which secret she should jealously guard! Now comes the story of the times, in which a clergyman has been found with an electric gadget to use in shocking his flock, in a simulation of exorcising demons.

To my amazement and shock, I read early last week, a story in the newspapers about an incident in which it was alleged that a clergyman had locked the body of his just deceased estranged wife in his house to prevent her relatives from giving her a decent send off and burial.
Not until they first surrendered the land title to the house that the deceased owned, which he now forcefully wanted to inherit! It took some tough persuasion from the police before he could relent and release the body. It will not take long before another story pops up, because it seems Ugandan clergymen are truly wired for scandal!

Uganda: Police Open File On Fake Pastors

THE Police have opened a general inquiry file on fake pastors countrywide.

Announcing the move, Police spokesman Asan Kasingye on Friday called on people to use the opportunity to report dubious pastors.
"Every person with a complaint against a particular pastor can come to us and give us information," he appealed, while addressing a news conference at the Police headquarters in Kampala.

The Police open a general inquiry file when there are several complaints about an issue from members of the public. "We open the file in absence of a particular complainant so that we can confirm the allegations and also find a way forward," Kasingye explained.

The Acting Commissioner (crime), Elly Womanya, who is stationed at the CID headquarters at Kibuli in Kampala, will receive all complaints.

The media has lately been awash with reports about the activities of pastors, many of which border on crime.

The Sunday Vision over three weeks this month serialised the activities of pastors who coerce their flock into "sowing" their valuables in exchange for blessings from God.

Several people have alleged that pastors take their vehicles and land titles with promises that they will cure them of HIV/AIDS, among other miracles.
"If someone reports to us that they have been threatened or intimidated, we shall take action," Kasingye warned.

He cited embattled Pastor Obiri Yeboah Kojo, who last week asked Pastor Samuel Kakande of the Synagogue Church Of All Nations to apologise to him or "face God's power within 60 days".
The Police are investigating Kojo over allegations of importing a device designed to give electric shocks, but Kojo accuses Kakande of framing him.

Kasingye also said Pastor Grace Kitaka, who is accused of sodomising Julius Lukyamuzi, had been interrogated.
Meanwhile, it emerged that Kojo is not wanted by the police in Ghana. The Police had early in the week warned that Kojo would be extradited over allegedly defrauding a woman of the equivalent of sh17m. Kasigye said the man Ghanian police seek is Alex Yeboah.

ROERMOND (RKnieuws.net) - De bisschop van Roermond bereikte zojuist het bericht dat heden, in zijn woning te Sittard, ten gevolge van een hartinfarct, oud-deken Joep Haffmans plotseling is overleden. De bisschop is door dit bericht diep geraakt en geschokt. Hij hecht eraan om zijn gevoelens van medeleven kenbaar te maken aan de familie Haffmans en aan diegenen die zich met de oud-deken verbonden voelden. Hij zal de overledene insluiten in zijn gebed.

"Wij weten allen, dat in het afgelopen jaar een justitieel onderzoek tegen de oud-deken liep, dat in de komende maanden tot een afronding zou komen. Het ontvangen van het bericht van zijn plotseling overlijden maakt ons er pijnlijk van bewust, hoe kwetsbaar het menselijke leven is.

Wij treden terug in ons oordeel, nu oud-deken Haffmans is aangekomen bij de hemelse Vader, de God van barmhartigheid. Alleen aan Hem komt het oordeel toe," aldus de bisschop. "Wij begeleiden de overledene met onze gebeden. Moge hij rusten in vrede."

Wat verschrikkelijk voor de man en de zijnen.

Misschien kan er dan nu eindelijk gesproken worden over datgene waar het nu eigenlijk over ging:
wie er binnen die kerk , dat bisdom, nu eigenlijk hoe verantwoordelijk was voor misbruik van vertrouwen, dat het leven en de gezondheid van anderen beinvloedde!

Inplaats van gebruik te maken van de dood van de man met argumenten als "wij treden terug in ons oordeel" en God als rechter.

Een rk kerkelijke hierarchie bestaat omdat niet slechts personen individueel verantwoordelijk zijn binnen, maar de kerk als institutie !

Om dan nu het bisdom Roermond meteen maar helemaal op te heffen, of communaal over te stappen naar de PKN ten gevolge van deze man en diens dood, lijkt mij wat overdreven!

Ze schijnen daar in Roermond mbt. hun eigen leer in ieder geval wel heel erg hardleers te zijn
en er een knap cynisch minachtende uitleg van

Hubert O'Connor, the disgraced Roman Catholic bishop, has died of a heart attack in Toronto. He was 79.
His death was announced by the Canadian Conference of Catholic Bishops.

He resigned as bishop of the British Columbia diocese of Prince George after being charged with sex crimes in 1991.

