O Vaticano analisa um processo de expulsão do padre Jan van Dael, da congregação dos missionários Sagrado Coração de Jesus (SCJ). Dael é um dos dois padres belgas, acusados de pedofilia naquele país, que trabalham com crianças no Brasil. Dono de um abrigo de adolescentes carentes em Caucaia (CE), “Pai Jan”, como é conhecido pelos menores, foi acusado de abusar de cinco crianças belgas nas décadas de 1970 e 1980, e de também de abusar de crianças brasileiras abrigados em sua instituição, chamada Sítio Esperança da Criança, em Caucaia, cidade próxima a Fortaleza.

O outro padre é Marc Filip Dacuypere, o padre Marco, capelão e professor em um colégio católico de ensino regular em Salvador e responsável por uma das paróquias da Arquidiocese de Salvador. O padre, que já trabalhou em um centro infantil com crianças de dois a seis anos de idade, foi suspenso nesta semana das atividades religiosas pelo bispo de Bruges, Josef De Kesel. Ele está na Bélgica para se explicar a uma comissão da Igreja Católica sobre as denúncias de que teria abusado de um menino e uma menina que eram seus alunos numa instituição da Igreja Católica daquele país na década de 1980.

Os dois padres chegaram a responder pelas denúncias, na Bélgica, entre 2010 e 2011, mas foram liberados devido à prescrição dos crimes pela legislação belga. De volta ao Brasil, onde moravam desde 1990, eles continuaram cuidando das crianças, sem acompanhamento das autoridades civis e religiosas brasileiras, que, apesar de alertadas pela Igreja e por entidades dos Direitos Humanos da Bélgica sobre o perigo que isso representava para as crianças brasileiras, nada fizeram.

Na quinta-feira, o vigário-geral da SCJ, em Roma, John van den Hengel revelou à reportagem do Terra que o padre Jan van Dael está passando por um processo de expulsão, que está em análise pela Congregação da Fé, do Vaticano, entidade que deverá decidir o seu futuro. Hengel explicou que o processo de expulsão foi iniciado depois que padre Jan se recusou a obedecer às exigências da liderança da SCJ, ordem à qual pertence.

Durante as investigações, que tiveram início em maio de 2011 e terminaram no outono de 2013, padre Jan se recusou a cumprir diversas medidas, como instalar conselho de profissionais para cuidar de seu abrigo, melhorar as condições do sítio, fechar o sítio e repassá-lo a uma organização que pudesse administrá-lo melhor e a se mudar para a região Sul do Brasil.

Depois de diversas visitas da liderança da SCJ ao País - nas quais o padre sempre negava as denúncias de abuso contra os adolescentes e a liderança da SCJ constatava as precariedades do sítio -, padre Jan foi convidado a fechar seu abrigo. Mas logo ele reabriu e pediu verbas na Europa para manter sua instituição beneficente, que àquela altura, já não tinha mais cadastro para se manter oficialmente aberta e em funcionamento legal.

“Os religiosos constataram que não havia nenhum programa. A SCJ então decidiu que Jan, devido à sua idade (72 anos) e às precárias instalações do local, deveria fechar a casa, fazer as reformas nas instalações, entregá-la para uma organização que pudesse cuidar das crianças e se mudasse para o Sul do País”, disse Hengel. “A pressão feita pela liderança belga-holandesa da SCJ, fez com que Jan van Dael, em fevereiro de 2013, assinasse um acordo formal para fechar a casa. No entanto, ele não deixou o sítio e ainda começou a abrigar crianças e a solicitar fundos na Europa para apoiar seu abrigo”, contou o vigário-geral.

A reação da SCJ foi ameaçar de expulsá-lo em três cartas enviadas a ele para exigir que deixasse o sítio e fixasse residência no Sul do Brasil. Em uma das cartas, Jan se recusa a aceitar a demanda. A recusa, já no outono (outubro/novembro) de 2013, leva a SCJ a ameaçar Jan com uma demissão formal da congregação, cujo processo foi enviado ao comando da SCJ em Roma.

“Um dossiê foi montado com a carta de demissão, que foi enviado para a Congregação em Roma, que é quem decide sobre a demissão”, contou Hengel. Segundo o vigário-geral da SCJ, o processo do caso, acompanhado de uma carta do Superior Geral da Congregação, foi enviado para a Congregação da Fé, no Vaticano, em janeiro de 2014. Como exige os novos regulamentos que tratam dos supostos casos de abusos, a Congregação da Fé é quem avalia o pedido de expulsão e assim que fizer a avaliação, comunicará sua decisão à SCJ, que ainda não recebeu a resposta da Congregação da Fé.

