Ik ben gelukkig geen bisschop, overste of broeder-onderwijzer, anders had ik dit nooit durven schrijven. Ik heb niet de bedoeling het leed van slachtoffers te bagatelliseren, al zullen velen dat wel roepen. Ik probeer fair te zijn voor alle partijen, maar ten behoeve van het herstel van de balans voor een eerlijke beoordeling van de situatie vooral aandacht te vragen voor de partij die nu onrecht wordt aangedaan en monddood wordt gemaakt: de meer dan 50.000 geestelijken die zich in het verleden met grote toewijding hebben ingezet voor de opvoeding en het onderwijs van mijzelf en van tallozen van mijn leeftijdsgenoten."

Toch wel mooi zo'n oud-hoogleraar.
En de man kan schrijven ook.
Nou is dat natuurlijk iets wat je aan een hoogleraar, oud of niet, wel kunt toevertrouwen, je wordt nu eenmaal geen hoogleraar wanneer je uitgerekend in dat schrijven van stukkies niet goed bent, dus dat zit wel snor bij heer Sjaak.
Maar wat zou in vredesnaam het wetenschappelijke van dit stukkie dan zijn?
't Is niet anders dan een -helemaal niet ten onrechte - aanhankelijkheidsverklaring, die dom is.
En dan mag je er 30 keer onderzetten dat je een oud-hoogleraar bent, maar dat verandert er dus helemaal niks aan.

Aan mijn dankzij dit soort in landelijk pers hartekreten verkochte kennelijk als waardevol aan te merken observaties van een wetenschapper met ruime rk ervaringskennis bedenkelijk groeiende sik ook niet.

Maar wat is dat voor dom gezwets: "de partij die nu onrecht wordt aangedaan en monddood wordt gemaakt". Da's mooi gesnotter tbv de verkoop van tissues maar verdorie nog beroerder dan de reclame voor inlegkruiskruisjes met vleugeltjes, heer Sjaak, en buitengewoon katholiek van het verkeerde soort.

Maar als Uwes dan toch - hopelijk om bona fide redenen - ex-hooogleraar bent waarom maakt Uwes dan niet even duidelijk door wie en of wat die 50.000 dan wel monddood worden gemaakt?
't Zal toch niet zijn omdat ze zelf de lulkoek van dit soort argumenten door hebben?

Uw hartekreet, heer Sjaak, is een belediging!
En een grove ook.
En laat dat nu toch precies zijn zoals die in het verleden eindeloos gebruikt werd.
Oftewel: me neus!
Maar dan zonder gesnotter en tissues, ik haal hem wel op.

Dag Sjaak, hopelijk was je een dijk van een hoogleraar en heb je daar erg veel lol aan gehad.En als je nou nog 's een keer niks te doen heb, gedenk dan aub mijn sik, en kijk 's naar (ook de rest van) de onzin die je hartekreet je liet schrijven en laat je handjes wapperen tbv noodzakelijke oplossingen.

Ron van der Vring: "Wat ik het meest ga missen is de onderlinge loyaliteit"

Toen justitie in 2009 het dossier van de politie kreeg bleek de zaak van een van de slachtoffers net een maand verjaard. Het tweede geval was niet te bewijzen. Een woordvoerder van het OM in Utrecht verklaarde vandaag dat Justitie die gang van zaken achteraf betreurt.

HARD INGRIJPEN

Voor aartsbisschop Eijk was het seksueel misbruik echter alsnog reden om hard in te grijpen.
Priester Ron van der V. mag sinds mei 2010 geen mis meer opdragen, geen sacramenten uitdelen en geen pastorale zorg verlenen.

ALMELO - Van der V. uit Best ontkent het misbruik van het 13-jarige jongetje, maar ook het bezit van fotos met kinderporno.
Hij verklaarde gisteren bij de rechtbank in Almelo, dat hij vroeger wel kinderporno had gedownload. "Maar dat was tot het strafbaar werd. Daarna heb ik alles verwijderd. Ik kan mezelf in de spiegel zien. Dat is voor mij een belangrijk criterium."

Formeel is Van der V. nog pastoor, maar hij mag sinds kort zijn pastorale taken niet meer uitvoeren. In de jaren negentig is hij veroordeeld wegens ontucht. Er zijn nog wel meer beschuldigingen geweest, maar die zaken werden geseponeerd.