He was convicted in 1996 of committing rape and indecent assault on two young aboriginal women during the 1960s when he was a priest. He was sentenced to 2 1/2 years in prison by Mr. Justice Wally Oppal, who is now British Columbia's attorney general. After serving six months, the disgraced clergyman was released on $1,000 bail.
The B.C. Court of Appeal later acquitted him of sexually assaulting a student at a Williams Lake residential school, where he was principal.
The appeal court also set aside his conviction for rape of a school secretary, ordering a new trial.

Instead, authorities agreed to drop the rape charge after the former bishop apologized to his accuser in 1998 at a traditional native healing circle held at Alkali Lake, a small native village near Williams Lake in the B.C. Interior.

Earlier, he had told court during a bail hearing that "if I had not broken my vow of chastity (klik)I would not be here today. I have paid a very heavy price." (klik)

Court heard lurid details about a predatory priest who used his position to attain sex, which he would later insist was consensual (klik)
A former student testified he had ordered her to clean his bathroom, then pulled her onto his bed and said: "Let's have some fun."

The former secretary testified he had once presented her with a Christmas gift of a statue of the Virgin Mary before feeling her breasts and trying to kiss her.

He maintained his innocence throughout the long court battle, arguing his accusers had
consented to sex. He admitted to fathering a child who was placed for adoption.

The case attracted widespread attention, as it became a symbol for debate about the role of the justice system in handling cases of aboriginals abused at church-run residential schools.
The original charges were suspended when the defence successfully argued the Crown failed to provide the records of the therapists and psychologists who treated the accusers. A defendant's right to such access was upheld by the Supreme Court of Canada, a decision bitterly denounced by women's groups and advocates for sexual assault victims.

Parliament later passed Bill C-46, which offered some privacy protection (klik)regarding a complainant's counselling records in such cases.

..... Gijsen wijdde Haffmans in 1974 tot priester. Dat besluit is omstreden, sinds emeritus hoogleraar Ad Blijlevens, van 1988 tot 1992 rector van de Hogeschool voor Theologie en Pastoraat (HTP) in Heerlen, vorig jaar in deze krant onthulde dat Gijsen in weerwil van waarschuwingen over een dubieuze levensstijl Haffmans tóch tot priester wijdde.

Vanuit de HTP, waaraan Haffmans begin jaren zeventig studeerde, kwam het advies dat Haffmans " vanwege zijn levensstijl en geaardheid" niet geschikt was priester te worden. Blijlevens zei dat de HTP concrete signalen kreeg die te maken hadden met Haffmans’ "homoseksuele geaardheid en vooral hoe hij in de richting van medestudenten daarmee omging". De HTP-leiding informeerde het bisdom, maar vond daar geen luisterend oor.

"Haffmans moest en zou tot priester worden gewijd. Gijsen hanteerde blijkbaar andere criteria dan wij."

Reno's former Roman Catholic bishop, Phillip Straling, supported building a facility for priests accused of molesting children when he was bishop in San Bernardino, Calif., and used some of the priests held there to work in his diocese, according to testimony from a priest who led the group that ran the center.

The Rev. Joseph McNamara revealed Straling's involvement in the creation of the Servants of the Paraclete facility in Cherry Valley, Calif., during his June 21 testimony in the massive legal case against Los Angeles-area priests accused of sexually abusing children.
The Diocese of Los Angeles settled that case last week for a record $660 million.

The Southern California facility, built in Straling's San Bernardino diocese in 1980, was used as "a clerical prison for holding known child sex offenders from all over the country instead of turning them over to the police," said Patrick Wall, a consultant with a Southern California law firm handling hundreds of cases against priests.

When consulted by McNamara on setting up the center, Straling gave his approval of the plan and saw it as a way to bring in new priests to help with his short-staffed diocese, the testimony showed.
Straling declined to comment on the priest's testimony, and said he had been advised by lawyers for the Diocese of San Bernardino against talking about any pending lawsuits, said Brother Matthew Cunningham, spokesman for the Diocese of Reno.

Straling is a witness in some San Bernardino cases.
Straling instead referred questions to the Rev. Howard Lincoln, spokesman for the San Bernardino diocese. Lincoln said McNamara's statements were generally true.

"Bishop Straling supported their work and their mission of helping troubled individuals," Lincoln said of the Servants of the Paraclete.
"We did use members (priests who worked at the facility) as supply priests," Lincoln said. "We also used guests who had been placed in Cherry Valley as a sort of 'halfway house' for alcoholism.
"We have no records to indicate that we utilized guests as supply priests who had been placed with the Paracletes for issues of sexual abuse," he said.

The Paracletes reached a peak of having about 23 centers in the 1970s to 1990s that catered to priests who had problems with alcoholism or sexual activity, including the sexual abuse of children, Wall said.

Most centers were closed because of a sex-abuse scandal and only three facilities still are operating — one, located in Minnesota, in the U.S., Wall said. The centers were the subject of growing criticism as being used to protect abusive priests.