Conselho fará vistoria
O Conselho Tutelar de Caucaia informou nesta sexta-feira que vai vistoriar na próxima quarta-feira o sítio Criança da Esperança para conferir se a denúncia de abuso sexual contra menores é verdadeira. Segundo o conselheiro James Barros, a denúncia remonta a 2008, quando começou a ser checada. No dia 16 de novembro de 2014, o promotor de Infância e da Juventude, Ronald Fontenelle, pediu ao Conselho que fosse checar novamente as atividades no sítio. “Como era uma denúncia que ainda estava aqui para nós, pedi para que verificasse a veracidade”, afirmou. O promotor disse que recebeu informações de que o sítio está fechado, mas quer a vistoria para que possa comprovar se isso é verdadeiro ou não.

ex-Belgische ex- ‘eskimo-pater’ ex-Oblaat in Canada veroordeeld tot 19 jaar cel

Eric Dejaeger, die bekend staat als de zogenaamde ‘eskimo-pater’ is in Canada veroordeeld tot 19 jaar cel voor seksuele misdrijven op kinderen. Met de voorhechtenis in achting genomen, zal de 67-jarige Belg nog 11 jaar in de cel verblijven.

Dejaeger, een voormalige katholieke priester van Belgische afkomst, stond terecht voor het seksueel misbruik van kinderen in het Canadese Igloolik, meer dan dertig jaar geleden. Hij werd in september schuldig bevonden aan 24 aanklachten van seksueel misbruik van minderjarigen. Bij de start van het proces pleitte Dejaeger al schuldig aan 8 aanklachten. Het proces duurde in totaal tien maanden.

De openbare aanklager in het Canadese Iqualuit had 25 jaar cel geëist. Volgens hem moet er niet gestreefd worden naar rehabilitatie maar naar vergelding en erkenning van de feiten. Hij vroeg aan de rechter om rekening te houden met de verzwarende omstandigheden. Zo waren de meeste slachtoffers jonger dan achttien jaar oud, ging het misbruik jarenlang door en hadden de feiten een zware impact op het leven van de slachtoffers.

De advocaat van Dejaeger, Malcolm Kempt, had op zijn beurt 12 jaar cel gevraagd. Hij voerde aan dat in het verleden in Canada zedendelinquenten met zwaardere feiten op hun kerfstok al lichtere straffen kregen dan 25 jaar opsluiting. Om zijn pleidooi kracht bij te zetten noemde hij enkele voorbeelden van zedenmisdrijven die door de daders werden gefilmd en waarbij wapens werden gebruikt, waarna hij concludeerde dat de misdaden van de Dejaeger minder monsterlijk waren. Bovendien, ging Kempt verder, heeft Dejaeger bijzonder veel schrik om tijdens zijn gevangenschap te overlijden.

‘Levens onherstelbaar verwoest’

‘Uw zelfzucht heeft een generatie jonge katholieke parochianen in Igloolik verwoest. Vele levens werden onherstelbaar veranderd door uw duister legaat', aldus de rechter (iii).
 'Voor veel slachtoffers betekende het plegen van uw delict het einde van leven en het begin van hun overleven.' De strafmaat kwam uiteindelijk op 19 jaar te staan. 'Deze gevangenisstraf is enkel het begin van de boetedoening’, aldus de rechter aan het slot tot de beklaagde. 

Dejaeger zit al 4 jaar in voorhechtenis en die periode mag dubbel van de straf worden afgetrokken, wat betekent dat hij nog 11 jaar effectief in de cel moet blijven.

B. Concluding Remarks 

(i).The Court`s remarks on the supports available at sentencing 

[330] Victim support during the trial and subsequent sentencing hearing has been provided by a number of organizations. 

[331] Mental Health Services, Government of Nunavut, made five counselors available at the Courthouse. Community Justice, Government of Nunavut provided two victim support coordinators. These victim support coordinators were instrumental in facilitating the involvement of the Ilisaqsivik Society [Society] from Clyde River, Nunavut. 

[332] This Society is a non-profit community-based Inuit organization that is dedicated to promoting community wellness. The Society sent four counselors to Iqaluit who provided support in both English and Inuktitut to victims and community members. The cost of sending three of the four counselors was borne by the Society. 

