The Mount Alverno Boys' Protectory:

"Work and worship" was a way of life to the Brothers of the Poor of St. Francis Seraph, and the philosophic basis of the environment which they provided for the poor and neglected boys who were placed in their care. 


The brothers arrived in Cincinnati in 1837 and for a number of years conducted a home for boys in the basin area at Bank Street. Like other religious orders,
they realized that one could feel closer to God if one was close to the good earth and separated from the disorder of the rapidly growing city.

Consequently, the Brothers decided to move to the Delhi highlands in 1869,
the same year that the Sisters of Charity arrived. The order purchased the
W.Q. Adams estate of 106 acres in Section 10.

The area had been known as Mount St. Peter, but the Brothers changed the
name to Mount Alverno in honor of their patron, Saint Francis of Assisi who
had received the gift of the stigmata while on Mount Alverno in Italy. The
name of the institution was the Protectory for Boys but it was commonly
known as Mount Alverno.

Brother Michael Dux was appointed superior of the Delhi convent, and the
brothers moved into the old Adams homestead. The farmlands and vineyards of
the estate were cultivated by the brothers, who with the help of several of
the older boys, did all of the manual labor themselves. Part of their
philosophy of training children to become productive, devout individuals was
to teach by example as well as by the word. By 1880 over two hundred boys
were living at the Protectory and many more had graduated.

With their own hands, too, the Brothers quarried limestone from the property
to provide building blocks for the construction of a school, chapel, and
additional living quarters. The impressive limestone structure was ail but
destroyed by fire in 1906; it took a year to rebuild. Another fire in 1923
destroyed the main barn.

The community of boys and brothers at Mount Alverno was practically
self-sufficient. Over eighty-five acres of land, including the hillsides
were under cultivation. The brothers practiced soil conservation by
terracing the hillside and kept up on the latest in "scientific" farming.
They raised corn, barley, and hay for their dairy cattle and steers.
Everything that was produced on the farm was used by the residents."

The school existed from 1871 to 1972 when the school and land were sold for
a housing development. The Proctectory was demolished that year.

Though the boys' home is no longer in Delhi, the Brothers of the Poor of St.
Francis are still in Cincinnati. I would check with them for records.

 Bishop of the Catholic Church of Iceland Pétur Burcher has established a council of specialists, which is to provide consultation on the right for damages for victims of sexual and other abuse within the church, following the release of a report confirming the abuse. 
 
The council is also to suggest changes to the church’s work methods when abuse is reported, as well as preventive methods and other improvements, ruv.is reports.

Supreme Court lawyer Eiríkur Elís Þorláksson is to chair the council, on which anthropologist April Frigge and lawyer Skúli Guðmundsson will also have a seat. It is to commence its work immediately and hand in suggestions no later than June 1, 2013.
 
The investigative committee of the Catholic Church in Iceland concluded that all of the church’s bishops from 1968 to this date, Hinrik Frehen, Alfred Jolsons, Joannes Gijsen and Pétur Burcher, failed the students of Landakotsskóli and neglected their duties.
 
All four bishops received complaints from parents and former students that Rev. Ágúst Georg, principal of Landakotsskóli, and one of its teachers, Margrét Müller, abused their subjects mentally and sexually, ruv.is reports.
 
According to the report, the abuse took place from 1956 to 2003. The antagonists abused the children separately or together, humiliated, beat and raped them and inflicted serious and continuous mental abuse, as described on ruv.is.
Representatives of the Catholic Church of Iceland have refrained from commenting to the media. Burcher, the current bishop, is abroad.

C’est plus que les plaintes reçues par la commission Adriaenssens !

Bruxelles  Le chiffre fait froid dans le dos. 583 dossiers ont été introduits devant le Centre d’arbitrage en matière d’abus sexuels. Soit autant de dossiers qui concernent des méfaits commis par des gens d’Église…

On se souvient du séisme qu’avaient provoqué en 2010 les révélations du professeur Adriaenssens. La Commission qu’il présidait – et qui avait été mise en place par l’Église catholique de Belgique elle-même – avait déjà réceptionné quelque 476 plaintes. Ce chiffre est aujourd’hui largement dépassé !