Het Oldenzaalse jongetje zou hij vorig jaar hebben misbruikt op een camping in Frankrijk. Hij zou het kind in een ruimte van een sauna oraal hebben bevredigd, en toen ook zichzelf. Volgens Van der V. was het de jongen die hem uitlokte, door hem te vragen te helpen bij het masturberen.

Advocaat Peter Garrels vroeg de rechtbank om opheffing van de hechtenis. Van der V. zit al sinds oktober vast. De advocaat meent onder andere, dat als er een veroordeling komt, die straf korter zal zijn dan de tijd die Van der V. nu al vast zit. Justitie verzette zich tegen vrijlating omdat er nog veel onderzoek nodig is. De rechtbank wees het verzoek af. "Er blijft een ernstige verdenking bestaan."

Priester Ron van der V. ontkent dat hij ontucht heeft gehad met jonge jongens in onder meer Amersfoort. Hij noemt zijn daden een uiting van affectie. Dat zei hij vanmiddag tegen een verslaggever van RTV Utrecht.

"Ik vind het vreselijk als mensen zich daardoor beschadigd hebben gevoeld. Ik heb nooit de bedoeling gehad hen kwaad te doen," aldus een aangeslagen Van der V. die eraan toevoegt dat hij "aan het eind van zijn Latijn" is.

Van der V. zegt dat de zaak is opgeblazen en uit zijn verband gerukt. "Ik heb nooit iemand misbruikt. Ik heb lang geleden al te enthousiast een aantal jongens op een niet juiste manier benaderd. En ik respecteerde het als ze daar duidelijk nee tegen zeiden. Dat is fout en ik ga het niet goedpraten."

VEROORDEELD

Eerder vandaag meldden de Wereldomroep, de NRC en Nieuwsuur dat kardinaal Simonis Van der V. een baan in Amersfoort gaf en daarbij verzweeg dat de priester was veroordeeld voor seksueel misbruik van jonge jongens.

De NRC schrijft dat de 59-jarige priester vorig jaar een beroepsverbod heeft gekregen van aartsbisschop Wim Eijk. Volgens de krant is Ron van der V. een veelplegende pedoseksueel, die in de jaren tachtig begon met het misbruiken van minderjarige jongens. Hij kreeg daarbij bescherming van de hoogste gezagdragers van de Rooms-Katholieke kerk in Nederland.

SEKSUELE SPELLETJES

De krant laat ook de moeder van een van de slachtoffers aan het woord. In Zoetermeer zou Ron van der V., toen nog kapelaan, haar zoontje tussen zijn achtste en twaalfde seksuele spelletjes hebben laten doen. Ze deed aangifte bij de politie en Van der V. bekende, maar het Openbaar Ministerie seponeerde de zaak vanwege de slechte gezondheid van de kapelaan. Hij kreeg een proeftijd en een contactverbod.

Een ander slachtoffer, inmiddels 41, vertelt in de NRC hoe hij tijdens een uitstapje naar de sauna werd aangerand. Later vergreep Van der V. zich ook aan drie jongens van veertien jaar oud. Daarvoor werd hij wel veroordeeld. De priester kreeg drie maanden voorwaardelijke celstraf.

OVERPLAATSEN

Bisschop Bar stuurde Van der V. daarop naar therapie en liet hem in een jezuietenklooster in Zeist verblijven. Toen Van der V. na een jaar weer aan het werk wilde liet het bisdom Rotterdam hem overplaatsen naar het naburige aartsbisdom Utrecht. Kardinaal Simonis kende de twintig jaar jongere V. al uit diens studententijd.

Simonis bevorderde Van der V. tot pastoor en stelde hem aan in de Sint Henricusparochie in Amersfoort. Hij hield het verleden van de nieuwe geestelijke stil. De NRC schrijft dat Simonis tegen mensen die kwamen klagen glashard ontkende dat de pastoor een pedoseksueel was.

LEGER-AALMOEZENIER

Nadat in Amersfoort opnieuw misbruikklachten kwamen vertrok de priester om leger-aalmoezenier te worden. Als hij niet op uitzending was, dan hielp hij sinds 2005 in het bisdom Den Bosch. In Eindhoven begeleidde hij een kinderkoor. Hij assisteerde ook in Soesterberg en Middelbeers.

