Cleve Foster was scheduled to die at 6 pm Texas time. It is the third time the US Supreme Court has stepped in and delayed Foster’s execution. His claim focuses on ineffective counsel at the post conviction phase.

According to a statement from the Court, Foster’s application for a stay is granted until the Court decides whether to take up his case.

The Death Penalty Information Center, a group opposed to the death penalty , says that the high court has stepped in to temporarily halt executions a total of five times this year, which includes the case of Duane Buck from last week.

Tomorrow there are two more U.S. executions scheduled : Lawrence Brewer of Texas and Troy Davis of Georgia.