[333] This support was invaluable. It made the burden a little lighter for those attending court. 

[334] The Court thanks each and every organization for this assistance. A heart sent thank-you is extended to those involved for their time and effort in helping those affected. 

(ii).The Court`s address to the victims 

[335] This Court is powerless to undo the past. No sentence can ever compensate you for what has been taken. No sentence can ever compensate you for the pain and anguish that you have suffered. No sentence can ever return the quality of life that has been missing these past many years. For many of you, no sentence will ever be long enough, or hard enough. 

[336] Your anger must be put aside. Your trust in others must be restored. You must learn to rely on the good around you, in your family, in your neighbors, and in your community. Despite what has happened to you, there is still much good in people. It is all around you. You will find that by sharing your burden with others, the burden will eventually become easier to carry. 

[337] The time has now come for you to move on with your lives. 

[338] The Court wishes you well in the long healing journey that lies ahead. 

(iii). The Court`s address to the accused

[339] Your selfishness has devastated a generation of young Roman Catholic parishioners in Igloolik. Many lives have been irrevocably altered by your dark legacy. For many victims, the commission of your offence has marked the end of living and the beginning of their survival. 

[340] You must now atone for the many wrongs that you have inflicted on others. 

[341] This sentence is only the beginning of that atonement.

Church must rid itself of the scourge of child sexual abuse


Last March I established the Pontifical Commission for the Protection of Minors,
which had first been announced in December 2013, for the purpose of offering proposals and initiatives meant to improve the norms and procedures for protecting children and vulnerable adults. I then appointed to the Commission a number of
highly qualified persons well-known for their work in this field.

At my meeting in July with persons who had suffered sexual abuse by priests, I was deeply moved by their witness to the depth of their sufferings and the strength of their faith. This experience reaffirmed my conviction that everything possible must be done to rid the Church of the scourge of the sexual abuse of minors and to open
pathways of reconciliation and healing for those who were abused.

For this reason, last December I added new members to the Commission, in order to
represent the Particular Churches throughout the world. In just a few days, all the
members will meet in Rome for the first time.

In light of the above, I believe that the Commission can be a new, important and
effective means for helping me to encourage and advance the commitment of the
Church at every level – Episcopal Conferences, Dioceses, Institutes of Consecrated
Life and Societies of Apostolic Life, and others – to take whatever steps are
necessary to ensure the protection of minors and vulnerable adults, and to respond
to their needs with fairness and mercy.

Families need to know that the Church is making every effort to protect their children.
They should also know that they have every right to turn to the Church with full
confidence, for it is a safe and secure home. Consequently, priority must not be
given to any other kind of concern, whatever its nature, such as the desire to avoid
scandal, since there is absolutely no place in ministry for those who abuse minors.

Every effort must also be made to ensure that the provisions of the Circular Letter of
the Congregation for the Doctrine of the Faith dated 3 May 2011 are fully
implemented. This document was issued to assist Episcopal Conferences in drawing
up guidelines for handling cases of sexual abuse of minors by clerics. It is likewise
important that Episcopal Conferences establish a practical means for periodically
reviewing their norms and verifying that they are being observed.

It is the responsibility of Diocesan Bishops and Major Superiors to ascertain that the
safety of minors and vulnerable adults is assured in parishes and other Church
institutions. As an expression of the Church’s duty to express the compassion of
Jesus towards those who have suffered abuse and towards their families, the various
Dioceses, Institutes of Consecrated Life and Societies of Apostolic Life are urged to
identify programmes for pastoral care which include provisions for psychological
assistance and spiritual care. Pastors and those in charge of religious communities
should be available to meet with victims and their loved ones; such meetings are
valuable opportunities for listening to those have greatly suffered and for asking their
forgiveness.


For all of these reasons, I now ask for your close and complete cooperation with the Commission for the Protection of Minors. The work I have entrusted to them includes
providing assistance to you and your Conferences through an exchange of best practices and through programmes of education, training, and developing adequate responses to sexual abuse.

May the Lord Jesus instil in each of us, as ministers of the Church, the same love and affection for the little ones which characterized his own presence among us, and which in turn enjoins on us a particular responsibility for the welfare of children and vulnerable adults. May Mary Most Holy, Mother of tenderness and mercy, help us to
carry out, generously and thoroughly, our duty to humbly acknowledge and repair
past injustices and to remain ever faithful in the work of protecting those closest to
the heart of Jesus.
