Sensitive information disclosed to the McAleese committee, which has been investigating State involvement with Magdalene laundries, will not be published in the committee’s report tomorrow.


The interdepartmental committee, chaired by Senator Martin McAleese, began its work in July 2011 and has sought to establish the extent of State interaction with the 10 Magdalene laundries in Ireland between 1922 and 1996.

As Senator McAleese made clear when appointed on July 1st, 2011, “the sole purpose of the committee is to clarify and detail the facts of any State interaction with the laundries”.

‘Appropriate safeguards’
An interim report the committee published on October 25th, 2011, disclosed that “appropriate safeguards” had been put in place to enable the four religious congregations concerned to co-operate with the committee “within the law and while fully respecting the sensitivity and confidentiality of the records”.

It said an order had been made by Minister for Justice Alan Shatter to authorise the disclosure of sensitive personal data to – and processing of such data by – the committee.

The congregations involved were the Sisters of Our Lady of Charity, the Congregation of the Sisters of Mercy, the Religious Sisters of Charity and the Sisters of the Good Shepherd.

No personal data
The report said, “in no case would such sensitive personal data be published or made available to the public without the consent of the data subject”, living or dead. It added: “The names or personal data of former residents of the Magdalene laundries will not be published or otherwise released to the general public.”

Also, an archive of the committee’s work will not include “personal and sensitive personal data”, all of which will be “destroyed and/or returned to the relevant religious order upon conclusion of the committee’s work and publication of its report”, it said.

Researchers at the women’s studies centre in the school of social justice at UCD are seeking interviewees for a Magdalene oral history project. It is collecting accounts from Magdalene survivors, relatives, members of the religious orders, and anyone who wishes to share memories and experiences of the institutions. Abused in the past and abandoned in the present

She remains anonymous by choice. She values her privacy above all. She lives alone and never married. She attends daily Mass. She will never again live in Ireland. She celebrated her 78th birthday recently. She is a survivor of the Magdalene laundries.

Her mother died when she was seven. At 14, her father remarried but she and a younger sister were unwelcome in the new family household, the only home they ever knew. Poverty was her only crime.
She was taken to the Good Shepherd convent in New Ross, her younger sister sent by train to the congregation’s Limerick house. The Good Shepherds managed industrial schools for children at both locations and a reformatory school for girls in Limerick.

But the two sisters were put to work in the Magdalene laundry with its population of adult women workers. For the next five years she washed society’s dirty laundry and received no pay. When she refused to work the nuns cut her hair as punishment. The hair grew back but to this day the loss of her education angers her. To her, it was a prison in all but name. There was no inspector, no child welfare officer. She was abandoned and no one cared.

Sixty years later this woman lives with the stigma and shame attached to these institutions. These are the indelible stains on her life.

And, in her case and others, there are life-long material consequences to having spent time in the Magdalene laundry. Her application to the Residential Institutions Redress Board was rejected. The 10 laundries were not among the institutions covered, thus her application was deemed “ineligible”, and the review board refused her appeal.

Friends helped her apply for a statutory pension, but once again her years working in the Magdalene laundry did not count when calculating her entitlement. She was never paid so no stamps were submitted on her behalf. After endless bureaucratic delays and reams of paperwork, she receives a meagre $7.50 a week from the Irish State – that is, after an Irish bank deducts international wire transfer and currency conversion charges.

This is the plight of one Magdalene survivor: abused in the past, abandoned in the present.

This morning as she wakes in her rented apartment here in the US, the Cabinet will meet in Dublin to discuss the final report from the Inter-Departmental Committee Investigating State Involvement with the Magdalene Laundries. This afternoon the report is to be published. It remains to be seen how or whether the Government responds. In either case, today’s events will have an impact on the rest of her days.

She is not alone, nor is her experience exceptional. Survivors can be found all across Ireland, the UK, the US and beyond, each with her own story to tell, all of them anxiously awaiting news from Government Buildings this afternoon.

Some contributed to the work of the interdepartmental committee – they completed surveys, submitted testimony that was often difficult and painful to recall, and travelled to Dublin or London to meet the committee chairman, Senator Martin McAleese, in person.
In doing so, they showed admirable courage and resilience.
 
Others felt unable to participate. Their time in the Magdalene laundry remains a carefully guarded secret.

They fear jeopardising established identities – husbands, children and grandchildren know little about this part of their past. Or they have a deep distrust that justice will be forthcoming. They have been disappointed before. For some, the risk is paralysing.

And still, the women’s testimony is compelling. It rebuts government claims that they entered these institutions “voluntarily”. It contradicts the religious orders’ assertion that women were free to come and go as they pleased. Some survivors describe their experience as tantamount to “slavery”, living behind locked doors and barred windows.

They insist, moreover, that members of An Garda Síochána routinely brought women to the laundries and/or returned women who escaped – regardless of whether the State was involved in committing them in the first place, and in the absence of any statutory basis for doing so.


The women’s testimony corroborates historical archives that disclose the transfer into the Magdalene laundries of children from State-funded residential institutions and unmarried mothers from State-licensed mother-and-baby homes.

There is no evidence to suggest the State made certain the release of these women and young girls. Some would remain to live and die behind convent walls.