In 2007 startte een nieuw politieonderzoek naar Van der V. Twee jongens in Amersfoort die als kind door hem waren misbruikt hadden aangifte gedaan. Toen justitie in 2009 het dossier van de politie kreeg bleek de zaak van een van de slachtoffers net een maand verjaard. Het tweede geval was niet te bewijzen. Groot bedrag verduisterd bij Achterhoekse parochie

LICHTENVOORDE - In de parochie Sint Ludger is beroering ontstaan door de vermissing van een 'aanzienlijk geldbedrag’. Een voormalig bestuurslid van de locatieraad van de katholieke geloofsgemeenschap Heilige Bonifatius-Ludger in Lichtenvoorde is in verband met het onderzoek geschorst.

Vice-voorzitter Jos Rosendaal van de parochie wil niet zeggen om hoeveel vermist geld het gaat. Hij houdt het op een ’aanzienlijk bedrag’.

Het bedrag van een half miljoen dat in kerkkringen circuleert, bevestigt noch ontkent Rosendaal. In december is aangifte gedaan van de vermissing van het geld.

De politie bevestigt de aangifte van verduistering. Het politieonderzoek loopt nog.

De parochie Sint Ludger omvat, behalve de geloofsgemeenschap Lichtenvoorde, ook die van Vragender, Harreveld, Zieuwent, Mariënvelde, Meddo, Winterswijk, Aalten en Bredevoort.

De nieuwe parochie wordt aangestuurd vanuit Lichtenvoorde.

Eind juni merkte het bestuur dat er ongebruikelijke transacties waren.

Uit intern onderzoek blijkt dat er jarenlang geld is gestolen uit de middelen die de kerkgangers bijeen hebben gebracht. De penningmeester van het parochiebestuur is uit haar functie ontheven. De parochie weet niet waar het geld naartoe is gegaan.

PUTTEN - Bestuurslid Astrid van Schaik van de regionale St. Lucasparochie (onder meer Putten, Barneveld, Nijkerk, Achterveld) noemt het de onjuist dat zij zou zijn afgetreden omdat zij het niet eens zou zijn geweest rond het onmiddellijk op non-actief stellen van pastoor Bert Sturkenboom door het aartsbisdom Utrecht. ,,Dat is de omgekeerde waarheid. Ik ben juist afgetreden omdat het aartsbisdom Utrecht vorige week dinsdag geen openheid van zaken wilde geven omtrent het misbruik.''

Volgens Van Schaik wilde mgr. Hans Zuijdwijk van het aartsbisdom aanvankelijk niet melden dat het om seksueel misbruik zou gaan. ,,Dat was voor mij reden om af te treden. Het was namelijk voor mij een absolute voorwaarde dat hier melding van gemaakt zou worden. Maar het aartsbisdom wilde geen openheid van zaken geven. Dat hebben zij de dag daarop wel gedaan, maar toen was ik al opgestapt. De enige die alles weet over aard en inhoud van de aanklachten is het bisdom, zij zijn partij en verantwoordelijk voor de gang van zaken in deze. Zij zijn niet transparant en open en ik kan niet werkzaam zijn voor een instituut wat daardoor zo tegen mijn principes ingaat, dat is de reden voor mijn aftreden.''

Van Schaik wil ook tegenspreken dat zij niet direct de klachten rond pastoor Albert Rubrech heeft toegegeven. ,,Vanaf het begin heb ik de klachten van het misbruik erkend. Er was immers al een getuigenverhoor geweest. Hangende de civiele procedure heb ik geen uitspraken willen doen over deze zaak. Dat heb ik op 14 december desgevraagd ook aan de Puttenaer verteld.

Toen heb ik gezegd dat we zorgvuldig willen omgaan met deze zaak zolang deze nog onder de rechter is en er nog geen onomstotelijke bewijzen zijn. Het gaat nog om aanklachten, in dit geval om zijn stiefzoon. We onthouden ons in die zin van commentaar. Van de brieven weten wij niets af. Die liggen bij het bisdom. De inhoud is daar bekend, zo ook van de klachten. In dit interview met Puttenaer van 14 december heb ik aangegeven dat ik van mening ben dat de rooms-katholieke kerk en de Sint Lucasparochie elke vorm van seksueel misbruik afwijst.

De katholieke kerk in Nederland is geschokt door alle misbruikzaken die aan het licht zijn gekomen en de rooms-katholieke kerk in Nederland moet hiervan ook afstand nemen. Ook Sint Lucasparochie heeft hier afstand van genomen. Inhoudelijk heb ik geen uitspraak willen doen over het vermeende seksueel misbruik. Dat moet de rechter doen.
Wat nu in de pers is verschenen is de omgekeerde waarheid.''