“On voit que le Centre d’arbitrage répond à une véritable demande des victimes” , a commenté hier Karine Lalieux (PS) au moment de nous dévoiler les derniers chiffres. La députée est la présidente de la commission parlementaire spéciale mise en place à la suite des révélations de Peter Adriaenssens. C’est le travail de cette commission qui avait permis d’instaurer, en bonne entente avec l’Église, le Centre d’arbitrage.
La procédure est exceptionnelle puisqu’elle permet à des victimes d’abus d’être reconnues dans leur souffrance (par le prêtre abuseur lui-même ou par l’Église en tant qu’autorité morale) alors que les faits sont prescrits par la Justice. Elle a aussi la possibilité de réclamer un dédommagement financier de maximum 25.000 euros.

“Est-ce que tous vont être dédommagés ? Je l’espère, mais je n’en sais rien. Il revient aux arbitres de le déterminer” , reprend Mme Lalieux. Quoi qu’il en soit, “les victimes se rendent compte que, sans le Centre, elles n’auraient jamais eu la reconnaissance de la part de l’Église de ce qu’elles ont subi. Le Parlement a fait un travail pragmatique, concret, qui répond aux demandes des victimes. Je m’en félicite.” 
 
Le délai d’introduction des dossiers est maintenant terminé. Il était fixé au 31 octobre – le cachet de La Poste faisant foi, ce qui veut dire que l’un ou l’autre recommandé pourrait encore arriver.

“Je pense qu’un délai de neuf mois, c’était bien. Il a déjà fallu six mois pour que le Centre voie le jour. Il me semble donc que les victimes ont eu le temps de la réflexion. D’autant plus qu’il s’agissait d’une procédure simplifiée, ne nécessitant pas d’avocat et entièrement gratuite. J’espère juste que les personnes qui n’ont pas introduit de requête ne le regretteront pas” , conclut Karine Lalieux.

Le travail ne fait que commencer. Les premiers arbitrages ont déjà eu lieu.

Il y a une dizaine de jours, sept dossiers avaient abouti à une conciliation entre la victime et l’Église. Un autre était en cours de procédure. Le plus dur reste à venir.

Kritiek op onderzoek sterfgevallen Sint Joseph


De namen van broeder Andreas en de Heelse dorpsdokter Guus Verstraelen moeten gezuiverd worden. Dat vindt een werkgroep die op initiatief van schrijver Ton van Reen is opgericht. De werkgroep houdt op 6 november een openbare hoorzitting in Heel over de in zijn ogen onterechte beschuldigingen aan het adres van de broeder en de dokter.

Justitie noemde Andreas en Verstraelen afgelopen zomer als verdachten na een uitgebreid feitenonderzoek naar de dood van 37 minderjarige jongens die begin jaren vijftig op het terrein van zwakzinnigeninstelling Sint Joseph in Heel woonden. Omdat de zaak is verjaard en beiden zijn overleden, kan justitie ze niet formeel als verdachte aanmerken.

De werkgroep van Van Reen vindt dat justitie zich te veel op geruchten en vage uitspraken baseert. Ook kunnen de twee verdachten zich niet verdedigen. Volgens de werkgroep heeft Andreas er juist alles aan gedaan het lijden van de jongens te verzachten, zonder ze aan hun einde te helpen. Van Reen heeft Andreas persoonlijk gekend. Tijdens de openbare hoorzitting in Heelse zaal Don Bosco wil de werkgroep 'aantonen dat de argumentatie van het OM ondeugdelijk is'.

Naast Van Reen zijn ook advocaat Frank Dronkers, secretaris Patrick Chatelion Counet van de Konferentie Nederlandse Religieuzen, oud-huisarts Antoon Visschedijk, verpleegkundige Jac Peeters en oud-medewerkster Wies Janssen van de Raad voor de Jeugdbescherming bij de hoorzitting aanwezig. De bijeenkomst begint om 20.00 uur.
Het OM verwijst in een reactie op naar het in haar ogen volledige feitenonderzoek.

Se prevé un lanzamiento inicial de 5.000 botellas, aunque si la demanda es mayor la bodega tiene una reserva de 20.000 botellas. Según revela la gerente y enóloga de la bodega, Susana Ruberte, “se trata de un vino de intenso color cereza con reflejos granate, con aroma a fruta fresca con toques minerales y que en boca resulta sabroso, un poco ácido y con gusto a fruta madura”.
Ruberte ha explicado que se trata de un producto realizado de acuerdo a procedimientos tradicionales.