Testimony substantiates historical Dáil debates that point to various State agencies contracting laundry work to the nuns’ commercial businesses, and doing so without a “fair wages clause” as stipulated for similar contracts with commercial laundries. Women describe laundry specific to the Army, State hospitals, prisons, agricultural laboratories etc.

It is to be hoped today’s report will answer many of the heretofore unanswered questions about these institutions, for example, how many women entered, why did they end up there, who brought them, how long did they stay, how many died, and where are they buried? It will, as such, help Irish society better understand this aspect of our nation’s past.

Ultimately, however, today will be remembered for how the Government responds to the conclusions about State involvement, the committee’s primary remit. The survivor community will judge the Government on whether Minister for Justice Alan Shatter announces measures that finally affords them justice.

These measures begin with an official State apology. Lost wages must be restored and pensions recalculated to reflect time spent in the laundries. These measures need to be implemented immediately. The Government should then establish a transparent and non-adversarial compensation scheme that is open to all survivors and puts their welfare at the forefront.

Time is of the essence. It is the one commodity many of these women can ill afford. They have waited for justice too long already. The wait must end today.

Her first tweet simply said: “My mother was Magdalene No. 322. Real name Margaret.”

It was met by a number of reactions, including disbelief that Magdalenes were given numbers.

 “Yes,” replied Samantha Long. “I was looking over her records today and thought I’d share that. Awful.”






The Twitter user was talking about her late mother, Margaret Bullen, a woman taken into the Magdalene Laundries system when she was just two years old.

Just days ahead of the publication of a report into the level of State involvement at the now-infamous institutions, Long decided to share her family’s story.

There had been a campaign to get the hashtag #justiceformagdalenesNOW trending on Twitter to raise awareness last night and the Dublin woman’s provocative, powerful and heartbreaking tweets
achieved that aim.

Senator Martin McAleese’s report has been sent to Justice Minister Alan Shatter, who will publish it in full on Tuesday afternoon, following a Cabinet meeting.

The long-awaited report has been delayed multiple times since the inter-departmental committee was established in response to a recommendation from the United Nations Committee Against Torture (UNCAT).

That body said it was “gravely concerned” at the failure of the State to protect girls and women who were involuntarily confined between 1922 and 1996.

Advocacy groups have called for a full State apology, as well as a proper, transparent compensation scheme for survivors. About 30,000 women were incarcerated in Magdalene Laundries between 1922 and 1996.

As church files revealed this week, Bishop Thomas J. Curry chose again and again to conceal clerics' crimes and put priests' welfare ahead of helping victims.

A mistake the Santa Barbara District Attorney's Office is now investigating.
"We have some very serious allegations of obstruction of justice at the very least by individuals, I think the community has trusted throughout for a number of decades," says Santa Barbara City Chief Deputy District Attorney Hilary Dozer. "And that's a disturbing fact."

And prosecutors face another challenge. Most of the files happened in the 1980's far beyond the statute of limitations.
"If an individual has actively hidden information from law enforcement, there are some ways and situations where that statute of limitations is tolled," says Dozer. "Meaning it does not preclude us from going forward."

 SANTA BARBARA — When he took office in 1985, Roger M. Mahony set about modernizing the operations of the Los Angeles Archdiocese. He brought in computers and put women in top jobs.

He then appointed an Irish-born academic to a brand-new cabinet position: Vicar for Clergy, a human resources director of sorts for priests, brothers and nuns. Msgr. Thomas J. Curry would shape the way the nation's largest archdiocese responded to claims that its priests had molested and raped children.

In his five years in the role, Curry was a staunch defender of the church and its clergymen. And as revealed in secret church records made public this week, he chose again and again to conceal clerics' crimes from police and put priests' welfare ahead of helping victims.

 On Thursday, as his former boss was publicly rebuked, the 70-year-old regional bishop in Santa Barbara stepped down, part of an unprecedented reaction by the Catholic Church to the clergy child abuse scandal. It was a stunning fall for a man who had acted as a right hand for one of the most powerful U.S. Catholic prelates.

Over the years, Curry has issued numerous public apologies in response to the sex abuse scandal. At the same time, he has been outspoken in his criticism of government authorities who, he says, were overzealous in their investigations.
"The targeting of the Church (particularly in California), the overreaching of district attorneys and prosecutors, and the lack of due process and fairness for the Church has been tyrannical," he once wrote on a personal blog.

In another online missive, he criticized a San Diego federal judge who had upheld a California law allowing victims to sue for decades-old abuse: "Americans assume that the days of Henry VIII, when rulers declared themselves authorities in religious matters, are long gone in America. For Catholics, unfortunately, that is far from the reality."
 
In an email to The Times on Saturday, Curry said he wrote the blog posts to make the point that the Catholic Church was being unfairly blamed for a "society-wide issue."
"I do believe that it is a mistake for society to treat this as a 'Catholic Church' problem," he said.

Memos and letters
Not long after his appointment as vicar in 1985, Curry was discussing ways to keep the misdeeds of priests out of the court system, the newly released records show. Curry wrote memos and letters stating that he believed the church was not legally responsible for the harm its priests caused.

In November 1989, Curry wrote to Mahony about where to assign Father Kevin Barmasse, who had been sent to Tucson years earlier after molesting a Lakewood boy. The priest wanted to return to Los Angeles. Curry wrote: "The young boy involved is now about eighteen, so Kevin should certainly not return for another two years by which time the period for filing law suits will have passed."