When priests were sent to a center, “they weren’t reported for their suspected criminal activities and no warnings were given to the communities,” said Dr. Gilbert Kliman, the medical director of the San Francisco-based Children’s Psychological Health Center and an expert witness in the L.A. lawsuits.

“The priests were often referred back to the same people who had referred them there, and many priests returned to ordinary duties, including contact with children,” he said.Straling, who retired unexpectedly in 2005, was not named in the Los Angeles suits, but is a key witness in about 170 lawsuits in San Bernardino and San Diego filed against priests accused of molesting children.

In some cases, Straling is accused of negligence for failing to stop the abuse. The former bishop was called in to testify on those cases in December. His deposition has remained sealed while the bankruptcy case filed by the San Bernardino diocese is considered by the courts.

Straling also came under fire in late 2005 from several Reno residents who said they were abused by priests in the Reno diocese.
One woman, who accepted a $50,000 settlement from the Reno diocese for abuse she said she suffered by the Rev. David Brusky, said Straling lied to her about Brusky’s condition and led her to believe he had suffered a stroke and was incapacitated.

But a visit by the Reno Gazette-Journal revealed that he was healthy and able to move around his Milwaukee assisted-living home. The woman and several others had said at the time that they were considering filing a new lawsuit against the diocese for this and other cases, but none has been filed. The woman said last week that a new lawsuit was unlikely at this point, given the cost and stress of such legal action.

Retreat for problem priests
After working as a priest in San Diego, Straling was appointed as the first bishop of the newly established San Bernardino diocese in 1978, and became the Reno bishop in 1995.
According to the lawyers in the San Bernardino and San Diego cases, Straling lived and worked with priests who were later accused of abusing children, but did not report the abuse to authorities. Straling has denied any knowledge of abuse.

When the San Bernardino diocese was established, more than a dozen priests who were later accused or charged with molesting children worked there, and Straling had made many of these priests officials in his diocese.

It was during the early years as the new bishop in San Bernardino that McNamara sought approval from Straling for the Servants of the Paraclete problem-priest facility in Cherry Valley.
According to letters between the leader of the Servants of the Paraclete and various dioceses at that time, their mission was to create a “retreat for priests with problems.”
They sought financial support from Catholic leaders across the country to help them “provide shelter for the sick whether their ills stem primarily from the soul or from the body,” according to the letters obtained through the Los Angeles litigation.

Some of the cases included priests who “have been addicted to abnormal practices, especially sins with the young.” One priest who was sent to a Paraclete center from a church in New Hampshire did not have a drinking problem, the bishop told the servants, but had been involved in “a series of scandal-causing escapades with young girls.”

The bishop wrote to the head of the servant facility in Jemez Springs, New Mexico, asking to send the priest to a new location: “The solution of his problem seems to be a fresh start in some diocese where he is not known.”

Some of the priests who became “guests” at servant facilities were used by the local diocese to help out with the needs of the churches, McNamara said in an affidavit given in November 1993.
The mental-health experts at the facility said segregating the priests with “psychosexual difficulties” from others “would be counterproductive to rehabilitation.” They recommended that the priests work as “supply ministry” to the local diocese, McNamara said.
Straling was interested in that possibility when the Cherry Valley facility was proposed, McNamara said.

New center
In his deposition for the Los Angeles lawsuits, McNamara said the archbishop of Los Angeles at the time, Cardinal Timothy Manning, wanted to use the services of the Servants of the Paraclete for his priests.

Manning retired in 1985, and was followed by Cardinal Roger M. Mahony.
Manning actually toured the Paraclete’s New Mexico center to see how it was operated, McNamara said.

The lawyer questioning McNamara asked whether Manning knew why the priests were sent there, and he said Manning, like every bishop in the country, was “aware of priests who had — had not lived up to their expectations, or — or priests who had simply kind of given up.”

Following that tour, Manning discussed opening a facility in the Los Angeles area with the head of the servants at the time, McNamara said.
McNamara said the Rev. Gerald Fitzgerald, the leader of the Paracletes at the time, sent him to speak with Bishop Straling.

He met Straling at the diocese and discussed establishing a center within the San Bernardino diocese, McNamara said. McNamara said he wanted to see whether Straling would be open to such a facility.
“And what was his response?” the lawyer asked.
“He seemed favorable — favorable to it because — well, he had his own reasons, but he seemed favorable to it,” McNamara said.
McNamara said Straling’s diocese was short-staffed, and the bishop hoped the new Cherry Valley facility would bring new priests to the region to help with the diocese.

“Now, was he, if you know, considering members or guests or just members” to work for him, the lawyer asked. The members were the priests who worked at the facility and the guests were the problem priests sent there.
“I think he was considering both,” McNamara said.

The lawyer asked what happened after talking with Straling, and McNamara said they took it as the green light to go ahead and purchased property in Cherry Valley for the facility.
He asked whether the servants spoke with any other Catholic leaders in Southern California about the inception of the Cherry Valley facility, and he said, “No. Just with Bishop Straling.”