Before I say anything else here today, as Bishop of Antigonish, I want to formally apologize to every victim and to their families for the sexual abuse that was inflicted upon those who were entitled instead to the trust and protection of priests of the Church.

I want them to know how terribly sorry we are; how wrong this abuse was, and how we are now attempting to right those wrongs. Money can never compensate fully, but we are trying throughout this process to be fair, responsible, respectful, and most of all, compassionate. Above all, we want to do the right thing.

Bishop Zavala, a native of Mexico, was raised in Los Angeles, California. Following secondary school, Bishop attended and completed the course of studies both at St. John’s Seminary College and Theologate. He was ordained for the Archdiocese of Los Angeles in 1977. In 1985, Bishop Zavala finished his studies for a Licentiate in Canon Law from the Catholic University of America. In 1994 he was named and consecrated Auxiliary Bishop for Los Angeles, currently serving as the Regional Bishop in the San Gabriel Pastoral Region.

Bishop Zavala has served the Archdiocese in a variety of capacities. He has been a parish priest, Associate director in the Metropolitan Tribunal, faculty member at St. John’s Seminary; Professor of Canon Law at the Seminary and served as the Dean of Students, and Vice Rector before being named Rector of St. John’s Seminary in Camarillo, California.

Bishop Zavala is quite active in the national Church, our local Church and in the City of Los Angeles. He is on the boards of The House of Ruth, Death Penalty Focus and Don Bosco Technical High School. Bishop Zavala is to be found at rallies and is involved in a number of social justice initiatives that support the rights of immigrants, workers and the incarcerated, their victims and family members. In 2004 he received the Death Penalty Focus Abolition Award for his commitment to end capital punishment. He serves on the Archdiocesan Advisory Board for Restorative Justice and San Gabriel Mission High School. He also is an Adjunct Professor of Canon Law at Loyola Marymount University. He is also on the Board for Interfaith Worker Justice. In 2003 he was named Bishop President of Pax Christi USA.

As the Episcopal liaison to Restorative Justice Committee for the California Catholic Conference, he has played an active role in promoting the involvement of the Church in providing pastoral care for prisoners, support for their families and assistance to victims.

Bishop Zavala is a member of the United States Conference of Catholic Bishops. He has served on several committees of the USCCB, such as Migration, Vocations, Women in Society in the Church, Priestly Formation, Evangelization, Canonical Affairs, Hispanic Affairs, Education, and the Bishop’s Editorial Oversight Board for the National Catechism, and is presently Consultant to the USCCB Office of Hispanic Affairs. He is presently Chair of the Communications Committee and a member of the following committees: Administrative, Special Assembly and Ad Hoc Committee on Spanish Translation of the Bible for the Americas.

Bishop Zavala was the chair of the committee that developed and organized Encuentro 2000 in Los Angeles. He has given numerous lectures, conducts retreats and workshops both locally and nationally, and has written articles for publication.

Los Angeles Archbishop Jose Gomez, has prepared a letter for the faithful in the archdiocese explaining the circumstances of the departure of Zavala, who was assistant bishop for the San Gabriel region of California.

"The Archdiocese has reached out to the mother and children to provide spiritual care as well as funding to assist the children with college costs. The family's identity is not known to the public, and I wish to respect their right to privacy," the letter says.

Zavala's resignation under a cloud was the latest headache for the diocese, which paid a $660 million settlement in 2007 for cases of sexual abuse going as far back at the 1940.

Een man uit Breda heeft op 21 december aangifte gedaan tegen kardinaal Ad Simonis wegens meineed. De man meent dat de kardinaal tijdens getuigenverhoor bij de rechtbank in Middelburg heeft gelogen toen hij zei dat hij niet wist over misbruik van kinderen door geestelijken.

De man zegt dat hij is misbruikt door de vorig jaar overleden salesiaanse pater Jan N. Op basis van de uitkomsten van het onderzoek door Wim Deetman naar het seksueel misbruik binnen de katholieke kerk stapte de man naar de politie. 'Ik ben ervan overtuigd dat Simonis het misbruik van kinderen wel heeft geweten maar tijdens de rechtszitting niet heeft verklaard. Hij heeft het ook geweten in de tijd dat het misbruik zich afspeelde', zegt de aangever woensdag op de internetpagina Breda Dichtbij.