In a letter that same month, he told Barmasse to stay in Arizona.
"While such suits are not effective against the Archdiocese, in that the Archdiocese was not aware of your behavior and did take action as soon as it became aware of it, they are extremely painful for all parties involved," Curry wrote. "Our experience tells us that your presence in the area ... would greatly increase the possibility of a suit against you."

He also dismissed the notion that the church bore responsibility for the acts of Msgr. Peter Garcia, a priest who targeted the children of undocumented immigrants.

In a 1990 letter, Curry wrote that he viewed a boy molested by Garcia as "the victim of a person who, as a result of his own illness, committed grave wrongs."
"Although the person was a priest, he did not perform these wrongs as a representative of the Church or even with its knowledge," he wrote.

Curry, as Mahony's delegate in handling abuse claims, dealt directly with the problem priests. After he met and corresponded with them, his sympathies often appeared to lie with the clerics.

Of one priest, George Neville Rucker, accused in 1989 by a 31-year-old woman of decades-old abuse, he wrote: "It was of great concern to him that for something that was so casual to him at the time could be so devastating to her … he stays awake at night because of this."
"The trouble it caused him and his transfer was such a trauma for him that he has never been involved in anything since that time," Curry recounted.

Curry also proposed to Mahony that another priest stay away from a therapist who "should have" contacted police but did not. And, he raised the possibility of sending an abusive cleric to a psychiatrist who was also an attorney so their conversations would remain legally confidential.

Curry declined to respond to questions on the files, saying he has "not had the time or opportunity" to review them. He said he felt "profound regret, disappointment, sorrow and sympathy" for parishioners who may have felt betrayed by the revelations.

Curry stressed that his actions related to priest abuse were at the behest of Mahony.
"I acted after consultation and consent of the Archbishop," he wrote in the email sent by his attorney. Curry said if such allegations were to come to his attention today, he would "be sure to ascertain that the matter had been reported to the secular authorities."

Church and state
Curry was ordained as a priest in Ireland in 1967. He earned a degree at University College Dublin in history and political science and soon moved to Southern California, where he worked as a parish priest in Woodland Hills and then as a high school teacher in Downey and Santa Fe Springs. He received his doctorate in American history at Claremont Graduate University.

Curry is a 1st Amendment scholar who has written and lectured extensively about the separation of church and state. He argues that since the 1940s, the government has meddled too much in church affairs.
When the church abuse scandal broke in 2002, more than a decade after his tenure as vicar ended, Curry was the Santa Barbara regional bishop. He repeatedly apologized in local newspapers, saying the church had not been equipped to deal with the problem.

That year, a group of Catholics started a chapter of the national church reform group Voice of the Faithful. Curry met with them. Marie Foley, 74, a former professor at Santa Barbara City College, said that Curry came across as a gentle scholar, an introverted intellectual who charmed people with his Irish brogue. He was far from imperious, she said.
"He expressed remorse at those meetings," Foley said. "I thought it was heartfelt. I got a sense that they were very slow in understanding sexual abuse and understanding pedophilia."

Behind closed doors, however, Curry struck a different tone.
In a 2009 civil deposition about his handling of Michael Baker, one of the archdiocese's most notorious pedophile priests, Curry said that in the 1980s neither he nor Mahony notified parishes where Baker had previously served, nor did they try to locate victims. "I wasn't trained in finding people," he said.

The bishop said he understood child molestation was a crime in 1986, when Baker first told church officials he'd abused boys, but didn't call the police because there was an understanding that Baker's admission — though not a sacramental confession — was a "confidential matter."
"If he had come in and told you he had murdered children, would you have called police?" an attorney asked.
"I don't know what I would have done in that I never dealt with such a thing," Curry replied.

Authorities believe that Baker molested as many as 23 children. He pleaded guilty in 2007 to sexually abusing two boys. Curry said that he was "disappointed" and "grieved" over the priest's transgressions, but he added: "I did not think I made a mistake at the time."
"Do you feel you bear partial responsibility for that by putting him back in ministry?" the attorney asked.
"No," Curry said.
"So your conscience is clear on that?" the attorney asked.
The bishop replied: "Yes."

'Very cordial'
In recent years, Curry had gained the respect of some Santa Barbara parishioners critical of the church's handling of the priest scandal.

Kathleen Strittmatter, 70, and her husband were so taken by the affable bishop that every Christmas they sent him a few bottles of good red wine. He didn't like Merlot, and shied away from Scotch, which gave him headaches, she said. The couple also gave Curry a series of jazz albums.
Strittmatter, who would sometimes run into Curry at the local Trader Joe's, said he often spoke nostalgically of his native Ireland.
"I felt a real connection to the man," she said. "He was very kind and very cordial."
 
When an elderly friend of hers who volunteered at Curry's residence started suffering from dementia, the bishop and Strittmatter worked together to help her.

This week, she and others were dumbfounded by what the reams of church records and correspondences revealed about the bishop's reaction to allegations of child abuse. They said they couldn't help but think about the public apologies he made a decade ago.

The local chapter of Voice of the Faithful called for Curry's resignation. But Strittmatter said she felt she owed Curry her own personal email. After a lot of prayer, Strittmatter told the bishop she hoped he would resign, adding pessimistically: "This will never happen I know."