“And did, in fact — once the Cherry Valley facility was opened, did it serve his purpose of providing some additional priests to help in his diocese?” the lawyer asked. “Yes,” he replied, adding that both members and guests were utilized.

“What kind of work are we talking about,” the lawyer asked.
“Mostly a weekend ministry, helping out on, say, Mass on the weekends, or when they happened to be on retreat and they needed priests to fill in, we would be there,” McNamara said.

Archdiocese releases documents on priest abuses

PORTLAND -- The Archdiocese of Portland released 30 previously secret documents Wednesday detailing sexual abuse of boys by priests.

They included psychological evaluations, allegations by victims and some candid detail of what went on between some priests and their young parishioners over several years. The documents make clear that church officials had been aware of abuse problems for years and refused to acknowledge them.

The archdiocese released the papers as part of a settlement agreed to in April. Portland lawyer Kelly Clark, who represented more than 40 abuse victims, said he was blindsided by the release of the documents on Wednesday.

He said the agreement with the archdiocese "included a joint presentation to the public, not only about what the documents are but what they mean."

"I had absolutely no idea that it was coming today," he said.

A statement by Archbishop John Vlazny said the records were released "as part of the process of healing and reconciliation."

He said most of the information in the documents was decades old, "when people did not have the benefit of today's knowledge and standards."

He said church officials did not always respond then as they might now and that a "modern and effective child protection program" is in place with updated policies to ensure safety.

Most or all of the priests named in the documents have retired and some have died. Some of the documents released Wednesday are rather candid.

One dated 1989 quoted a victim whose name was redacted as saying Father Rocky Perone, who was at St. Philip Neri parish in Portland in the 1950s, initiated the abuse in a confessional, where the boy had admitted "something like impure thoughts."

"The next day Father Perone asked him to come into a room and take down his pants and show him exactly what had happened and that he fondled him briefly," said a memorandum from The Rev. Charles Lienert, director of clergy personnel, to then-Archbishop William Leveda. It said the relationship progressed and lasted about six years. Perone also was the subject of other complaints.

After months in treatment, Perone was placed in a parish in Texas, where the bishop was notified of his history. He was barred from contact with young people.

A 1995 document from Lienert to Leveda told of Father Aldo Orso-Manzonetta, who had parishes in Newberg and Tillamook and about whom parishioners often talked of sexual improprieties. The document quotes a person whose name is redacted as saying "Fr. Aldo's typical pattern in developing these emotional relationships is to heap gifts on a person and then only go as far as a person will allow him when he makes an advance."

A 1994 memo from Lienert told of a boy just out of juvenile detention who met a man claiming to be a church janitor and offered the boy money to spend the night with him.

He learned the following Sunday that the "janitor" was Orso-Manzonetta, who he said always gave him some pills he later found to be barbiturates that made him vague about what was going on.

In 2004, the Portland Archdiocese became the first in the nation to file for bankruptcy protection because of the wave of abuse lawsuits. About 175 people who claimed they were molested by priests or other church officials have agreed to settle their cases for about $52 million.

Sex scandal bishop tells of fleeing the media | Uk News | News | Telegraph

The former Bishop of Galway has spoken for the first time about his years on the run after he was at the centre of a sex scandal that shocked the Roman Catholic Church.
Eamonn Casey broke his silence about the Catholic network that smuggled him across two continents after the exposure of his affair with Annie Murphy, an Irish-American divorcee with whom he had a child.

In his first interview since returning to Ireland last year, Fr Casey revealed that Pope John Paul II did not want him to resign as bishop when told that he had fathered a child.
He also spoke of the great lengths he went to and the huge distances he travelled to evade the media as he paid his penance in a North American monastery and with a South American mission.

After years of eluding journalists, the 79-year-old clergyman chose to tell his story to Maurice O'Keefe, an Irish folklorist who recorded several hours of interviews with him at his house in Shangalish, Co Galway.

The interviews disclose the life Fr Casey led after fleeing Ireland as a result of the 1992 disclosure that he had siphoned funds from the Galway diocese to support his mistress and their son Peter, who was born in 1974.
The 70,000 Irish pounds has since been repaid to the diocese and Fr Casey has apologised for his conduct.

In conversation with Mr O'Keefe, Fr Casey described how he travelled to Rome to tender his resignation when he knew that his relationship was about to be made public.
Prior to the publication of his lover's kiss and tell memoirs Forbidden Fruit he was stuck in the Vatican for three days dealing with the Pope's representative.
"All I wanted was to submit my resignation and acknowledge my wrong-doing and leave it at that," said Fr Casey, who masterminded the Pope's visit to Ireland in 1979.

"But he (the Pope's representative) wouldn't accept it. He said the Holy Father doesn't want to accept it."
Fr Casey was coy about his relationship with Mrs Murphy and their son, saying that he "ignored" her book when it came out. Their relationship caused a sensation in Ireland and in the Catholic Church, which had yet to be hit by many of its more unsavoury scandals involving child abuse and predatory priests.
He was more forthcoming about the people who smuggled him from one safe house to another as he attempted to preserve his anonymity on the other side of the Atlantic.