 Oud-bisschop Gijsen van Roermond wordt in IJsland beschuldigd van het verzwijgen van seksueel misbruik. Dat blijkt uit een rapport van een IJslandse commissie die onderzoek doet naar seksueel misbruik binnen de katholieke kerk.

Gijsen was van 1996 tot 2007 bisschop van de katholieke kerk in IJsland. In die tijd had een man in een brief geschreven dat hij was misbruikt door een IJslandse priester. Gijsen heeft die brief vernietigd.

De commissie-Hákonardóttir vindt dat Gijsen nalatig is geweest. Hij had een onafhankelijk onderzoek moeten instellen naar de beschuldiging.

In een reactie aan de commissie laat Gijsen weten dat hij de zaak had besproken met de auteur van de brief. De man had volgens Gijsen slechts het vermoeden dat de priester een seksuele relatie met hem wilde beginnen, maar zou dat niet zeker hebben geweten. Daarop hebben de twee besloten de brief te vernietigen, schrijft Gijsen.

In 2010 werd Gijsen in Nederland beschuldigd van het begluren van een jongen die zichzelf bevredigde, eind jaren '50. De commissie-Deetman sprak niet van misbruik, maar vond wel dat hij over de schreef is gegaan. Gijsen heeft altijd ontkend dat hij de jongen heeft begluurd.

Catholic Church Confirms Child Abuse in Iceland

The investigative commission of the Catholic Church in Iceland presented its report on Friday, confirming that Rev. Ágúst Georg, principal of the church-run elementary school Landakotsskóli, and one of its teachers, Margrét Müller, abused their pupils. 

 The commission questioned 30 of the school’s former pupils and people who had joined the Catholic Church’s summer camps as children. Eight of them stated they had been sexually abused and 27 that they had been subject to or witnessed mental abuse, ruv.is reports.
 
Hjördís Hákonardóttir, who chairs the commission, said the report is a serious blow to the reputation of the Catholic Church in Iceland.
 
It reveals that Joannes Gijsen, who served as Bishop of the Catholic Church in Iceland 1996-2007, destroyed a letter from a man who described how he was abused by Rev. Georg, ruv.is reports. 
 
In doing so, the commission considers Gijsen to have failed his obligations; he should have launched an independent investigation by specialists into the matter.
 
In a written statement to the commission, Gijsen explained that at the time he had talked the matter through with the man who sent the letter. 
 
Gijsen stated that the man had written that he believed Rev. Georg had sought a sexual relationship with him but that he wasn’t sure. They had therefore jointly decided to drop the case and destroy the letter.
 
In 2010, Gijsen was accused of sexual violations while teaching at a school of the Catholic Church in Holland in the 1950s and 1960s. He has denied all accusations.

LONDEN (RKnieuws.net) - Na een lange juridische strijd moet Catholic Care, het laatste van de twaalf katholieke adoptiebureaus in Engeland en Wales,sluiten. Decennialang zorgde de katholieke Kerk via deze sociale instellingen, en zonder noemenswaardige steun van de overheid, ervoor dat kinderen die voor adoptie werden afgestaan nieuwe ouders vonden. De overheid kon op die manier naar schatting 12 miljoen euro besparen. Klachten over de behandeling van de adopties waren er niet. In 2007 keurde Groot-Brittannië echter een antidiscriminatiewet goed die de adoptiediensten verplicht niet langer een onderscheid te maken tussen homoseksuele en heteroseksuele paren.

Catholic Care, met adoptiekantoren in de bisdommen Leeds, Middlesbrough en Hallam, tekende bezwaar aan tegen de verplichting. Volgens Catholic Care dwingt de wet haar medewerkers om tegen hun geweten in en in strijd met de leer van de katholieke Kerk te handelen. Het Britse Hooggerechtshof oordeelt nu dat de antidiscriminatiewet van 2007 geen uitzonderingen toestaat. Dat impliceert dat Catholic Care zijn status van welzijnsorganisatie verliest als het geen kinderen voor adoptie aan homoparen afstaat. Rechter Justice Sales oordeelde dat er geen objectieve reden bestaat om een uitzondering toe te staan.

Eerder besloten verschillende andere katholieke adoptiebureaus de deuren te sluiten. Volgens Britse kranten hebben enkele andere adoptiebureaus hun banden met de katholieke Kerk verbroken, om toch nog actief te blijven. Catholic Care kondigde dit weekend aan dat het gaat onderzoeken of er alsnog een juridische mogelijkheid bestaat om het adoptiewerk voort te zetten.