She concluded the email: "I have spent the last week in devastation and sorrow, as I am sure have you. May God have mercy on us all."

A letter from Archbishop Jose Gomez expressing his anguish about newly released sex-abuse files will be read during Mass on Sunday to Roman Catholics around the Los Angeles area, who will also hear pleas for donations to the region's poorest parishes.

 At St. Bartholomew Church in Long Beach, Monsignor Bernard Leheny plans to interject his own request - that parishioners put aside their anger at clergy implicated in the ongoing scandal and focus instead on living the tenets of their faith. "The hurt has been resurrected by the bad publicity and the mistakes that were made," Leheny said. "I worry that will hurt the poor parishes if people hold back (on donations).

"But the church has made tremendous progress in  the protection of children. All the people who deal with children - not just the clergy, but lay ministers - have taken training sessions so they can be aware. "You see this around the church on any given Sunday."


Leheny's hope is that efforts by the church will allow its followers to someday get past the horrific details contained in the files on pedophile priests that were released last week.

The decades-old documents show that Cardinal Roger Mahony and his then-Vicar of Clergy Thomas Curry knowingly transferred priests accused of molestation from parish to parish and maneuvered to protect them from the police.
Minutes after the court-ordered release of some 12,000 pages of documents for 124 priests on Thursday, Gomez issued a statement describing the behavior detailed in the files as "terribly sad and evil." "There is no excuse, no explaining away what happened to these children," Gomez said in his statement, which will be read at Sunday Masses. "The priests involved had the duty to be their spiritual fathers and they failed."  Gomez indicated that he's working on a long-term plan to rebuild trust in the nation's largest archdiocese, with details to be announced in the weeks ahead.
"We will continue to work, every day, to make sure that our children are safe and loved and cared for in our parishes, schools and in every ministry in the archdiocese," he said. The first step in the process was a public rebuke of Mahony, whom Gomez stripped of his administrative and public duties - a move that sex-abuse victims decried as symbolic since the cardinal had no administrative duties and his public appearances were limited.

Gomez also allowed Curry to step down as bishop of the Santa Barbara region. Mahony fired back Friday with a letter to Gomez, noting that he's apologized repeatedly for his failures. And while he claimed to be ill-equipped to handle complaints of sex abuse during his first years in Los Angeles, the archdiocese "was second to none in protecting children and youth" by the time Gomez succeeded him as archbishop in 2011.
The church now has a policy of reporting allegations of abuse to law enforcement and removing the priests from ministry.

Leaders of the Survivors Network of those Abused by Priests, were skeptical of the church's efforts to protect its youngest members.
  "We are reaching out to Catholics and members of the community who may have been witnesses to abuse, who may be a whistle-blower, who may have heard allegations, may have heard a confession, may have heard an admission," said Joelle Casteix, western regional director of SNAP.

"We believe that is the only way we will get the true story of the scope and scale of abuse in the archdiocese." SNAP also called on authorities to investigate and prosecute high-ranking church officials who participated in the cover-up of child molestations.

The District Attorney's Office has said it is reviewing the files. The documents posted Thursday on the archdiocese website were part of a 2007 settlement with more than 500 sex-abuse victims, who shared in a record $660 million payout.
 The details in the new files are similar to those revealed in 14 cases released the previous week.

Still, there are surprising details showing how Mahony and his top aides plotted to protect the church from scandal. Mahony received a letter  in 1991 from a man stating that he'd been molested as a child by Father Carl Sutphin when he was assigned to St. Rose of Lima Parish in Maywood.

Mahony sent Sutphin away for treatment, then reassigned him as a chaplain at a convalescent home. After more allegations surfaced in 1994, again dating back to the '70s, the priest was transferred to St. Vibiana Cathedral.

Mahony later chose Sutphin to be an associate pastor when the Cathedral of Our Lady of the Angels opened in 2001.
A year later, however, Sutphin retired from the ministry when he was indicted for molestation - charges that were later dismissed because the statute of limitations had expired.
Sutphin was defrocked in 2005.

According to a church report, he was accused of molesting 18 young boys.
 "There are very few priests of this archdiocese who have had more allegations of such an egregious nature made against them," says a report summarizing the accusations against him.

During the early years of the sex-abuse scandal, church leaders typically took the word of priests over their accusers.

 After admitting to church officials that he'd had a long-term sexual relationship with a teenage girl in the late 1980s, Father Joseph Pina was ordered to undergo therapy, including a six-month stint at Villa St. John Vianney Hospital in Pennsylvania, described in the files as the most regimented treatment facility in country for problem priests.

 "I saw us as a boyfriend/girlfriend relationship," he told one therapist. Pina told another psychologist that he'd been attracted to an eighth-grade girl when he saw her in a costume.


 "She dressed as Snow White I had a crush on Snow White, so I started to open myself up to her," according to the file.

After his release, Pina was assigned to San Buenaventura Mission and told to have no one-on-one contact with females 14-30. By 1998, however, he'd been accused of taking young girls shopping and touching them inappropriately.
He was admitted to the sexual-offenders unit at Del Amo Hospital in Torrance and resigned days later from St. Emydius Church in Lynwood.