Through his friends, he was sent to a North American monastery, where his fellow clergy had taken a vow of silence and were forbidden from smoking. Twice he set off the alarm by smoking in his room late at night, but he was able to answer the 750 letters he had received.
"That was a delightful six months," he said. "I tried to seek out what was God's will for me."

The answer was to escape to Ecuador, where he used an old Catholic connection to arrange work with the American missionary Society of St James the Apostle. For six and a half years he worked with parish priests building schools and churches.

While there he was sent on a six-month Spanish language course 100 miles outside Mexico City. But he was "betrayed" after three months when two cars drew up outside the gate and two people got out. One started taking photographs.
Fr Casey went to the headmaster and swiftly explained who he was and why the press arrived. He was smuggled out in a convoy of cars. He travelled hundreds of miles to link up with a leading Augustinian, who was also from Galway, while a friend travelled 1,000 miles to pick up his passport so he could go to Florida.

After moving to the south of England in 1998 to work as a hospital chaplain, he is now home in Galway and looking forward to taking Mass in public once more.
He cannot until a Church investigation into false accusations made against him is completed. In 2005, a woman made unfounded allegations of child abuse claiming the alleged incidents took place 30 years ago. The Irish police investigation was completed last August and no charges are to be brought.

At least 500 women in Ireland are conducting clandestine affairs with Roman Catholic priests, according to the leader of a support group set up to look after those in forbidden relationships.
An indication of the extent of illicit sexual relationships within the church was given after it was disclosed that Fr Maurice "Mossy" Dillane, 73, had fathered a child with his 31-year-old girlfriend.


Bishop Pat Buckley said an extremely conservative estimate was that one in 10 of the 5,000 Catholic priests in Ireland enjoyed regular sex with women and some even referred to their clerical collar as the "bird catcher".

Studies had shown that 80 per cent of priests had broken their vows of celibacy on at least one occasion, he said.

Bishop Buckley runs the Bethany organisation in Larne, Co Antrim, which he set up to provide support to those in love affairs with the clergy.

Described as Ireland's rebel bishop, Bishop Buckley was sidelined by the Catholic church in the mid-1980s when he pursued his own ministry for those who felt alienated by the traditional church.

When the statistics were widened to take in practising homosexuals, Bishop Buckley said up to 40 per cent of the Catholic clergy in Ireland were sexually active.
Counselling sessions organised by Bethany have disclosed that several women were unwittingly having sex with the same priest.


He claimed the church's hierarchy was prepared to turn a blind eye to sexual indiscretion because it was so widespread. "Bishops are caught between Rome and the priests and, of course, some of the bishops are in the same position (i.e. having relationships)," he said.

"From the top down it is hypocritical. We are preaching compulsory celibacy, but very few are living it."

He said he had met 147 women who had joined Bethany in order to share their stories of adultery and priestly promiscuity.'

Romances between an understanding man of God and an unloved wife were commonplace, as were priests and their housekeepers secretly living together as man and wife while relationships between priests and nuns were unofficially known as the "third way" by the church.

Bishop Buckley said Fr Dillane and the mother of his child had nothing to be ashamed of and urged them to come out of the safe houses where they have been hiding since news of their relationship swept through Ireland.

]The case of Fr Dillane, a sociable and charismatic priest from Co Galway, has been greeted with a tolerance that was absent 14-years ago when Bishop Eamon Casey, the Bishop of Galway, was disclosed as the father of a teenage son by an American divorcee, Annie Murphy. He was forced to apologise when it emerged that he had siphoned £70,000 from the diocese for their upkeep.

Bishop Buckley has been a long-standing campaigner against compulsory celibacy and points to a recent Irish survey suggesting that 90 per cent of the population thought clergy should be allowed to marry. He also believes that enforced celibacy is an unnatural state that could be to blame for the sexual deviancy that led to the child abuse scandal that erupted in Ireland last year.

"Some priests are in the Jack the lad mould and have several relationships in various parishes. I have heard priests refer to their clerical collar as the bird catcher," Bishop Buckley said.
The Roman Catholic Church in Ireland declined to comment on Bishop Buckley's claims.

Clergy sex abuse victims blast gag order

Tomorrow, Catholic church officials will likely crow at moving one step forward in their bankruptcy protection scam. But tonight, sex abuse victims are mourning.

We are members of a support group called SNAP, the Survivors Network of those Abused by Priests (SNAPnetwork.org). We applaud the dozens of Oregon men and women who have found the strength and courage to come forward and report horrific serial sex crimes and deceitful cover ups of those crimes.

But we mourn the fact that these brave individuals will never have the chance to expose corruption like some abuse victims have. We mourn the fact that church officials who deceived the police, public, press and parishioners about clergy sex crimes are essentially getting off ‘scott free.’ We mourn the fact that the same church officials who have operated and still operate above the law are basically getting by with it again.