In scouts’ sex-abuse scandal, dark secrets for a model citizen


This article is based on the so-called “perversion files” that the Boy Scouts of America maintained for decades to identify scoutmasters and others accused of child molestation. The files were released to the public last month through a lawsuit filed by an Oregon man who said the scouts failed to protect him from sexual abuse. So far, files on 20 Georgia scout leaders have been released, and another 43 Georgia cases are expected to be made public soon.
The Atlanta Journal-Constitution attempted to interview former scoutmaster Ernest Boland of Athens, as well as his lawyer. Neither responded to requests for an interview. Several former scout officials involved in Boland’s case declined to comment.
The newspaper is not identifying former scouts who say they were molested. The newspaper’s policy is to generally not name suspected victims of sex crimes.

The investigation also documented a case that did not directly involve the scouts.
As scoutmaster, Boland apparently forged an unusual arrangement with law-enforcement officials: When boys in the community got into minor trouble with the law, he sometimes acted as an unofficial probation officer, counseling and supervising the boys to keep them out of juvenile court or jail.

Whether Boland brought any of these boys into scouting is not known.


One of the boys, now a 65-year-old man, was placed under Boland’s supervision after neighbors accused him of vandalism when he was 12 or 13, he recalled in an interview. He spoke on the condition that he not be identified publicly.

“For spite,” the man said, he grabbed laundry off the neighbors’ clothesline and hid it nearby. A few days later, he said, two police officers came to his house with a third man: Ernest Boland.

Working with Boland, the officers said, would keep the boy out of jail.

“It was my first time ever getting in trouble,” the man said. “It was like probation.”
Soon, he joined other boys doing chores for Boland: cutting the grass on lots he owned or preparing buildings to be repainted. Often, the man said, boys ended up alone with Boland. That, he said, is when Boland threatened them with jail time if they didn’t perform sex acts.
 
“He would use that against us,” the man said. “He had what we did over our heads.”

Boland molested him two or three times, the man said, before he told his parents. They were angry, he said, but adamant that he keep quiet. “You’d be ridiculed,” they told him.

He never saw Boland again. Until recently, he didn’t know Boland was still living.

Regardless, half a century later, he struggles with shame over the traumas of his adolescence.
“I wish I hadn’t got in trouble,” he said. “None of that would be in my background. You do spiteful things, you get what you deserve.
“I forgive him for what he did. God tells us to. But that don’t mean you’ve got to like the person. It’s kind of hard to forget.”

ROME (RKnieuws.net) - Maandag moet computerspecialist Claudio Sciarpelletti zich voor de rechtbank verantwoorden in het kader van de Vatileaks affaire. Hij wordt beschuldigd van mogelijke medeplichtigheid bij de diefstal van vertrouwelijke documenten uit de pauselijke vertrekken. Sciarpelletti kreeg gedaan dat zijn proces gescheiden wordt gevoerd van dat van Paolo Gabriele, de ex-majordomus (butler) van de paus, die onlangs tot 18 maanden celstraf werd veroordeeld.
Kerk & leven, één van de grootste weekbladen in Vlaanderen, pakt deze week uit met een gestoffeerd dossier over Vatileaks. Daaruit blijkt dat Vatileaks een schandaal is dat vooral toont hoe het erin het Vaticaan aan toe gaat en dat is niet altijd even fraai. ‘Ook in het Vaticaan waren schandalen nooit weg. Het Vaticaan is een oord van jaloezie en intriges en met Vatileaks krijgt de Kerk opnieuw een flinke deuk”, aldus Kerk & leven.

Niet zomaar wat roddels

“Vatileaks gaat niet over zomaar wat roddels. De lekken bevatten de waarheid, gestaafd met documenten. Alle Vaticanwatchers, journalisten gespecialiseerd in het Vaticaan en de wereldkerk zijn het er over eens dat vele vragen onbeantwoord blijven. Het verraad in eigen huis werpt een smet op het pas gestarte Jaar van het geloof”, stelt het weekblad.