Pina was invested by a Ventura County grand jury, but was never charged, according to the file. He was defrocked in 2006.
Two years later, a follow-up memo says that Pina was working for the Los Angeles Unified School District. A 2008 memo posted online by LAUSD identifies Pina as the community contact for an elementary school being built in Canoga Park.

Father Gerald Fessard was allowed to continue in the ministry although he'd pleaded no contest in 1987 to one count each of battery and child molestation after fondling five teenage boys at Our Lady Queen of Angels High School Seminary.
 The plea deal got him a sentence of three years' probation.

A note from Curry says that neither the police nor the City Attorney's Office wanted to publicize the case. Fessard was told not to have contact with minors and to attend 12-step programs for alcohol and sex addiction. In 1994, however, he was accused of inappropriate contact with teenage girls and of being drunk at youth group meets at St. Luke Parish in Temple City. In 2002, Fessard and Mahony agreed that the priest would resign from the priesthood.

 That process took five years while Fessard pressured the church for financial support.

Terry McKiernan, president of bishopaccountability.org, which has been tracking the sex-abuse scandal at diocese across the U.S., said the next few months will be critical in determining the future of the Los Angeles Archdiocese.

He noted that Mahony was a champion for Hispanic Catholics and an advocate for immigrants. At the same time, many of the sex-abuse victims were youngsters from immigrant families.

Pius X Fraterniteit mag geen katholieke kerken gebruiken

GENEVE (RKnieuws.net) - De priesters van de traditionalistische priesterfraterniteit Pius X van mgr. Lefebvre mogen in geen enkel geval gebruik maken van katholieke kerken en kapellen en er geen enkel sacrament toedienen. Daarin herinnert mgr. Charles Morerod, bisschop van Lausanne, Geneve en Freiburg, in een zopas gepubliceerd decreet.
Hetzelfde verbod geldt voor de niet-christelijke gemeenschappen maar als pastoraal de noodzaak daartoe bestaat mogen gereformeerden, lutheranen, orthodoxen en anglicanen wel de katholieke kerken en kapellen gebruiken.

Het decreet van mgr. Morerod is de zuivere toepassing van een beslissing van de Zwitserse bisschoppenconferentie over het gebruik van katholieke kerken en kapellen. De Zwitserse bisschoppenconferentie gaat er van uit dat iedere geloofsgemeenschap over eigen financien en cultusplaatsen beschikt.

Ondanks opheffing excommunicatie

Mgr. Morerod herinnert eraan dat de priesterfraterniteit Pius X ondanks de opheffing van de excommunicatie van haar vier bisschoppen in 2009 door paus Benedictus XVI geen canonisch statuut in de Kerk heeft, dat haar priesters geen wettelijk ministerie uitoefenen en a divinis gesuspendeerd blijven. Om die redenen kunnen zij geen eucharistievieringen opdragen in katholieke kerken en kapellen of er de sacramenten toedienen.

Begeleiders van rituelen mogen de kerken en kapellen ook niet gebruiken omdat het niet om kerkelijke vieringen gaat, aldus de Zwitserse bisschoppen.

Vraag 3:

Is de verantwoordelijkheidsverdeling tussen ouders, professionals, instellingen, overheid en politiek helder, zowel bij thuiswonende kinderen, thuiswonende kinderen met ondertoezichtstelling (OTS), en bij uit huis geplaatste kinderen? Zo ja, wat is deze dan? Zo nee, op welke wijze zien de staatssecretarissen deze verdeling?

Antwoord:
Internationale verplichtingen alsook het nationale wettelijk kader zijn helder daar waar het gaat om de verantwoordelijkheidsverdeling bij een ondertoezichtstelling al dan niet met een uithuisplaatsing.
Ten aanzien van een kind dat (tijdelijk) niet thuis kan verblijven, rust op de overheid een bijzondere plicht om de zorg voor deze kinderen te waarborgen. De wijze waarop de overheid deze verantwoordelijkheid invult, is eerder bij vraag 1 geschetst.


Bij een ondertoezichtstelling, al dan niet met een uithuisplaatsing, blijft het gezag bij de ouders. Het Bureau jeugdzorg is verantwoordelijk voor de uitvoering van de ondertoezichtstelling en daarmee voor de veiligheid van het kind gedurende de ondertoezichtstelling. De pleegzorgwerker is verantwoordelijk voor de begeleiding van de pleegouders en pleegkind.

Het rapport van de Commissie Samson maakt tegelijkertijd zichtbaar dat taken en rollen soms dicht tegen elkaar aan liggen en dat in de praktijk onduidelijkheid bestaat over de rolverdeling tussen pleegzorgwerker en (gezins)voogd. Tussen professionals in de uitvoering mag er vanzelfsprekend geen verwarring zijn over wie wat op welk moment moet doen. In de uitgebreide beleidsreactie op het rapport van de Commissie Samson van 21 december 2012 hebben wij aangegeven dat wij zullen zorgen voor een duidelijke rolverdeling tussen de gezinsvoogd en de pleegzorgmedewerker zodat de beschermingsconstructie die ten behoeve van kwetsbare kinderen is ingericht in de praktijk ook goed werkt.

Vraag 4:
Welke verantwoordelijkheden neemt de overheid over van de ouders wanneer een kind uit huis wordt geplaatst?