Regarding pedophile priests and corrupt bishops, the truth surfaces only through litigation – discovery, depositions and testimony. Without litigation, Catholics never learn who knew what when about pedophile priests. And with the Chapter 11 process, cover ups remain covered up. That’s why five bishops have gone this route – to avoid having to testify under oath and in open court about how much they knew and how little they did about predators on their payrolls.

Adding insult to injury, and heaping more dangerous secrecy on top of dangerous secrecy, U.S. District Judge Michael Hogan and Lane County Circuit Judge Lyle Velure have imposed a gag order on everyone involved in the Chapter 11 process. This unprecedented, unwise and unfair move helps molesters and hurts kids. It helps keep the identities and whereabouts of predators secret. It helps keep the identities and methods of enablers secret. It’s also unhealthy, we feel, for adult victims, who often find it healing to discuss the crimes committed against them.

Historically, gag orders have sometimes been used to protect public safety. In this instance, gag orders are damaging public safety. These two judges are putting the convenience of complicit church officials above the needs of vulnerable kids and devout parishioners. Shame on them.

We understand that several abuse victims have filed a suit to void the gag order. We support them in this effort and wish them well. And we're sad that they even have to resort to legal action to secure their Constitutionally-guaranteed First Amendment rights.

Because Chapter 11 and the gag order both prevent truth-telling, today, we are urging potential “whistleblowers” - current or former church employees or members - to disclose what they know about pedophile priests and cover ups. Many times, when victims come forward, church workers who have information about clergy sex crimes breath signs of relief, stay silent, and assume that deception and corruption will be exposed through litigation. That’s obviously not happening here. So it’s crucial that those who have knowledge or suspicions about child molestation and cover ups speak up right away. Tell therapists, police, journalists, or support groups like ours. But tell someone. Staying silent perpetuates abuse and rewards wrongdoers. Please, find the courage and strength to do what we’ve done: come forward.

Finally, three weeks ago, Fr. Joseph Hoang was suspended from his Tillamook parish for sexual abuse allegations that are being investigated by the police. According to news accounts, church officials have not looked into the accusations against Hoang and will wait for the police investigation to finish before deciding what to do next. This is wrong and irresponsible. Sadly, however, it’s what bishops have done for decades and continues to do even now.

We implore Archbishop Vlazny to follow the example set by Jesus himself. Jesus taught us to leave the 99 and go out into the cold and rain and dark, to find and help the lost sheep. We urge the archbishop to go to the parish this weekend (and anywhere else Hoang may have worked) and urge victims and witnesses to contact law enforcement immediately.

We should not have to urge Portland church officials to personally visit parishes where Hoang worked and ask that any more victims or witnesses call police immediately. This is the instinctive, caring, responsible reaction any sensitive decision maker would have to credible abuse reports.

But sadly, despite his claims to have reformed, Vlazny still follows the same destructive ‘bare minimum’ approach he and his colleagues have used for ages.
We beg him to reconsider, and to put the safety of his flock ahead of his own comfort and convenience.

No falta razón al Congreso de la Unión al impulsar estas reformas. Según algunas opiniones recientes, México se ha convertido en un lugar seguro para la actividad de los depredadores sexuales y los recientes escándalos provocados por malos ministros de la Iglesia católica que han abusado sexualmente de menores ha levantado un reclamo público que debe ser atendido de forma urgente. No obstante, la bondad de la reforma podría estar viciada de inconstitucionalidad en relación a la “inhabilitación”.

No falta razón a los Obispos al decir que los órganos del Estado han vulnerado el principio de separación iglesias-Estado, principio rector del derecho eclesiástico mexicano y uno de los ejes que apuntalan el espíritu del artículo 130 de la Constitución Política, ya que el concepto de “inhabilitación” vendría a ser la aplicación de una sanción relativa al incumplimiento de un servidor público en el sentido que establece el artículo 108 constitucional y las Leyes Sobre Responsabilidades de los Servidores Públicos y los ministros de culto no tienen esta categoría. Evidentemente, cualquier sujeto que es condenado por la comisión de delito, es suspendido de sus derechos políticos, pero en relación a una “inhabilitación sacerdotal” se considera que sólo las iglesias tienen esta capacidad de hacerlo, particularmente en la Iglesia católica, reduciendo a diáconos y presbíteros al estado laical o en el caso de los obispos, al ser suspendidos de sus funciones ministeriales.