“De gelekte documenten tonen aan hoe sterk het Vaticaan en de Italiaanse politiek verstrengeld zijn. De katholieke journalist Andrea Tornelli gelooft niet dat Gabriele de documenten heeft laten lekken op eigen houtje. Eigenlijk gaat Vatileaks slechts terzijde over de wereldkerk, des te meer over een hofhouding. Velen vergeten immers dat het pausdom de oudste monarchie ter wereld is. Sinds de vroege Middeleeuwen bestond in Rome een haast ononderbroken traditie van een hofhouding rond een vorst die ook nog eens bisschop en leider van de wereldkerk is. Het verdwijnen van de Pauselijke Staten in 1870 maakte blijkbaar geen einde aan die hofcultuur, wel integendeel. Sindsdien moet de Heilige Stoel op een andere manier zijn politieke macht bestendigen evenals de curie en de Vaticaanse stadsstaat zien te financieren. Vatileaks brengt overduidelijk aan het licht dat het hoogste bestuur van de Kerk lichtjaren verwijderd is van modern management, laat staan van democratische doorzichtigheid”, aldus Kerk & leven.

Corruptie niet van vandaag

"Corruptie in de Vaticaanse bureaucratie gaat terug tot de Middeleeuwen en zelfs eerder. Het lekken van vertrouwelijke Vaticaanse documenten is niet nieuw. Dat gebeurde al tijdens het eerste Vaticaans concilie met geheime documenten over de doctrine van de pauselijke onfeilbaarheid. In 1967 lekte een delicaat rapport uit over de goedkeuring van kunstmatige contraceptie, een jaar voor Paulus VI de bevindingen ervan verwierp en de encycliek Humana Vitae publiceerde., stelt het weekblad.

Professioneel werken in jeugdzorg wordt wettelijk vastgelegd

De ministerraad heeft op voorstel van staatssecretaris Veldhuijzen van Zanten van Volksgezondheid, Welzijn en Sport en staatssecretaris Teeven van Veiligheid en Justitie ingestemd met het wetsvoorstel professionalisering jeugdzorg.
Het wetsvoorstel verplicht jeugdzorgwerkers en gedragswetenschappers om zich te registreren bij een wettelijk register. Ook verbinden zij zich aan een beroepscode. Als sluitstuk van de professionalisering van de jeugdzorg komt er tuchtrechtspraak in de jeugdzorg. Met deze wettelijke instrumenten worden jeugdzorgwerkers beter toegerust en wordt de kwaliteit van de beroepsuitoefening in de gehele jeugdzorg op een hoger, professioneler plan getild.

Permanente educatie

Jeugdzorgprofessionals maken met registratie in een beroepsregister hun vakbekwaamheid aantoonbaar. Om geregistreerd te blijven, moeten zij verplicht deelnemen aan bij- en nascholing. Zo ontstaat er voor de werkers in de jeugdzorg een systeem van permanente educatie.

Tuchtrecht

Het sluitstuk is het tuchtrecht. Hiermee wordt het mogelijk dat beroepsmatig handelen van jeugdzorgprofessionals door vertegenwoordigers van de eigen beroepsgroep wordt getoetst. Beroepsbeoefenaren kunnen daarmee leren van complexe zaken en verbeteringen doorvoeren. Tuchtrecht betekent voor jeugdzorgcliënten dat zij worden beschermd tegen ernstig falende professionals. Die kunnen in het uiterste geval door het tuchtrechtcollege uit het register worden geschrapt.

Registratie loopt

Het wetsvoorstel schrijft voor dat jeugdzorgwerkers en gedragswetenschappers in de jeugdzorg uiterlijk 1 januari 2014 allemaal geregistreerd moeten zijn. Instellingen zijn vanaf dat moment verplicht om met geregistreerde professionals te werken. De registratie van jeugdzorgwerkers is al gestart, vooruitlopend op de nieuwe wet. Met de campagne 'Laat zien wat je waard bent' worden zij daar sinds september 2012 actief toe opgeroepen. De ministerraad heeft ermee ingestemd het wetsvoorstel voor advies aan de Raad van State te zenden. De tekst van het wetsvoorstel en van het advies van de Raad van State worden openbaar bij indiening bij de Tweede Kamer.

ENSCHEDE (RKnieuws.net) - Een Enschedese weduwe eist een schadevergoeding van 100.000 euro van de Rooms Katholieke kerk. De vrouw houdt de kerk verantwoordelijk voor de zelfmoord van haar man, ruim twintig jaar geleden.

