Danneels jurisprudentie aansprakelijkheid


Procureur-generaal Marc de le Court, die het gerechtelijk onderzoek naar pedofiliefeiten gepleegd door priesters nakijkt, zat het hof van beroep voor dat kardinaal Godfried Danneels in 1998 onschuldig verklaarde in verband met gelijkaardige feiten. Het weekblad Télé Moustique wijst daarop in een artikel dat woensdag verschijnt.


Danneels in beroep onschuldig
De correctionele rechtbank van Brussel veroordeelde priester André Vander Lijn in 1998 tot zes jaar cel wegens verkrachting van minderjarigen. Het ging om scouts waarvan hij aalmoezenier was in de parochie Sint-Gillis. De rechtbank oordeelde toen ook dat kardinaal Danneels en hulpbisschop Paul Lanneau op de hoogte gebracht waren van het pedofiele gedrag van de priester en burgerlijk aansprakelijk waren.



Danneels en Lanneau gingen in beroep en werden onschuldig verklaard.
Télé Moustique wijst erop dat de kamer van het hof van beroep die de zaak toen behandelde, voorgezeten werd door Marc de le Court, die zich vandaag als procureur-generaal over het onderzoeksdossier van rechter De Troy buigt.

Het tijdschrift schuift de hypothese naar voren dat de procureur-generaal, die katholiek is, zou proberen te verhinderen dat de huidige zaak de gepensioneerde aartsbisschop treft. (belga/mvdb)
Canada’s Truth and Reconciliation Commission on Indian residential schools is in the midst of another shakeup of its senior ranks following the resignation of the director of research and the appointment of a new executive director.

The personnel moves come just weeks after the commission’s first national event in Winnipeg, which was largely viewed as a success for gathering former students, teachers and religious leaders together to share stories about the boarding schools that operated for decades before almost all were closed in the 1970s.

Already more than a year behind schedule due to the resignations of the original three commissioners who were then replaced in June 2009, the changes at the highest levels of the support staff are prompting concern of further delays to the commission’s herculean task.
A product of the 2007 multi-billion out-of-court settlement between former students and the federal government and churches that ran the schools as a joint venture, the commission has a five-year mandate. But the commissioners are up against a deadline to produce a report by the end of its second year on “historic findings.”

The problem is that the commission has yet to even get its hands on the church records because of continuing technical negotiations over what form these documents should be in when they are handed over.

The resignation of research director John Milloy, who had only been in the position for a few months, comes after he delivered a face-to-face apology to church leaders during a meeting in Winnipeg over controversial remarks he made expressing his frustration over the pace of the document negotiations. The chair of the commission, Mr. Justice Murray Sinclair, sent a letter of apology to church representatives in April after Mr. Milloy’s comments were published.

Dr. Milloy, a Trent University professor and author of a history of residential schools called A National Crime, will continue to play a key role with the commission later this year as a special adviser on research to the commissioners.

“I’m sorry to hear he has resigned because I do believe that will stall things for a time,” said Cecile Fausak, the United Church’s liaison minister for residential schools.

In an interview, Dr. Milloy said his resignation had nothing to do with his remarks, which included a comment suggesting the Roman Catholic Church was afraid of lawsuits against living priests if diaries reveal details about “buggering boys in the basement and that sort of thing.”

Rather, he says the position involved far more administrative work than he had expected and that his preference was to leave that to someone else so that he could focus solely on research.

We will go to as many communities as we humanly can manage and where we can't go ourselves we will send our delegates armed with our authority to record the stories of those who wish to tell them.
And in the end we will ensure that the whole world hears their truths and the truth about residential schools, so that future generations of Aboriginal and non-Aboriginal Canadians will be able to hold to the statement that resonates with all of us: This must never happen again."

They make my desk at work look sophisticated, erudite even, those worthy reports on children's rights that surround my computer desktop.

The five volumes of the report of the Ryan Commission to Inquire into Child Abuse and the well-worn newsroom copy of the Murphy Report into the abuse of children by priests in the Archdiocese of Dublin.