De politie bevestigde vandaag dat er aangifte is gedaan.

Kardinaal Simonis heeft in het openbaar gezegd dat hij zich ongeveer tien gevallen van seksueel misbruik van minderjarigen door rooms-katholieke priesters kan herinneren. De commissie-Deetman stelde vast dat het er vermoedelijk wat meer zijn geweest. In de praktijk had hij geen contacten met slachtoffers en plegers, maar hij werd hierover wel geïnformeerd, aldus Deetman.

Disgraced Catholic Bishop Raymond Lahey will be the first test of new church rules dealing with clerics involved with child pornography.

It is possible that Lahey, who is expected to be sentenced today after pleading guilty to possessing violent child pornography, will be defrocked by the Catholic Church.

"It is extremely rare for a bishop to be removed from the clerical state because typically bishops haven't committed these types of crimes," said Chad Glendinning, a canon law professor at Ottawa's Saint Paul University. "But he has admitted his guilt so it makes it a little easier for the Holy See. They need not hold a full hearing to determine his guilt so could send the matter directly to the Pope and he could make the decision to dismiss him. But this isn't automatic. It's a possibility but not an inevitability."

In May 2010, the Congregation for the Doctrine of the Faith approved new rules to deal with clerics who use child pornography and made it a crime under canon law to possess child pornography. The Lahey case is the first to be dealt with under those new rules, so the Catholic Church will enter new ground in when it decides his fate.

There are other options besides defrocking, Glendinning said. Other sanctions open to the Pope include prohibiting Lahey from publicly celebrating the liturgy or assigning him to a life of prayer and penance.

"It all has a similar effect as dismissing him from the clerical state (defrocking)," he said.

Michael Swan, associate editor of The Catholic Register, described Lahey as being in canon law limbo.

"In terms of the application of canon law to bishops on this, it is sort of unprecedented" Swan said. "So, like any legal system, it is going to create precedents."

Lahey was arrested at Ottawa Airport in September 2009 after authorities found nearly 600 pornographic images on his laptop computer. Some showed young boys engaged in bondage and torture. In some images, the boys were wearing crucifixes and rosary beads.

Lahey pleaded guilty in May 2011 and voluntarily entered jail to begin serving his sentence.

Shortly after his arrest, Lahey resigned his post, becoming officially known as "The Former Bishop of Antigonish."

Within the Catholic Church, he is and always will remain a bishop.

Albert Rubrech worstelt, Jan Peijnenburg vecht schorsing aan

EINDHOVEN – De Eindhovense priester Jan Peijnenburg (81) vecht toch eerst bij de zogenoemde Congregatie voor de Clerus in Rome zijn schorsing door het bisdom Den Bosch aan.

Na overleg met zijn advocaat ziet hij af van een directe gang naar de burgerrechter, vertelde huisvriend en woordvoerder Harrie van Tuijl dinsdag. Van Tuijl: "De kans is namelijk groot dat de burgerrechter ons terug stuurt als we niet eerst het hele proces binnen de kerk hebben doorlopen."

Pastoor Albert Rubrech uit Putten (93) is enkele weken geleden ook geschorst. Dat werd vandaag (donderdag 29 december) duidelijk. Nu mist de Sint Lukas Parochie dus twee pastores. Dit heeft persvoorlichter van het bisdom Utrecht, de heer mr. Zuijdwijk bevestigd.

Sex abuse scandal in the Netherlands brings requiem for Dutch Catholicism

Last Friday, Archbishop of Utrecht Wim Eijk held a press conference to apologize for the abuse of tens of thousands of children in Catholics institutions in the Netherlands. The abuse was documented in a report that covered the year 1945 onward. Since the story is now a familiar one, the report has merited mention but little sustained attention.

But for some Catholics of my generation, the press conference was a coda, a requiem of sorts. Back in the '70s, Dutch Catholicism represented an open and engaged Catholicism. It embodied a vision of what Catholicism could become in the wake of the reforms of the Second Vatican Council.

For more than a decade after its publication in 1966, what was called the "Dutch Catechism" was considered necessary reading for earnest young Catholics trying to make sense of their faith and their intellectual commitments. I remember how accessible the text was, especially when compared with the traditional catechetical materials of my childhood days. I also remember how the Dutch Catechism inspired open and heartfelt discussions about the Bible and its historicity, Catholicism's relationship with other religions, as well as about the ultimate purpose and meaning of human life. It was a text that allowed believers, agnostics and atheists to sit together and honestly share their hopes, dreams and questions.