Antwoord:
Tenzij er sprake is van ontheffing of ontzetting uit het ouderlijk gezag, zijn ouders te allen tijde – ook bij een ots of een uithuisplaatsing – verantwoordelijk voor de opvoeding van hun kinderen. Bij een uithuisplaatsing neemt de overheid niet de  verantwoordelijkheid voor de opvoeding over. Door de maatregel van ondertoezichtstelling met een uithuisplaatsing moeten de ouders wel de inmenging van een gezinsvoogd accepteren bij de opvoeding van hun kind.
Zoals hierboven in de antwoorden op de vragen 1 en 3 is aangegeven, moet de overheid ervoor zorgen dat alle betrokkenen (waaronder de gezinsvoogden, de pleegzorgwerkers en zorgaanbieders die nauw bij het gezin betrokken zijn) door goede wet- en regelgeving, heldere afspraken, goede opleidingen en verdere professionalisering van de jeugdsector in staat worden gesteld om de uitvoering van de ots en uithuisplaatsing in het belang van het kind zo goed mogelijk uit te voeren en gezin hierbij te ondersteunen. Dit moet ertoe leiden dat een uithuisplaatsing zo snel als dit verantwoord is, kan worden beëindigd en het gezin – zonodig ondersteund door het sociale netwerk en andere hulpverlening- zonder overheidsmaatregel zelf weer alle verantwoordelijkheden voor het onbedreigd opgroeien van het kind op zich kan nemen.


Zo. en misschien kan er dan nu even door die HaHa Overheid  gevolg gegeven worden aan art 1 van de Nederlandse grondwet - en als de sodemieterij met als eerste prioriteit !! -  een verplicht inburgeringstraject  ingesteld worden? 

Doek heeft er nog een handige bijbel voor liggen.

En tot het moment dat dat inburgeringsproject  voor iedereen beschikbaar is even ALLE  geldstromen aan al die cluppies bevriezen en gratis condooms gaan uitdelen!


Vraag 27:
Deelt de staatssecretaris de mening van het rapport dat protocollering meer de bescherming van de professional dan de veiligheid van het kind dient?
Antwoord:
We onderkennen het risico hiervan en zijn bezig een omslag te bewerkstelligen naar handelingsvaardige professionals. Omdat kwalitatief goed handelen, ook in het herkennen en omgaan met seksueel misbruik, zich niet laat vangen in kwantificeerbare regels, professionaliseren wij twee beroepen in de jeugdzorg (jeugdzorgwerker (HBO) en gedragswetenschapper in de jeugdzorg (WO)) en stimuleren wij het ontwikkelen van richtlijnen. Hiermee worden ‘state of the art’ kaders geboden, opgesteld door beroepsbeoefenaren zelf, in samenspraak met cliënten en werkgevers. Beroepsbeoefenaren kunnen in het individuele geval altijd beargumenteerd van de richtlijnen afwijken en bij klachten over het beroepsmatig handelen zullen zij zich in eerste aanleg verantwoorden via het tuchtrecht. Deze optie biedt mijns inziens de grootste kans dat beroepsbeoefenaren de problematiek beter leren herkennen en er adequaat mee omgaan.

Vraag 50:
Hoe en wanneer gaat de staatssecretaris ervoor zorgen dat de motie Kooiman wordt uitgevoerd, die de regering verzoekt ervoor te zorgen dat iedereen die beroepsmatig met kinderen werkt in de particuliere jeugdzorg beschikt over een Verklaring Omtrent het Gedrag (VOG)?

Antwoord:
Momenteel vragen werkgevers in de jeugdzorg op basis van onderlinge afspraken van werknemers een VOG.
De Wet op de jeugdzorg zal medio 2013 worden aangepast zodat de VOG een wettelijke verplichting wordt. Deze bepaling geldt ook voor particuliere onderaannemers. In de nieuwe jeugdwet zal eveneens een dergelijke verplichting worden opgenomen.

Vraag 53:
In de jeugdzorgsector wordt al langer met een meldcode gewerkt. Op welke wijze kan dan de verplichte meldcode, die in feite al bestaat, bijdragen aan betere signalering en melding van kindermishandeling?
Antwoord:
Het klopt dat in de jeugdzorgsector al langer met een meldcode wordt gewerkt. Maar nog lang niet alle organisaties in de jeugdzorgsector beschikken over een   meldcode. De voorgenomen wet verplichte meldcode huiselijk geweld en kindermishandeling verplicht ook deze organisaties om een meldcode te implementeren. Onderzoek heeft aangetoond dat professionals die met een meldcode werken drie keer zo vaak ingrijpen bij signalen van kindermishandeling als professionals die niet over een meldcode beschikken.
Daarnaast wordt verplicht gesteld dat organisaties kennis over de meldcode bevorderen, waardoor meer professionals geschoold zullen worden in het signaleren van en handelen bij kindermishandeling.


Vraag 58:
Welke conclusies trekt de staatssecretaris uit het feit dat seksueel misbruik inherent is aan residentiële jeugdzorg?
Antwoord:
Zolang seksueel misbruik in de samenleving voorkomt, zal het zich ook voordoen in diverse voorzieningen voor zorg, waaronder de residentiële jeugdzorg. Mijn beleid is erop gericht om samen met de instellingen zelf de jeugdzorgsector verder te professionaliseren: door verbetering van de kwaliteit van de opleidingen, registratie en tuchtrecht voor professionals, en door het onderwerp seksualiteit bespreekbaar te maken in residentiële instellingen en pleegzorg. Een open klimaat kan bijdragen aan het tegengaan van seksueel misbruik. Hier ligt een grote verantwoordelijkheid voor de leiding van de instelling.