Guam: Community apathetic on sex abuse bill

Guam - Legislation that would make it clear in Guam civil law that clerics cannot claim privileged communications as a basis for failure to make such reports of child abuse, neglect or sexual abuse went up for a public hearing this afternoon. No one however showed up to testify for or against the legislation. Likewise, no one submitted written testimony either.

Currently under Guam law teachers, nurses, doctors, social services workers, police officers and other professionals are required to report cases of suspected abuse. The bill would add the job positions of bishops, pastors, priests, deacons and other clerical posts.

The Legislature will still accept written testimony on Bill 372 over the next ten days.

The home provided care for boys with emotional and behavioural problems

A Catholic diocese has launched an appeal after being found liable for running a boys' school where 150 former pupils are suing for abuse.
Middlesbrough Diocese is facing the £8m compensation claim.

The alleged abuse took place between 1960 and 1992 at St William's in Market Weighton, East Yorkshire.

A judge ruled last year that the De La Salle Brotherhood, which provided the school with teachers at the time, had no legal responsibility.

At a hearing at Leeds Crown Court last year, a judge decided that the diocese, which owned the home, and not the De La Salle Order of Christian Brothers, a Catholic order of lay teachers, was responsible for the abuse that took place.

The compensation claim by the 150 pupils was submitted in 2006.

Started appeal
However, the Middlesbrough Diocese said it believed the Catholic brotherhood should take some responsibility.
Jeremy Stuart-Smith QC, representing the diocese and its Catholic Child Welfare Society, started the appeal in front of the three judges at the Court of Appeal in London on Monday.
The case centres around the alleged systematic abuse of boys aged between 10 and 16 from 1960 to 1992.
The home provided residential care and education for boys with emotional and behavioural problems aged from 11 to 18, mainly from Yorkshire and the North East.

Humberside Police started an investigation in 2001, which focused on child abuse at the home between 1965 and 1992.

The appeal is expected to last four days, when judgement will be reserved to a later date.

Wie is die man ? was - voor de eerste keer in mijn leven - mijn vraag gistermiddag aan het aartsbisdom. Ik stelde ooit eenmaal eerder een vraag aan datzelfde aartsbisdom en bij het herinneren aan wat dat heeft opgeleverd wordt ik daar weer kots en kots misselijk van.
Een vriendelijke en correcte dame bevestigde dat het om dezelfde persoon zou gaan omdat de heer Chatilion Counet, inderdaad de schrijver van dat boekje zich inderdaad bezig houd met kerkelijk seksueel misbruik maar geen (aankomend) kerkelijk rechter bij het aartsbisdom (meer) zou zijn of bij het aartsbisdom zou werken; zij verwees mij door naar de Konferentie Nederlandse Religieusen waar hij werkzaam zou zijn.


De heer Chatilion Counet bleek hier inderdaad te werken en voor een kerkelijk hotemetoot verbazingwekkend toegankelijk te zijn - nog voor je het weet heb je hem aan de lijn- en op een paar terreinen net zo bevooroordeeld te zijn als ik dat ben, wat in mijn bepaald niet meer bescheiden mening over die kerk in Nederland zowel voor de man als voor mij pleit. Er is een beroerdere waardering mogelijk.
Het (seksueel) misbruik in de Kerk heeft inderdaad heel wat meer slachtoffers gemaakt dan slechts de direct betrokken slachtoffers en daders van ooit.

Interpol heeft een red notice uitgevaardigd tegen pater Eric Dejaeger.
De Vlaamse geestelijke werd in Canada veroordeeld wegens pedofilie en moet er een gevangenisstraf uitzitten.

De paters oblaten in Blanden houden hem echter al tien jaar verborgen omdat hij zijn straf al zou uitgezeten hebben in Canada.

De uit Roeselare afkomstige pater Eric Dejaeger trok in de jaren zeventig naar Canada om er op het eiland Igloolik, in het barre noorden, Inuit tot het christendom te bekeren. Op 5 april 1990 werd hij veroordeeld tot vijf jaar cel voor de verkrachting van acht kinderen, zowel jongens als meisjes, schrijft de krant De Morgen.