When my parents gave me the Dutch Catechism as a birthday present in the late 1970s, I had no idea the text had evoked such controversy. Some bishops in the United States had withdrawn their endorsement of it, the Vatican had called for revisions and clarifications, and a Dutch bishop had even said his purported support of the text had been misconstrued.

Dutch Catholicism always had a contentious and contrarian history. For example, Holland and the Diocese of Utrecht is the original home of the "Old Catholic Church," created by a complex series of historical events and doctrinal disagreements that came in the wake of the Reformation and extended through the 19th century. Old Catholics claim the title "Catholic" through "apostolic succession" but are not recognized by the Vatican.

But while a few Catholics in the Netherlands departed from allegiance to Rome, it was the hierarchy in full communion with Rome that seemed to represent the best that Catholicism stood for. When German forces in World War II overwhelmed the country, the Catholic hierarchy of the Netherlands took a firm and courageous stance. Bishop Johannes de Jong denied sacraments to members of the Nazi party. The hierarchy of the Netherlands also denounced the deportation of Jews in a letter read at all Masses -- an act that distinguished Dutch bishops from many other Catholic and Protestant leaders who often refused to even acknowledge the persecution of the Jews, yet alone oppose it in any coherent way.

This awareness of a world outside the ecclesiastic structures of Catholicism animated not only the Dutch Catechism, but also the work of bishops like Johannes Cardinal Willebrands, who died in 2006. Willebrands was widely admired for his work in the service of ecumenical dialogue and for arguing that the laity should be more broadly included in church governance. He was one of the papabile -- potential popes -- that many liberal-minded Catholics favorably looked upon before the election that brought John Paul II to the papacy.

Even those who did not study the intricacies of Church politics, doctrine and leadership knew that Dutch Catholicism was different -- perhaps even special.

When the abuse scandal exploded in the United States, I expected something similar in other European countries like Ireland. But I never would have considered the Netherlands to be a likely place for abuse to foster. I thought Dutch Catholicism was too self-consciously open for something like that to happen.

But abuse not only happened, it was aided and abetted by cover-up over a period of six decades.

Even in the most detailed reports concerning clerical sexual abuse, there is always some potential "out:" records were bad, the hierarchy was not informed or the number of perpetrators was relatively limited. In the Dutch case, it has been said that the rate of abuse was not higher in Catholic institutions and that, in any case, Catholic dioceses were "fragmented."

But Catholics don't view the Catholic church as just another institution. As far as the hierarchy goes, whether Catholic bishops were in Amsterdam, Utrecht or Rome, it is doubtful that "fragmentation" could explain how such an extended period of cover-up would have successfully kept them totally unawares.

I do not think there are any "outs" here.

Narratives about the sexual abuse scandal are usually spun in relation to the ideological commitments of the Catholics who are telling the story. Catholicism has been too conservative, some say; others say the church was too liberal for too long. The second view seems tailor-made for the story of sexual abuse in Dutch Catholic institutions.

I, for one, tend to see the sexual abuse narrative in terms of power -- a power that equally tempts conservatives and liberals. But there is nonetheless a mournful quality to the latest revelations about Dutch Catholicism: mourning for the victims who can never be compensated or receive justice for their sufferings. But to this I would also add that the revelations about clerical sexual abuse in Holland have also become a requiem, mourning the loss of dreams so favored by Catholics like me in the distant days of our youth.

The priests and victims have been meeting quietly for roughly a year since Peter Isely, the Midwest director for the Survivors Network of those Abused by Priests, approached Father James Connell after a news conference.

At a news conference Tuesday at Plymouth Church in Milwaukee, Isely said the idea for the alliance between priests and victims was inspired by the Gospel.

"In the Christian story, which I believe in and have faith in, the truth may seem buried and dead, but there's always a way the truth will come back to life," he said. "I've always had a deep conviction that survivors and priests of integrity can turn the corner on the sexual abuse crisis. It's not going to be the bishops who do it."

Connell said that as the priests and victims listened to one another what emerged was "a sense of hope. . . . This hope is something to be kept alive."

Tuesday's newspaper ad said in part: "As priests and pastors of the archdiocese, we publicly declare our unqualified support to every victim/survivor. We hold ourselves and our institution fully accountable for any action or inaction that may have allowed these crimes to occur, the offender to go unpunished, and other children to be harmed. We are truly sorry that this happened to you."