Vraag 66:
Hoe kan het dat informatie over seksueel misbruik dat bekend is, niet altijd wordt gedeeld? Wat gaat de staatssecretaris doen om de informatievoorziening te verbeteren, en waarom is voor deze maatregelen gekozen?
Antwoord:
Met informatie over seksueel misbruik moet zeer voorzichtig worden omgegaan. Het is niet altijd eenduidig vast te stellen en er is een gerede kans dat aantijgingen achteraf niet blijken te kloppen. Het onzorgvuldig uitwisselen van informatie over seksueel misbruik kan levens van onschuldige ‘daders’ ernstig beschadigen. Hiervoor gelden niet voor niets strenge privacy regels. Een goede afweging (belang van het kind versus belang van het onterecht beschuldigen van een ‘dader’) moet hierom zo laag mogelijk in de organisaties worden gemaakt, binnen de kaders die de privacywetgeving hiervoor stelt.
Zoals vermeld in de brief van 21 december 2012 (p. 8) besteedt Jeugdzorg Nederland aandacht aan dit onderwerp. Het beleid rond signaleren, vermoeden, handelen en melden krijgt een plaats in het te ontwikkelen kwaliteitskader. Ook de professionalisering van de jeugdzorg richt zich op het aanpakken van de handelingsverlegenheid door ervoor te zorgen dat binnen instellingen en pleeggezinnen makkelijker over seksualiteit wordt gesproken.

Vraag 68:
Meer dan de helft van de daders van seksueel misbruik is een leeftijdsgenoot, veelal een groepsgenoot. Welke acties gaat de staatssecretaris nemen om het risico op seksueel misbruik binnen een groep tot een minimum te beperken?
Antwoord:
Bij de implementatie van de aanbevelingen richten wij ons zowel op de professional en de pleegouder als op groepsgenoten.
Het bespreekbaar maken van seksualiteit in het team en met jongeren vinden wij één van de centrale thema’s bij de aanpak van misbruik. Jeugdzorg Nederland neemt dit onderwerp mee in het kwaliteitskader Voorkomen Seksueel Misbruik.

Vraag 77:
Is de staatssecretaris bereid om de Inspectie voor de Gezondheidszorg (IGZ) toezicht te laten houden op de certificering van medewerkers in de (justitiële) jeugdzorg en waar nodig sanctionerend op te treden? Zo nee, waarom niet?

Antwoord:
De commissie spreekt van wettelijk verplichte certificering van alle medewerkers in de (justitiële) jeugdzorg. Wij interpreteren de aanbeveling van de commissie zo, dat het de wettelijk verplichte registratie van beroepsbeoefenaren in de jeugdzorg betreft. Het belang van registratie zien wij en aan deze aanbeveling wordt (deels) uitvoering gegeven. Het wetsvoorstel professionalisering regelt de wettelijke registratie van twee beroepsgroepen in het jeugdzorgdomein, te weten de HBO-jeugdzorgwerker en de WO gedragswetenschapper (psycholoog en orthopedagoog).
Dit wetsvoorstel ligt thans bij de Raad van State. Indiening bij uw Kamer is begin 2013 voorzien en inwerkingtreding per 1 januari 2014.
Werkgevers in de jeugdhulp worden verplicht te werken met geregistreerde professionals, tenzij zij kunnen aangeven waarom dit zonder kwaliteitsverlies niet noodzakelijk is. De Inspectie Jeugdzorg ziet hierop toe. De veldpartijen ontwikkelen in goede afstemming met de IJZ een kwaliteitskader en in het verlengde hiervan stelt de IJZ een toetsingskader op.
Overigens blijft de Wet In het kader van de Wet Beroepen Individuele Gezondheidszorg (BIG) ook in het nieuwe jeugdstelsel van toepassing. In het kader van de Wet BIG heeft de Inspectie voor de Gezondheidszorg toezicht op de kwaliteit van die beroepsuitoefening.


Antwoord:
In het wetsvoorstel Jeugdwet is opgenomen dat er landelijk toezicht volgt op de wettelijke kwaliteitseisen gesteld aan jeugdhulpaanbieders en professionals.

Vraag 100:
Welke instrumenten dient de IJZ in handen te krijgen om de sector te innoveren, te controleren en waar nodig te sanctioneren?

Antwoord:
Wij willen de Inspectie Jeugdzorg graag uitrusten met de juiste instrumenten. De IJZ heeft instrumenten in handen om te controleren en er is ruimte om de instrumenten die daar in de toekomst mogelijk verder nog voor nodig zijn op eigen initiatief te ontwikkelen. Dit laat onverlet dat de sector zelf kan innoveren. Dit zit in meer mogelijkheden voor wetenschappelijk onderzoek, professionalisering van beroepsbeoefenaren en bijvoorbeeld een carrièrebeleid. In het wetsvoorstel Jeugdwet worden de handhavingsinstrumenten van de IJZ, in navolging van de IGZ, uitgebreid met de bestuurlijke boete.