Volgens de weduwe is haar man het jarenlange misbruik in z’n jeugd door paters van een missietehuis in Brabant nooit te boven gekomen. Hij was jarenlang depressief en pleegde op 58-jarige leeftijd zelfmoord. De Enschedese is op zoek naar mannen die in hun jeugd in hetzelfde tehuis hebben gezeten met mogelijk dezelfde ervaringen.

Met het relaas van de weduwe komt een nieuwe categorie slachtoffers van seksueel misbruik in de katholieke kerk aan het licht. Paters vergrepen zich in de jaren ’30 aan haar overleden man. Het misbruik van gevallen die nu bekend zijn, dateert van de jaren ’50 en ’60. Uit Overijssel komen nog steeds nieuwe meldingen binnen.

KINSHASA (RKnieuws.net) - De ontvoerders van de drie Congolese assumptionisten Anselme Wasukundi, Jean-Pierre Ndulani en Edmond Kisughu vragen losgeld voor hun vrijlating. De omvang van het bedrag is niet bekendgemaakt, maar volgens de Congolese krant ‘Le Potentiel’ wordt een bedrag van 50.000 dollar (38.574 euro) gevraagd.

De drie paters werden op vrijdag 19 oktober ontvoerd uit hun klooster in Mbau (Noord-Kivu). Sinsdien is er geen nieuws van hen.

There is a six-step process for getting conflict gold from mines in eastern Congo into its final form: jewelry or gold bars for investors. At the mines, the gold is mainly dug up by hand with pick-axes and shovels in dangerous shafts as far as 100 yards into the earth. Fewer than 5 percent of miners are registered with the authorities, and an estimated 40 percent are children.*3
Armed groups and/or army commanders control a majority of mines, forcing miners to work, taking cuts from the miners, and/or taxing traders along supply routes. An estimated 5 tons to 7 tons of gold are produced in the Kivu region of eastern Congo annually—worth between $285 million and $400 million, a large percentage of which ends up in the hands of armed groups that target civilians with rape, murder, and other abuses. *4

From the 15 major mines in the Kivu region, the gold is mainly sold to smugglers, who illegally transport 99 percent of it out of the country. The smugglers carry the gold by hand in briefcases to neighboring Uganda, Burundi, and Tanzania and then take it to Dubai. In Dubai the gold is bought by cash-for-gold dealers, and then it reaches a fork in the road: It is either processed at a refinery (smeltered) to be sold in to Europe, or it is made into jewelry for sale in the Middle East, China, and India. Refiners sell the smeltered gold primarily to banks in Switzerland to be held in vaults for investors or jewelers. Worldwide, jewelers and investors together account for 80 percent of gold consumption; roughly 10 percent of gold is used in electronics, and central-bank purchases, dentistry, and industrial uses make up the other 10 percent.*5

This supply chain is not always linear, as gold can be melted down several times, and firms generally source from several suppliers. But these six steps represent the main path for Congo’s conflict gold, a trade that is tightly controlled close to its source by a few powerful individuals. The supply chain has some key choke points, however, that can be exploited for a possible solution to the conflict—namely, the large mines, the Dubai refiners, and the handful of large smugglers in Congo and neighboring countries.

In contrast to the progress on reducing militias’ profits from the 3-T minerals, few inroads have been made in stemming the conflict-gold trade. The Dodd-Frank legislation and electronics-industry audits led to a 65 percent drop in armed groups’ profits from the 3-Ts and have spurred reforms by governments and companies.*6
The conflict-gold trade, however, has increased over the same period rather than decreased: Fighting in and around gold mines continues; mines are at full production; the Rwandan Hutu Democratic Forces has begun trading gold again; and the M23 rebels are attempting to take over gold-trading areas in North Kivu and Ituri. As a civil society leader in eastern Congo told the Enough Project, “For now, there is no pressure on gold dealers at all …
No one cares where the gold comes from.” *7

Building on the 3-T legislation, some companies are starting to pay attention. Some mining companies are undertaking audits, with banks auditing refiners beginning in 2013, and jewelers are putting conflict-gold policies in place. But conflict gold is still flowing from Congo unabated. The following report is an outline of the supply chain.