Members of both groups, the priests and the victims, said it was not easy at first to sit down together.

Lynn Pilmaier, the mother of an abuse victim, said that when she was first approached to participate in the group, "I wasn't real eager." The last people she wanted to sit down with were Catholic priests, she said.

Father Howard G. Haase, pastor of St. Mary Catholic Church in Waukesha, said he had grown to regard some of the victims who were in the news often as his enemies.

"You are easy to dislike," he explained, "when all you are is a sound bite, a face on TV." Both Haase and Pilmaier said the dialogue they engaged in during these meetings was encouraging.

"We have a long way to go," Haase said, "but I really believe this is a tremendous start."

Mike Sneesby, another member of the survivors group, said the alliance isn't simply about "chasing money. We want the truth."

Tuesday's filing comes almost three weeks after the archdiocese announced a breakdown in settlement talks with 24 men and women who were molested as children, 16 of whom have pending lawsuits against the archdiocese in Milwaukee County Circuit Court. They accuse the archdiocese of defrauding them by moving priests with known histories of sexual abuse from parish to parish without telling families of their background.

The archdiocese said the talks collapsed after the plaintiffs' attorney rejected a $4.6 million settlement offer. The victims denied that assertion, saying they refused to discuss financial terms until the archdiocese agreed to their non-monetary demands, including the release of all documents pertaining to abuse in the archdiocese.


The Catholic Archdiocese of Milwaukee, which faces more than a dozen civil fraud lawsuits over its handling of clergy sex abuse cases, filed for Chapter 11 bankruptcy protection on Tuesday.

Archbishop Jerome Listecki, speaking on the first anniversary of his installation, said the move was necessary to fairly compensate victims and to continue the "essential ministries" of the church.

"As a result of the horrific actions of a few, there are financial claims pending against the archdiocese that exceed our means," Listecki said at a news conference at the Cousins Center in St. Francis, which houses the archdiocese headquarters.

He said the recent failure to reach a mediated settlement with victims and a court decision absolving its insurance companies of liability in the cases "made it quite clear that reorganization is the best way to fairly and equitably fulfill our obligations."

Victims' advocates and plaintiffs attorney Jeff Anderson characterized the filing as a ploy to protect the church and delay justice. They note that the move puts the civil fraud cases on hold, including the scheduled deposition of retired Auxiliary Bishop Richard Sklba, who has been called the "go-to-guy" for then-Archbishop Rembert Weakland in the handling of sex abuse cases.

"This is about protecting church secrets, not church assets," said David Clohessy, national director of SNAP, the Survivors Network of those Abused by Priests. "The goal here is to prevent top church managers from being questioned under oath about their complicity, not 'compensating victims fairly.'"

Milwaukee, with an annual operating budget of about $24 million, is believed to be the eighth Catholic diocese in the United States to declare bankruptcy in response to the clergy sex abuse scandal. The others are: Tucson, Ariz.; Portland, Ore.; Spokane, Wash.; Fairbanks, Alaska; Wilmington, Del.; San Diego; and Davenport, Iowa.

Some of those cases have concluded; others are still pending. Legal experts say it is difficult to make generalities about them, because the facts and financial circumstances differ from diocese to diocese. The effects on parishioners also have differed. In Tucson and Spokane, for example, parishes were asked to pay a portion of the settlements - almost like a tax, said Charles Zech, director of Villanova University's Center for the Study of Church Management.

Listecki said Tuesday that the filing would serve as a kind of final call for all sex abuse claims, allowing the archdiocese to determine its current and future financial obligations to victims. He said it would have no effect on schools and parishes, which are separately incorporated, although that would ultimately be decided by the bankruptcy judge.

The archdiocese created a special e-mail, reorg@archmil.org, where parishioners can send questions about the process, and said they would be answered periodically on its website, www.archmil.org.

Chapter 11 bankruptcy typically is filed to give a company or organization time to restructure its debts and work with creditors, with the expectation that it will continue to operate and emerge stronger in the end.

During the bankruptcy, the entity operates under the supervision of the court, and a committee usually is appointed to represent the interests of unsecured creditors.

As part of the process, the archdiocese will come up with a dollar figure it believes can be allocated to an account to compensate sex abuse claimants, said Marquette University law professor Ralph Anzivino, an expert on Chapter 11 bankruptcies. The amount of the fund is likely to be challenged by claimants, but eventually it will be established by the court.