En conclusión, se puede decir que el Senado ha aprobado una reforma necesaria pero hay que revisar este vicio. Y he aquí un mensaje importante de los representantes del pueblo de México: Nadie está por encima de la Ley, ninguno goza de fueros especiales, cualquier depredador sexual será sancionado gravemente sin importar su condición, ojalá…

de rkk kardinale vraag: wie naait wie? Law 's erfenis over het misbruik en Boston

Als je goed luistert kun je het misschien wel horen knetteren in Rome, over een kardinaal met een erebaantje. Die het niet alleen mogelijk maakte dat priesters door konden gaan met het misbruiken van kinderen.
Maar zoals het er nu uit ziet ook nog gelden, naja..kapitaal : 70 miljoen$ bijeengebracht tbv en onder het mom van pensioenen en oude dags voorzieningen voor gepensioneerde priesters, heeft misbruikt.

Voor noodzakelijke kosten . voor slachtoffers van misbruik.


Wat doe je dan met een kardinaal die naar Rome uitweek om niet in de gevangenis te belanden...wanneer die eerwaarde vader zijn "beminde zonen" bejaard en wel heeft misbruikt?
Je kunt hem vanuit Rome moeilijk nog een erebaantje geven om hem te dekken.

De combinatie zou wel eens een zeer explosief mengesel kunnen worden over de inmiddels wel erg kardinale vraag in de RKK: wie naait wie?

Hundreds of distraught Boston-area priests are facing stark cuts in their retirement benefits as the Archdiocese of Boston scrambles to shore up its teetering pension system after decades of poor fiscal management.

“I see all of this as unjust and a failure to observe our canon law,” said the Rev. Richard Craig, 71, who retired four years ago as pastor of St. John the Evangelist in North Chelmsford. “It leads me to wonder, are we, the senior priests, becoming objects of elderly discrimination?”

Church documents show that as of April 2006, the pension plan - the Clergy Retirement/Disability Trust - faced an $85.4 million gap between the money on hand and what it is expected to have to spend for hundreds of priests, active and retired.

Frightened senior priests have seen monthly stipends frozen to amounts as low as $1,889, with other benefits such as health and housing also diminishing.

In multiple interviews, retired priests described the following pinches on their already meager finances, which consist of the $1,889 monthly allowance, $600 of which is for housing:
No cost-of-living increase for the monthly stipend since 2005 and none expected soon;
A $200 cut to the housing allowance;
The end of Medicare reimbursements for eligible priests - a cash burden of almost $1,000 a year.
Archdiocese officials insist senior priests are better paid than their active counterparts.

Cardinal Sean P. O’Malley “is completely committed to ensuring that we provide for the medical, retirement and financial needs of our priests, which is why he has sought the professional advice of outside experts who can assist us with strengthening the Clergy Benefit Trust,” Terrence C. Donilon, archdiocese spokesman, said in a statement.

But some priests see it differently. “I don’t have peace of mind. I won’t have peace of mind until I know that they are not going to take anything away,” said one disabled priest, who did not want to be identified out of fear the church would strip his financial support. “The priests’ morale is horrible.”

The funding gap and cost-cutting measures would not be in place if pension management had been better, according to a January financial analysis by the Council of Parishes, an advocacy group for closed churches that has been critical of the archdiocese.

The group says at least $70 million in donations collected between 1986 to 2002 from parishioners -who were often told the money would fund priests’ retirements - went instead to other purposes, notably a fund drawn on extensively by former Cardinal Bernard Law before he left Boston.

That fund - the Clergy Benefit Trust - was used to pay millions of dollars for legal bills, psychological treatment and other expenses associated with dozens of priests accused of sexual abuse, according to church documents, interviews, letters and memos signed by Law.

“The archdiocese has never explained what was done with this money,” said Peter Borre, co-chairman of the Council of Parishes, which has been documenting pension fund troubles and demanding the release of audited financial statements of the two trusts set up to pay for the priests’ retirement.

“The net result,” he added, “is that many, many retired priests who have served honorably and faithfully are suffering economically because monies donated for their retirement went instead to fund priests accused of sexual abuse who had been placed on leave.”

The Rev. Mark O’Connell, who supervises the Clergy Retirement/Disability Trust, vigorously defended the diversion of millions in holiday collections. He saidthatduring that 16-year period, archdiocesan actuaries said the retirement fund was fully funded and even overfunded, and did not require a transfer from the Clergy Benefit Trust, the account that takes in the Christmas and Easter donations.

The retirement fund faltered, he said, after nursing-home costs, previously taken from a medical fund, were reassigned to the pension account and new actuaries started accounting for the likelihood that retired priests would live longer than expected.

“To think that something bad happened to that money or that it was used for something else that the good people of the archdiocese gave it for is simply false,” he said.

In recent months, the archdiocese has taken steps to catch up on the underfunding. It cites a $10 million reduction in the shortfall between planned assets and liabilities, and another $5 million infusion from the Clergy Benefit Trust. The church has named former Boston
Red Sox [team stats] executive John S. Buckley and former interim archdiocesean finance director James K. Hunt as advisers, according to a January letter signed by O’Connell.

O’Connell said the cost-cutting measures, especially the shift from making cost-of-living increases annually to doing so on an as-needed basis, will save millions. “The recent letter was designed to say to the senior priests, ‘Don’t worry,’ ” said O’Connell. “We are going to rethink it, we are going to have new financial help from experts.”