Eastern Congo’s gold mines are among the most abusive and dangerous places to work in the world. Gold miners have no health or safety standards because the mines and the trade are unregulated by Congo’s government. Because they are physically small enough to climb into tiny mine shafts, children make up an estimated 40 percent of the miners and can be as young as 8 years old.*8 They are joined by crews of former militia fighters and young men, digging shafts up to 100 yards deep.*9
Collapses in the shafts kill hundreds of workers every year. An accident in August, for example, left 60 miners dead.*10   Mercury is also used at and around the mines without gloves or safety protection, and miners are often poisoned by inhaling mercury vapors.

The surrounding populations also can suffer mercury poisoning by consuming fish from the contaminated streams and rivers close to the mines.11 Malnutrition, physical injury, and lack of clean water and medical services compound the health and safety concerns of miners.*12
Nearly all of the gold in the Kivu region of eastern Congo is mined artisanally—by hand, pick-axe, and shovel—and fewer than 5 percent of the miners are registered with the authorities.*13 There is one exception to this: The Canadian/South African company Banro is producing gold at one industrial mine, and both it and a South African consortium are separately planning production at two other mines next year. These mines appear to be conflict-free, but both companies have had issues working with local communities. Banro is currently benefitting from a 10-year tax break from the Congolese government. Whether industrial mining helps or harms eastern Congo will depend on how companies interact with communities and help artisanal miners,  meet key standards, exclude warlords, and operate transparently.

 There are also hundreds of child soldiers involved in the gold trade. When the Enough Project asked a room full of former child soldiers at a local rehabilitation center who among them had been involved in the gold trade, the vast majority of the children ages 11 to 16 raised their hands.
The chief reason for the abhorrent conditions is the control of the trade by armed groups and their criminal networks, including the former National Congress for the Defense of the People—which is now part of M23—as well as the Rwandan Hutu Democratic Forces, Mai Mai armed militias, and Congolese official army commanders.

 There has been limited improvement in some gold mines—one demilitarized mine was identified in 2011—but according to the U.N. Group of Experts, “Gold is among the main sources of financing most readily available to armed groups.”*17
U.N. investigators confirmed this trend in a September 2012 report.*18

Armed groups control a majority of the trade through four main means: taxation, protection, commercial control, or coercive control.(19  Taxation is done by collecting fees from miners at mines or roadblocks. Protection involves extorting money from mine managers with the threat of violence to them or their operations. Armed groups exercise commercial control by buying and selling close to the mines and owning gold-processing machines. Coercive control is carried out by pillaging mines or forcing miners to work exclusively for the armed group for a certain number of days each week. General Ntaganda, who has since mutinied from the army to start a rebellion, ran an extensive gold-smuggling network in 2011 worth tens of millions of dollars from mines in Walikale, Numbi, and Rubaya. This included the attempted sale of a $27 million lot of gold to three Houston-based businessmen, allegedly brokered by former basketball star Dikembe Mutombo.*20

Armed groups—often battlefield enemies—continue to trade gold for weapons, including the Rwandan Hutu Democratic Forces trading with the Congolese army, Mai Mai militias trading with the army, and M23 trading with the Rwandan Hutu Democratic Forces.*21

The United Nations has stated that, “According to local leaders in one remote area, the first thing newly arrived [Congolese army] officers often ask them is

The Rwandan Hutu Democratic Forces and allied Mai Mai militias until mid-2011 controlled a large number of mines and trading routes in Lubero, Fizi, Shabunda, Mwenga, and Walikale,*23 but was displaced from its bases in late 2011 by Congolese/U.N. military operations. It has since moved back into some gold-mining areas.

Congolese army officers continue to profit by controlling mines in North and South Kivu and extorting bribes from exporters in the gold trading cities of Butembo, Beni, and Bukavu. For example, General Gabriel Amisi’s troops forcibly took over the important Omate gold mine in 2010 to install a company from which he was to take 25 percent of the profits, beat up local civilians who protested the move, and moved to control several minerals pits in Walikale.*24  
Army officers are also involved in a trade in counterfeit gold worth millions of dollars, whereby real gold is used to lure buyers, who are then given up to 400 kilograms of fake gold.*25 Gold is also reportedly financing Burundian rebels, who are potentially looking to destabilize that country.  *26


