Later, Blom was quicker going through the cases of the two other John Does, but has consistently pointed out facets of the men’s lives — including the initial loss of a parent and, later, financial and career setbacks — that could have caused issues such as anger, depression and anxiety, and any genetic factors that might have contributed to the likelihood of abusing alcohol.
The trial entered its 26th non-consecutive day Wednesday and continues Thursday.

Further hearing dates in Case Study 35


The Royal Commission will hold a further day of hearings in relation to Case Study 35 (Catholic Archdiocese of Melbourne) in Sydney on Wednesday 27 April 2016 at 11:15am.

The purpose of the hearing is to receive the evidence of four former officers of the Catholic Education Office, who have provided statements to the Royal Commission following the evidence of Cardinal George Pell from Rome in March.

All witnesses will be appearing in Sydney with some legal representatives appearing from Melbourne via video link.

Venue: Hearing Room 1, Level 17, Governor Macquarie Tower, 1 Farrer Place, Sydney.
Time: 11:15am – 4pm AEST
Date: Wednesday 27 April 2016. If necessary, the hearing may continue on Thursday 28 April 2016.

The directions hearing will be streamed live via webcast on the Royal Commission’s website at www.childabuseroyalcommission.gov.au.

When Pope Francis’ landmark project of financial reform was announced two years ago, one lynch-pin was the idea that the world would no longer just to have to take the Vatican’s word for it in terms of how much money it has and where it’s going.

Instead there would be a credible audit carried out according to generally accepted business standards in the 21^st century. That step, officials said, would represent a revolution in the direction of transparency and accountability.

As it turns out, it’s now a revolution delayed.

In 1989, the Roman Catholic Archdiocese of St. John's commissioned an inquiry into the sexual abuse of boys by members of the clergy and Christian Brothers. Headed by former Lieutenant-Governor Gordon Winter, an Anglican, the commission strongly criticized the Archdiocesan administration for its handling of child abuse allegations, writing that it adopted a "minimal response policy" (138) which often amounted to no more than sending the offenders out of the province.

"Church officials aligned themselves with the accused;" the commission wrote, "their response to victims was thus inappropriate and un-Christian and this compounded the victims' initial sense of betrayal by the Church" (139). Archbishop Alphonsus Penney resigned as a result of the commission's findings.

During a public inquiry into abuse at Mount Cashel in October 1989, Shane Earle - a former resident of the orphanage - testified he saw something in Lahey's home as a teenager that disturbed him and caused his hospitalization for depression.

The inquiry heard that the incident happened in 1985 at Lahey's home. Earle said he lost control after spotting something in the house, but at that point inquiry lawyer Clayton Powell quickly warned him not to mention what he had seen.
Police in Newfoundland and Labrador are reviewing the allegation including audio and video records of interviews with "victims and offenders" from the investigation of sex abuse allegations at the Mount Cashel orphanage.


Today the Archdiocese of St. John's said last Thursday it became aware of Earle's testimony.

According to a news release, it states that since hearing the media reports, Archbishop Martin Currie asked for a review of what officials in the Archdiocese might have known at the time.

In the Hughes Inquiry Report, it is written: "He (Shane Earle) went to Portugal Cove and spoke to Father Kevin Molloy, telling him stories of Mount Cashel that upset the priest who promised to make inquiries."

Based on this information, Currie contacted Molloy and was informed by Molloy that he had met with Earle and that the conversation between them included reference to Lahey. 
Molloy said he passed on the information he learned from Earle to then Archbishop Penney.

The latest scandal has hit the Catholic Church hard.

Lahey's laptop and other media devices were seized by border guards when he was returning to Canada at the Ottawa airport on Sept. 15. Ottawa police charged him with possession and importing child pornography on Sept. 25 after a forensic investigation found images that police say were of "concern."

In his testimony to the public inquiry, Earle said senior officials of the Christian Brothers at Mount Cashel - including Lahey while he was still a priest - were told about sex involving boys and brothers at the orphanage.

Earle said he told Lahey that he had seen a brother having sex with several boys and the priest told him he had recommended to a member of the order's executive council in Toronto that the brother be removed from the orphanage, which was run by the Roman Catholic lay order for decades.

Weeks after his conversation with Lahey, the brother left the orphanage, said Earle, whose allegations sparked the inquiry into Mount Cashel by retired Ontario judge Samuel Hughes.

It was uncertain Tuesday whether the Mount Cashel civil trial will include evidence entered from videotapes of some witnesses who testified at the Hughes Inquiry nearly 30 years ago.


Lawyer Mark Frederick, who represents the Roman Catholic Episcopal Corp. of St. John’s, on Tuesday argued against an application made by lawyer Geoff Budden, who represents former orphanage residents.

Newfoundland Supreme Court Justice Alphonsus Faour did not rule on the matter as of the end of the court day Tuesday.

Introduction 

[1] Adams, J.: John Evangelist Murphy was originally charged with five counts of indecent assault, one count of gross indecency and one count of assault. The offences allegedly occurred between 1950 and 1960 while the accused was a member of the Irish Christian Brothers and working at Mount Cashel Orphanage in St. John’s, Newfoundland.

[2] After a preliminary inquiry was completed on 25 May 2001, Mr. Murphy was committed to stand trial on all counts. On 6 September 2001, an Indictment was filed at the Supreme Court of Newfoundland, Trial Division, which contained the five indecent assault charges and the one gross indecency charge. The Crown entered a stay of proceedings on the charge of assault.

 [3] The accused has applied to have the remaining charges stayed on several grounds:

         (1) The applicant’s right to be tried within a reasonable time has been breached contrary to Section 11(b) of the Charter of Rights and Freedoms;

(2) the applicant has been denied his right to be tried in accordance
with the principles of fundamental justice contrary to
Section 7 of the Canadian Charter of Rights and Freedoms; and

      (3) the provisions of the Criminal Code under which he is charged violate the equality provisions under Section 15 of the Charter of Rights and Freedoms.

The appellant, Ronald Justin Lasik, has applied, pursuant to the provisions of s. 679 of the Criminal Code, for release from custody pending the determination of his appeal from various convictions for which he received a sentence of a total of ten and one half years imprisonment.

[2] Mr. Lasik was charged on November 19, 1996 with a number of indictable offences relating to sexual and physical abuse of young boys at Mount Cashel Orphanage in St. John’s during the period 1954 to 1957. He was committed to stand trial, which trial commenced in April, 1999 and concluded in June, 1999 with convictions registered against him on 19 of 24 preferred counts. On July 27, 1999 he was sentenced to 10 ½ years imprisonment. He has been in custody since that time.

A civil trial involving the victims of Mount Cashel, the Catholic Church, and the Christian Brothers began today at Supreme Court in St. John's. The complainants were all residents of the orphanage between the 1940s and 1960s. The trial is set to be lengthy, and will continue into June.

In his opening statement this morning, lawyer Mark Frederick said the Archdiocese is not responsible for the faults of the Christian Brothers, who he says essentially acted as wardens at Mount Cashel. Lawyer for the victims, Geoff Budden, says the church has not done anything to adequately address the years of sexual and physical abuse suffered by the boys who once lived at the orphanage.

Only weeks before his arrest, Lahey announced the results of a $15-million settlement for victims of abuse in the diocese dating back to the 1950s. About six weeks after the announcement, he had been arrested.