Serbian priest sentenced to jail for sexual abuse of boys - International Herald Tribune

BELGRADE, Serbia

A Serbian Orthodox Church priest has been jailed for a year after being convicted of sexually abusing boys in 2001, a court announced Friday.

Jovan Misic, also known by his church name Ilarion and the former abbot of the Hopovo monastery in the northern Vojvodina province, was found guilty of "lewd behavior and sexual abuse" of several underage boys in monastery grounds, the court said.

The boys were aged between seven and eleven years old.
No furthers details were revealed because of the need to protect the victims and their families.

There was no immediate comment from Misic or his lawyer.

The District Court in Novi Sad, 60 kilometers (40 miles) northwest of Belgrade, first ruled in the case in October last year, finding Misic guilty and sentencing him to 10 months in prison.
The court confirmed the verdict on appeal and increased the prison term to 12 months.

NEW YORK — The U.S. bishops are undertaking a second study of the priest abuse scandal. Those conducting the research say hot button issues such as homosexuality and dissent will be part of the study.
The first phase of the study, conducted in 2004 by the John Jay College of Criminal Justice in New York, was considered a landmark in its field.


John Jay’s first report called for a more searching examination of the effects of homosexuality on the priesthood. It stated, “For those who choose to ordain homosexuals, there appears to be a need for additional scrutiny and perhaps additional or specialized formation to help them with the challenge of priestly celibacy.”

The bishops in November allocated funding for a follow-up on causes and context. It’s expected to be similarly groundbreaking.

Teresa Kettelkamp, executive director of the Office of Child and Youth Protection of the U.S. Conference of Catholic Bishops, pointed out that in the first phase of the study John Jay proved its “open, objective, thorough, impeccable and professional.”

She said the follow-up wouldn’t pull any punches when it comes to tough issues like homosexuality.
“Their reputation is on the line at a very high level, and they are not willing to risk their reputation by getting steered by external forces of political correctness,” Kettelkamp said. “I’m convinced they are seeking truth, and know how to find it.”

Dr. Richard Fitzgibbons, a psychiatrist and the author of the book Homosexuality and Hope, said that, after the first study, “the facts speak for themselves: Seventy-five percent to 80% of victims in the sex abuse crisis were adolescent males, so the cause is primarily the homosexual predation of adolescent males.”
He said John Jay researchers “were a good choice for that study of statistical data, and those findings are what confirmed for us that this is a homosexual crisis.”

The first report by John Jay, which is part of the City University of New York, found that at least 10,667 boys and girls were abused by Catholic clergymen in the United States between 1950 and 2002, and between 75% and 80% of the abuse involved adolescent male victims.

Margaret Smith, data analyst for John Jay on the causes and contexts study, said John Jay would look at every factor.
“I’m a researcher,” she said. “I have no interest in being politically correct.”

It was Smith’s analysis of Church personnel files and complaint files by parents and grown victims of prior sexual abuse that established the statistics regarding adolescent male victims.

Yet Smith takes issue with Fitzgibbons’ assertion that homosexuality is a cause for major concern. Smith said sexual preference or inclination may be largely “irrelevant” to the causes and contexts of sexual abuse of children.
“In secular society, the majority of men treated for sexual abuse of adolescent boys consider themselves heterosexual, so you cannot make this problem go away by saying the problem is homosexual priests,” Smith said. “That’s overly simplistic. Very many heterosexual men engage occasionally in homosexual behavior.”

Smith said while some psychologists and psychiatrists see a distinction between adults having sex with children and adults having sex with adolescents, the law sees it all as child abuse.
“If the victim is under the age of consent, it’s child abuse. That simple,” Smith said. “When someone abuses a child, it usually has little to do with sexual preference. It’s about abusing a child.”

In the study, however, Smith and other researchers will try to determine how many priests who have abused children identify themselves as homosexual.
Karen Terry, the principal investigator on the causes and contexts study, responded that there is “nothing in our data to indicate that this is or is not a crisis of homosexuality.”

“Although 81% of the victims in our study were male, it is not clear whether this is due to a sexual attraction to the male victims or whether the priests primarily abused males because this is the population to whom they had access,” she said.
“For instance, in prison,” she said, “many individuals of the same gender have sexual relationships even though most would identify themselves as heterosexual.”

The “historical context and influences” portion of the study will look at the Church and society “to frame our analysis of sexual abuse by priests.” One hypothesis researchers plan to explore is whether social changes of the 1960s and ’70s increased sexual attraction by adults to children.

Among four hypotheses researchers will explore while examining the response by Church leadership is that a “higher tolerance for non-traditional sexual behavior (adult heterosexual and homosexual relationships) will have a higher tolerance (and slower response) to abuse of children.”

Researchers also want to know if beliefs opposed to Church doctrine played a role in sexual abuse.
