A very high-profile figure was convicted on Tuesday of a serious crime, but we are unable to report their identity due to a suppression order.

The person, whose case has attracted significant media attention, was convicted on the second attempt, after the jury in an earlier trial was unable to reach a verdict. They will be remanded when they return to court in February for sentencing.

A suppression order issued by the Victorian County Court, which applies in all Australian states and territories, has prevented any publication of the details of the case including the person's name or the charges. It was imposed after the court accepted that knowledge of the person's identity in the first trial might prejudice a further trial being held in March.

It is relatively common in cases where a person faces separate allegations in sequential trials for the first trial to be suppressed. The process is designed not to prejudice later juries.

George Pell removed from Pope Francis's cardinal advisory body

A Vatican News report on a meeting of the Pope's Council of Cardinal Advisers this week said 77-year-old Cardinal Pell would no longer sit on the council.

"In October, the Pope had written to three of the more elderly cardinals: Cardinal Pell from Australia, Cardinal Errazuriz from Chile and Cardinal Monsengwo of Congo thanking them for their work," Holy See press office director Greg Burke said.

"After a five-year term, these three have passed out for the moment."

Mr Burke said the Pope had not named new cardinals to replace them on the advisory council, which was established in 2013 to help lead reform in the Vatican's bureaucracy.

In May, Cardinal Pell pleaded not guilty to multiple historical sexual offence charges.

He had taken an indefinite leave of absence from his role as head of the Vatican's Secretariat for the Economy in order to defend himself against those charges.

In a separate, unrelated matter, Javier Errazuriz, 85, has been accused by Chilean abuse survivors of having covered up for predator priests while he was archbishop of Santiago, a charge Cardinal Errazuriz has denied.

The third cardinal, 79-year-old Lauren Monsengwo Pasinya, had recently retired as archbishop of Kinshasa in the Democratic Republic of the Congo.

Pell, the Vatican’s finance chief and the highest Vatican official to ever go on trial for sex abuse, left Rome in June 2017 to stand trial in Melbourne.

As that trial was about to get underway in June, a judge placed a suppression order on all press coverage in Australia, according to the order reviewed by The Daily Beast. Prosecutors applied for the order and it was granted to “prevent a real and substantial risk of prejudice to the proper administration of justice.” That order remains in place in Australia.

A few days ago, I was invited to preside over the launch of a book by Antonio Ureta about Pope Francis. I shall be reviewing this book next week. What I wish to share is an interesting conversation that I had with one of those present during the coffee break. This gentleman is a person who follows thoroughly the church and attends even Catholic congresses abroad.  What he told me was that not all the clergy, whom he met at a Congress in Rome were in tune with the positions that Archbishop Charles J. Scicluna has taken regarding the implementation of the encyclical Amoris Laetitia.

It is a fact that archbishop Scicluna was one of the first archbishops, if not the first, to have endorsed the encyclical Amoris Laetitia and put it into practice. I am here referring to stands taken by the Church in support of communion to divorced Catholics. I am not a theologian, therefore I will not be analyzing this fact from a theological point of view. But I am a historian and a commentator of current affairs. Hence, I shall be analyzing this from a political stance.

In my view, there is no place for controversy about this fact. Even before Francis, the Church was not that strict in its discipline on this matter. Everyone remembers the incident when the then Italian Prime Minister of Italy, Silvio Berlusconi was invited to Mass at St. Peter Square and was allowed to receive Holy Communion, even if he was a remarried divorcee. Everybody knows that the man does not live as brother and sister with his women. I think that it is this type of hypocrisy that Pope Francis wants to challenge with his Amoris Laetitia.  

Then, there is the issue of sexual morality within the Church. The Church is still tied with sexual concepts created in the 19th Century. What were considered sins of the flesh, then became scientific and sexual deviances. The Church needs to divest herself ofthese 19th Century concepts. There is a significant difference between sin and scientific truth. The problem is that where sexuality is concerned, sin and scientific truth are being equated on the same plane. The Church needs to return to basics. In this Pope Francis is correct. He is facing new historical realities by stripping the Church of these 19th Century concepts while re-proposing Church teachings on sin and the sacrament of reconciliation or better still forgiveness.