Local smugglers
  A handful of local smugglers in eastern Congo who work with armed groups and regional smugglers control the trade by pre-purchasing gold directly from the mines. Known locally as comptoirs, local smugglers send their traders to the mines with large amounts of cash, and the traders then transport the gold back to three main towns: Bukavu, South Kivu or Butembo, and Beni, North Kivu. The local smugglers exporters have working relationships with one or more armed groups for protection of mines and transport routes. As Jacques, a former rebel told Enough, “[As a rebel], you have to work with certain sellers who help you sell the gold. You can’t sell it yourself because the bigger traders would think that you’d kill them.” *27 A gold exporter then told Enough, “I can no longer visit the villages. They will kill me.”*28 As a civil society leader later explained, “That is because he [the trader] has been trading gold with the [Rwandan Hutu Democratic Forces] for years. The communities hate him for that; he brought them war.”*29 Because of these close relationships, exporters are generally aware of the sources of their gold and can identify the mines of origin due to differences in quality and purity from the different mines. The local smugglers then aggregate the gold from different mines through rudimentary refining.

The largest exporter in South Kivu is Etablissement Namukaya, locally known as CongoCom. Namukaya has been documented by the United Nations to have bought gold from the M23-linked Mai Mai Sheka rebel group—which allegedly orchestrated the rape of 387 people in 201030—the Rwandan Hutu Democratic Forces, and other Mai Mai groups.*31 Its director, Evariste Shamamba, also owns an airline that transports
 gold from mines to Bukavu. *32 A Namukaya representative admitted that its due diligence consisted solely of buying “from areas where it is safe to land a plane.”*33

The trade in North Kivu was controlled by Ugandan-linked Kambale Kisoni until his murder in 2007, but trader Kasereka Maghulu appears to be taking over Kisoni’s former position in Butembo *34 Maghulu also operates an airline that regularly flies to remote areas in Congo*35   The Butembo-Beni trade has links to Mai Mai Lafontaine, the Rwandan Hutu Democratic Forces, the Congolese army, the Allied Democratic Forces—a Ugandan rebel force—and other local armed groups *.36

A smaller amount of gold is bought by individual traders, negociants, who sell it to other traders to smuggle out of the country. This petty trade is highly risky, as the individuals undercut the powerful smugglers and face high security risks transporting the gold along the road. The Enough Project witnessed several such small enterprises that traded out of the back of grocery or hardware stores through secret doors. On the way out of Congo, the traders pay bribes to different armed groups to pass security checkpoints. As Willy, a minerals transporter, told Enough, “If you drive from Walikale [a major minerals center] to Goma, you have to pass three different checkpoints. You have to pay the [Rwandan Hutu Democratic Forces], you have to pay the [former National Congress for the Defense of the People], and you have to pay the army. You have to pay all, or they will kill you.”*37  

The volume of this trade is smaller than that carried out by the armed groups, with transactions up to $5,000. Larger deals appear to go through the main exporters in Bukavu and Beni/Butembo—the gold traders in the Essence area of Bukavu that Enough spoke to, for example, sell the vast majority of their gold to Namukaya.38

Only a tiny fraction of Congo’s gold production is exported legally. For example, only 23 kilograms of gold was officially exported from the Kivu regions in the first six months of 2012, despite an estimated 2 tons to 4 tons going out unofficially. *39 
This stands in contrast to the 3-T minerals, which are larger and more difficult to smuggle. Roughly $30,000 worth of gold can fit in one’s pocket, and $700,000 worth can fit in a briefcase, whereas it would take 13 large trucks carrying 233 tons of tin ore total to equal that value.*40
Discrepancies in regional export taxes have also helped increase smuggling in the past, as Congo’s export tax was triple that of Uganda and Burundi. Congo lowered the gold export tax in late 2011, however, from 3.25 percent to 1 percent, bringing it nearly in line with that of Uganda. *41

From eastern Congo’s major towns, gold is mainly transferred to a small network of smuggling firms in neighboring Uganda, Burundi, and Tanzania. These firms are able to control the market because they can pay a higher price for the gold by avoiding taxes.*42 These companies both pre-purchase gold from the large Congolese producers and buy from individual smugglers who bring gold across the border from Congo. As a western industry analyst who witnessed transactions first hand told Enough, “The buyers [in Uganda] ask the sellers where the gold comes from. Even though all the traders are Congolese, they all say ‘South Sudan,’ but it’s obvious that that is not true. They write ‘South Sudan’ on the import form, and the transaction is finished, no questions asked. Then the mining ministry sees that ‘South Sudan’ has been written and stamps its approval.” *43