Vraag 102:
Hoe en wanneer gaat de staatssecretaris de rol van de inspectie versterken, zodat zij niet alleen een papieren toezicht uitvoeren, maar pro-actief het veld in gaan en bestaande mogelijkheden (zoals het schorsen van professionals en bestuurders) meer benutten?
Antwoord:
In mijn brief van 21 december 2012 (p. 9) wordt ingegaan op pro-actief toezicht door de IJZ. Zoals aan uw Kamer is toegezegd tijdens het wetgevingsoverleg jeugd van 3 december jl. kunt u in het voorjaar van 2013 een brief tegemoet zien waarin wordt beschreven (conform het wetvoorstel Jeugdwet) welke Rijksinspecties betrokken zijn, welke bevoegdheden zij hebben, en hoe het toezicht gaat functioneren. In deze brief wordt ook ingegaan op de aanbeveling van de commissie Samson met betrekking tot de handhavingstaak van de Inspectie Jeugdzorg in het nieuwe stelsel. Zoals toegezegd in de brief van 8 oktober 20128 wordt deze aanbeveling overgenomen.


Het aantal in pornografie gespecialiseerde zedenrechercheurs is sinds 1 oktober 2012 uitgebreid met 75 fte naar 150 fte.


Vraag 113:
Wat is de reactie van de staatssecretaris op de constatering van de Commissie dat het ministerie van VWS teveel aan het veld overlaat vanuit de filosofie “sturen op afstand”? Wat gaat de staatssecretaris eraan doen om dit te verbeteren?
Antwoord:
Het ministerie van VWS stuurt de jeugdzorg aan met de Wet op de jeugdzorg. Deze wet bevat kwaliteitsvoorschriften voor de jeugdzorginstellingen. De uitvoering van de jeugdzorg is op dit moment de verantwoordelijkheid van de provincies, zij moeten er voor zorgen dat de door hen gefinancierde jeugdzorg van behoorlijke kwaliteit is. Daarnaast is houdt de Inspectie Jeugdzorg toezicht op de kwaliteit van de jeugdzorg en op de naleving van de wettelijke eisen. Het toezicht richt zich met name op de veiligheid van het kind. Met het wetsvoorstel professionalisering, dat een registratieplicht voor professionals bevat en tuchtrecht, gaat de sturing van het ministerie van VWS zich ook op de professionals richten. Dit wetsvoorstel wordt begin 2013 bij de Tweede Kamer ingediend.

Vraag 121:
Is de staatssecretaris bereid een tweejaarlijkse prevalentiemonitor “seksueel misbruik in residentiële jeugdzorg en pleegzorg” te bewerkstelligen? Zo nee, waarom niet?
Antwoord:
De door de commissie voorgestane prevalentiemonitor naar seksueel misbruik in de residentiële jeugdzorg en de pleegzorg wil ik verbinden aan het vijfjaarlijkse prevalentieonderzoek naar kindermishandeling, dat voor 2015 voorzien is. Deze koppeling maakt een vergelijking tussen de jeugdzorg en andere sectoren mogelijk.

Vraag 129:
Vindt de staatssecretaris het wenselijk dat Jeugdzorg Nederland het onderzoek met 5 maanden heeft vertraagd? Is het waar dat een aantal jeugdzorginstellingen die juist bekend staan om hun kwalitatieve zorg uiteindelijk niet mee hebben gedaan aan het onderzoek? Wat betekent dit?
Antwoord:
Zowel Jeugdzorg Nederland als individuele instellingen wordt verweten het onderzoek van de Commissie Samson te hebben geblokkeerd. Dit is incorrect. Een wetenschappelijk onderzoek naar aard en omvang van seksueel misbruik vindt de jeugdzorg belangrijk. De belangen van de kinderen zijn hiermee gediend. Echter, het is de opdracht van de jeugdzorg om een veilig behandelklimaat te scheppen. Jeugdzorg Nederland was van mening dat de behandeling van kinderen zou worden verstoord door het afnemen van de oorspronkelijke vragenlijst. Samen met de kinderombudsman heeft Jeugdzorg Nederland deze bezwaren bij de Commissie Samson aangekaart. Het onderzoek is vervolgens beoordeeld door traumadeskundigen. De vragenlijst is hierna aangepast en het onderzoeksprotocol is aangescherpt. Bovendien is de nazorg voor kinderen beter georganiseerd in samenwerking met psychotraumacentrum GGZ. Hierna heeft Jeugdzorg Nederland haar leden geadviseerd volop mee te werken aan het onderzoek.
Wij betreuren het dat niet alle instellingen hebben meegewerkt aan het aangepast onderzoek.

Vraag 130:
Kan er worden geconcludeerd dat de Commissie een afgewezen deelonderzoeksrapport enkel geaccepteerd heeft vanwege voortijdig uitlekken van de voorlopige bevindingen in de Volkskrant? Wat betekent een afgewezen deelonderzoeksrapport voor de kwaliteit van de conclusies van het prevalentieonderzoek? Waarom voldeed het onderzoek niet? Waarom is de universiteit niet gevraagd het onderzoek opnieuw uit te voeren, op een methodologische verantwoorde manier?

Antwoord:
De commissie Samson was een onafhankelijke commissie. Wij mengen ons niet in de besluiten die de commissie heeft genomen.