Recidivist

De man verbleef slechts enkele maanden in de gevangenis, en na zijn vervroegde vrijlating begon hij meteen te recidiveren. Begin 1995 werden negen nieuwe aanklachten tegen hem geuit en leek de pater onvermijdelijk terug naar de gevangenis te moeten. De provinciale oversten van de Paters Oblaten in Vlaanderen zorgden er echter voor dat hij buiten medeweten van zijn parole officer Canada kon ontvluchten.

Canadese nationaliteit

In 2001 verpreidde Interpol al een eerste opsporingsbericht tegen Dejaeger, toen vergezeld met een waarschuwing: "Person may be dangerous." Dejaeger koos eind jaren zeventig voor de Canadese nationaliteit en kan dus perfect worden uitgeleverd als Canada daarom zou verzoeken.

Een red notice bij Interpol is niet hetzelfde als een internationaal aanhoudingsmandaat.

Het is de bedoeling dat mensen die de gezochte persoon (her)kennen, contact opnemen met de politie, zodat die verder kan overleggen met de bevoegde diensten in Brussel en Ottawa. (belga/vsv)

“The Interpol general secretariat is committed to ensuring that red notices are issued and maintained in accordance with the organization’s constitution and rules which are based on the rule of law and international standards of police cooperation and fundamental human rights.

“The general secretariat reviews all red notices before and after they are published in order to ensure their consistency with Interpol’s rules, and in particular with Article 3 of the organization’s constitution which states that it is ‘strictly forbidden for the organization to undertake any intervention or activities of a political, military, religious or racial character.’

This prohibition is taken extremely seriously by Interpol.“

Many of Interpol’s member countries consider a red notice a valid request for provisional arrest, especially if they are linked to the requesting country via a bilateral extradition treaty. In cases where arrests are made based on a red notice, these are made by national police officials in Interpol member countries. Interpol’s general secretariat does not send officers to arrest individuals who are the subject of a red notice, and cannot demand that any member country arrest the subject of a red notice.“

Any member country may challenge the validity of a red notice if they believe it contravenes Article 3. The person who is the subject of a red notice may also challenge it.

“Whenever an Article 3 issue is raised, the request is examined carefully to ensure that the red notice in question does not contravene Interpol’s constitution.

“If the general secretariat determines that the case does not contravene Article 3, the member country which brought the challenge can take the matter to the executive committee, and ultimately to the general assembly, Interpol’s supreme governing body.

“These safeguards ensure a transparent and structured process to address and resolve such issues.”

Guam Bill on child abuse by clergy has hearing

Guam - Lawmakers are expected to receive public testimony on Bill 372 on Monday, relative to the reporting of suspected child abuse or neglect by clerical personnel of churches and other religious organization. Back in April, officials at the Vatican issued a mandate that all bishops report incidents of sexual abuse within the Catholic Church.

Vice-Speaker B.J. Cruz told KUAM News at the time that as a former Family Court judge, he was constantly frustrated by priests' refusal to report alleged abuse, especially sexual abuse, because they were prevented by church rule.

Ze wimpelt ze meestal af omdat ze de context pijnlijk vindt en alles liever achter zich laat: 'Vooral om het gezin te beschermen. Zij verdienen het niet om in de wervelstorm van dit onderzoek te worden meegesleurd.'

through 27 July, 2010 to discuss pressing health issues for women and children
under the theme: “Maternal and Child health and Development in Africa”. For the
first time ever, young people will hold an African Youth Forum from 17 to 19
July, 2010 on the margins of the Heads of State Summit to discuss challenges and
progress faced by health programmes targeting young women and children. This
forum will follow a nationwide consultation process on youths’ views and
concerns about the health situation of women, mothers and children in their
communities.
Currently, BOSCO Uganda is undertaking training for youths to
post their views online and share
with other youths all over Africa.

In zijn preek stond mgr. Eijk stil bij de Evangelielezing, waarin Jezus de lamme geneest. Volgens de aartsbisschop stond diens lichamelijke verlamming voor “een geestelijke verlamming, die de wil aantast en tot zonde leidt.” Bij lichamelijke verlamming gaan bij de mens alarmbellen af, maar bij geestelijke verlamming is dat vaak niet zo: “Geestelijke verlamming kan tot op zekere hoogte zelfs comfortabel zijn, want het voorkomt moeilijke keuzes.”