Foucault reminds his readers that sex is power. Therefore, to dismantle the powerful discourse linked to sexuality, one needs either to undertake the use of sexual discourse or shift the public debate to other matters. Pope Francis is doing both. In the field of sexuality, the Church appeared cynical, in particular, after the Curia was  caught in a number of sexual scandals.

This explains why our arcbishop, Charles J. Scicluna has been promoted to the Congregation of the Faith. At the moment, the Church does not need theologians, as was the case in the 1970s when Ratzinger fought tooth and nail the theology of liberation.

Perhaps, one would think that the person to be appointed to this job should be a theologian. The pope seems to have a different view. He thinks that the best person would be a priest trained in law. While Pope Francis made a number of statements condemning the excessive legal attitude expressed by the Church faced with social problems, he knows very well that certain internal problems, which may appear to be theological, are in reality administrative in character. This explains Scicluna’s appointment.

I don’t think that Scicluna is a man of controversy. He is clearly a man of principle. This does not mean that all his actions and decisions are good or will bring benefit to the church. But I am sure that they have all been taken in good faith. I am sure that certain decisions will return to haunt the Church. These decisions are not related to the position of principle but more to the choice of people.

I am mentioning these facts for one simple reason. If one thinks that the controversies about this archbishop in the local media are something peripheral, one is definitely wrong. It is a known fact that the relationship between Archbishop Scicluna and Prime Minister Muscat is not one of the best. The attacks on the archbishop from the Labour front confirm this. These are prompted by certain comments that the archbishop makes about current situations.

I believe that comments being made by Archbishop Scicluna are not specifically against Labour. He would speak irrespective of who is in government. He is condemning or disagreeing with actions rather than with individuals.

His comments falls within the current church agenda as being expressed by the pope who wants his bishops to be committed to the Green Agenda, the reduction of global warming and world governance. The affirmations that Scicluna is making in this regard, in particular his past statements regarding the environment in Malta, should be read within this Green Agenda.

I was one of those who, in 2015, enjoyed the spectacle of fiat lux inspired by the Pope’s encyclical Laudatio Si: On care for our Common Home. This encyclical created a controversy. Even the fiat lux became a controversy. One needs to remember that when St. Peter’s Basilica was built, it brought a schism within the Church. Today, there is consensus that Pope Julius II had great vision. This is another reason, why bishops should not shy away from controversies.  They should be bold and stand for what they believe in.

Then, there is the element of internal controversy. Scicluna’s last appointment to the Congregation of the Faith led to statements that this archbishop now has a part-time job in Malta. I do not agree with this statement. It is not factual. On the contrary, this dual appointment enters within the new type of bishops that this current pope wants for the Church. Pope Francis does not want bishops who are simply bureaucrats working in some office in the Vatican. He also wants them to keep up their pastoral work.

In the Middle Ages this led to abuse. In olden days, due to issues of transportation, these  dual appointments led to bishops to be absent from their diocese for months, if not years, on end. Modern means of transportation has made this double role a factual reality.

But there is even more to this appointment. Normally, these appointments led to pastoral retreats. It was these pastoral retreats that have led to internal abuses within the church. Pastoral retreats have led the Vatican to make the wrong political alliances. 

Pope Frances has also opened to Islam, migration and the persecuted Christians in the East. Perhaps, on the latter point, the Church and Vatican diplomacy need to do more.The perceived reality is that the Church is not doing enough, or at best, little in this sphere.But even speeches by Scicluna on these points should be seen within the context.  Even here, Scicluna has followed suit. One needs to read his declaration with regards to Islam in this perspective.

This explains Scicluna’s pragmatic approach to current Church problems. I am convinced that Scicluna is authentic and definitely not cynical in his approach. Cynicism is the real opposite of authenticity. I believe that Scicluna is fighting modernism with its own tool. He is fighting cynicism with reason. He is following Francis’ example. But instead on focusing on sexuality, Scicluna too is trying to shift the Church agenda in Malta on to those who are suffering.

By shifting the debate to social outcasts, the Church is putting at the centre of her agenda a category of people that the Radical Chic and the Liberal Left have abandoned to their fate. In so doing, Pope Francis is dismantling the Liberal agenda which is appearing to be more and more cynical, counter-productive and devoid of any political sense.

In reality, it is not only the Church that is now in crisis but also all those political parties that to the eyes of the electorate appear to have reduced democracy to a system that is more totalitarian in content. This is the crux.

Minister Dekker (Rechtsbescherming) stelt een onafhankelijke commissie in die onderzoek gaat doen naar de gang van zaken rondom oude adoptiezaken vanuit het buitenland. 

De aanleiding is informatie over een adoptiezaak uit Brazilië, die naar boven is gekomen bij de behandeling van een Wob-verzoek (Wet openbaarheid van bestuur). 

Deze informatie wijst op mogelijke misstanden bij de adoptie van baby’s uit Brazilië in de jaren zeventig en tachtig, waarbij Nederlandse overheidsfunctionarissen betrokken zouden zijn geweest. Minister Dekker (Rechtsbescherming) neemt deze informatie zeer serieus. Dit is aanleiding om een onafhankelijke commissie in te stellen die onderzoek gaat uitvoeren naar interlandelijke adopties die in het verleden hebben plaatsgevonden.

gelukkig is het in Nederland allemaal  zo goed georganiseerd dat die archieven de moeite niet waard waren

Met mijn nog steeds bestaande 

dank, respect en waardering  aan dat Amsterdams Gemeente-archief waar - na een stevig alarm en knap lastig vallen - er een stevig en knap lastig  antwoord kwam, waar de Gemeente Amsterdam en haar Gemeentelijk Archief  (medewerkers ) maar beter trots op kan zijn;  er bleek meer hersenwerk aanwezig omtrent de [noodzakelijke wet op de] Privacy  ook in haar (internationale) service aan gebruikers in ons digi tijdperk en tegenstrijdige belangen die dat kan betekenen dan er op provinciaal niveau bestond. 

Ook mijn waardering, dank en respect aan het FIOM, Utrecht, waar weliswaar op uitvoeringsniveau van hulpverleners dan kennelijk wél de wens tot hulpverlening zal bestaan, maar er inhoudelijk - en niet slechts m.b.t. Privacy (wetgeving), archieven en digitalisering de nodige kennis ontbrak

(gelukkig wel, waardoor zo'n bekend balletje kon gaan rollen

maar dat zeker op bestuurs niveau niet ontbrak. 

Met als gevolg dat er binnen enkele uren niet slechts handelend opgetreden kon worden ter bescherming van mensen betrokken mensen waarvan velen dat waarschijnlijk nooit zullen weten.

Maar er bovendien tot dan veelal onbekend materiaal boven water kwam en/of op geattendeerd werd/kon worden. Waarvan hopelijk dan wél de nodige betrokkenen van kunnen en zullen weten: Zorgdragen voor dat wat niet van jou hoeft te zijn 

Dit gepaard gaande met mijn ook nog steeds diepe minachting voor de handelswijze vanuit het Fiom Den Bosch. Die ik niet anders kan waarderen dan als misselijkmakende arrogantie en daarmee onacceptabele geldklopperij vanuit een organisatie klopperij van overheidsgelden  t.b.v. een project

waarvoor bij  betrokkenen inderdaad de noodzaak bestaat. Maar waar -gezien de handelswijze, die betrokkenen kennelijk gezien worden als de bekende melkkoe. 

Een demonstratie die ik cadeau kreeg. En die, zeker zo kort na een hoorzitting van de tweede kamer waarin ook deze  realistische en bestaande noodzaak aangekaart werd. 

Opportunistische optreden vereist bepaald geen hufterig optreden buiten het bereik van camera's. 

En wanneer dat gebeurd op een (deel-) terrein van mensen met wiens knap basale Mensenrechten meer dan genoeg is aangerotzooid uit winstbejag is dat géén Zorg, maar simpelweg het maatschappelijk opportunisme dat die minachting ten volle verdiend ! 

Mijn gebrek aan respect en waardering geldt ook t.a.v. de (juridisch)  secretaris van het Meldpunt  seksueel misbruik RKK. 
Deze werd door mij geïnformeerd m.b.t. het boven water zijn gekomen van materiaal van archieven van Pro Juventute: immers dat was materiaal waarvan aangenomen was/werd dat dat niet (meer) bestond c.q. vernietigd was. 
Ik heb dit materiaal gezien, vond (en vind!) dat dit, mét in achtname van de Wet op de Privacy  zowel als het simpel boerenfatsoen - ik ben ten slotte mede een produkt van mijn jeugd in die RKK Kinderbescherming en wat dit betekent (heeft) en dat niet slechts voor mij persoonlijk of dat voor mijn gezins- en familieleden (tot op vandaag de dag op een veelfout van terreinen), dat dit geweten dient te worden. 

Dit materiaal is niet eerder gebruikt !! In ieder geval niet door Deetman cs. , of m.b.t. betrokkenen en de Samson Cie. , (noch door Slachtofferhulp naar het zich laat aanzien) en  dat was het tot het moment van mijn melding daar  niet door de Cie. De Winter.

Ik heb het materiaal wél gezien. En dat door gegeven ook. 
En bepaald niet alleen tbv. de (wet op ) de Privacy.    Maar ook tbv. onderzoeken/procedures ,  klachten- en  compensatie wensen, zoals  mede voor die Meldpunt procedures en de daarbij komende noodzaak van het (kunnen) onderbouwen van die klachten etc. 

In dit materiaal is - met voldoende kennis van zaken - aanwezig hiertoe. 

Zonder te beweren dat hier nu zoveel direct bewijs materiaal in staat - geen idee, dat is mijn vak of deskundigheid en zeker ook mijn interesse (prioriteit) niet, dat was het nooit ook. 

Maar ik ben er wel van overtuigd dat er - zo al niet bij enkele mensen heel direct wél - dermate informatie in te vinden is, en niet pas met de kennis van nu, maar op basis van authentiek en  eigentijdse materiaal, dat dit geweten had moeten worden door de  KlachtenCommissie c.q. het Meldpunt. En dat zelfde vind ik tav. "slachtoffers" en hun (juridische) hulp. 

De (juridisch) secretaris heeft (verschillende) malen geweigerd dit serieus te nemen of hiermee iets te doen. 

Ik vond en vind dit onacceptabel en een directe aanfluiting van die hele procedure c.q. de opzet van het geheel. 
En kan hierbij inderdaad slechts dank je wel zeggen tegen een hele wijze vent in zijn uitspraak: 
hier heb je je kwartje, en nu maar gauw in je rieten rokje om het kampvuur gaan dansen. 

Ik ben blij dat ik die wijze vent ook ooit tegen het lijf liep. 
Zoals ik blij ben dat ik niet slechts die papieren (en wat bijpassend materiaal) vond, maar ook daarin de nodige mensen, Al viel ik zeker niet onder Pro Juventute.  Zij passen in mijn herinneringen van feiten, niet slechts als kind/jong (volwassene) en daarna, ik kom ook hen tenslotte nog (steeds) tegen
Maar zeker ook in de realiteit dat ook duiding tijd nodig heeft en ik die gelukkig wél heb gekregen ! 
Ik kom ze tenslotte nog (steeds) tegen....

Daarmee hoeft er tegen mijn kinderen inderdaad niet gelogen te worden en zijn die archiefstukken de Kers van de taart.