"Let's assume they put $10 million in that account, but the claims are $100 million," Anzivino said, speaking hypothetically. "That means everybody is going to get 10 cents on the dollar. That's how it's going to work."

In the recently failed settlement talks, the archdiocese argued that its resources were limited to unrestricted operating assets - which totaled $1.6 million in the 2009-'10 fiscal year - and a portfolio of seven properties worth $5.5 million.

In interviews and documents released Tuesday, the archdiocese detailed its assets and explained why some resources could not be used to pay creditors - although at least some of those may be challenged by creditors in bankruptcy court.

According to its most recent financial statements, the archdiocese had $98.4 million in assets and $12 million in liabilities in 2010; however, almost all its assets are in restricted and dedicated accounts, it said.

The archdiocese said schools and parishes should not be affected because they are separately incorporated under Wisconsin law. However, that defense is being challenged in at least one other church bankruptcy, in Wilmington, where some parish funds were included in the pool of money available to creditors.

Restricted funds, endowments and trusts - including the newly formed Faith in Our Future Trust created to hold the proceeds of a $105 million capital campaign - are protected under the legal language that established them, it said.

"There's not a lot of precedent on this, but I think the courts will respect trusts and donor intentions," said Listecki.

Anderson, who has argued that the archdiocese's assets are "vast and unknown," declined to speculate Tuesday on how a bankruptcy court might view the archdiocese's ability to pay creditors, including victims.

The archbishop said it was too early to know how the operations of the archdiocese would be affected, or how that might trickle down to parishes, schools and others entities it supports.

De bisdommen hebben documenten en soms complete dossiers vernietigd die verwezen naar kindermisbruik. In drie van de zeven bisdommen gebeurde dat systematisch, in de andere incidenteel.

Ook zes van de negen onderzochte congregaties en ordes hebben systematisch ‘geschoond’. De meeste stukken zijn al jaren geleden verdwenen; in enkele gevallen is het mogelijk recent gebeurd.

Dat blijkt uit de bijlage van het eindrapport dat de commissie-Deetman vorige week heeft opgesteld over het seksueel misbruik van minderjarigen in de Rooms-Katholieke Kerk. In haar conclusies maakt de commissie hier geen melding van.

Het vernietigen van dossiers bevestigt berichten van vorig jaar. Toen gaf toenmalig bisschop Bluyssen van Den Bosch tegenover NRC Handelsblad toe in de jaren 70 dossiers te hebben vernietigd. Ook de inmiddels overleden bisschop Ter Schure gooide belastende dossiers weg. Hij was bisschop van Den Bosch van 1985 tot 1998.

De bisdommen die systematisch stukken vernietigden, zijn Den Bosch, Breda en Roermond. In het archief van het bisdom Den Bosch werden door de commissie-Deetman helemaal geen stukken over zedenzaken meer aangetroffen. In Breda waren “duidelijke aanwijzingen” dat archivalia over ontspoorde priesters zijn verdwenen. In Roermond blijken alle gevoelige stukken tussen 1972 en 1995 verdwenen. In het jaar 1972 trad bisschop Gijsen aan. Hij bevestigde tegenover de onderzoekers dat in zijn opdracht de stukken zijn vernietigd.

Bij de andere bisdommen konden sommige dossiers of afzonderlijke stukken niet worden teruggevonden. Bij het aartsbisdom Utrecht doet “de afwezigheid van geschreven materiaal in bepaalde bekende gevallen van misbruik vermoeden dat af en toe een brief of aantekening al of niet opzettelijk buiten het archief is gehouden”, aldus de onderzoekers.

Ook congregaties en ordes hebben systematisch geschoond. Bij de salesianen gebeurde dat mogelijk onlangs nog. Dossiers van salesianen tegen wie aanklachten zijn ingediend, blijken leeg of geschoond. Dat geeft volgens de onderzoekers “te denken”.

De onderzoekers:

“Frappante voorbeelden hiervan zijn die van een pater, naar wie vrijwel zeker in 1967 een intern onderzoek werd ingesteld en die in 2010 het misbruik (anoniem) in de media heeft toegegeven, en van een pater, tegen wie vele meldingen zijn binnengekomen, maar wiens dossier geen stukken meer bevat tussen 1958 en 1969, precies de periode waarop de meldingen betrekking hebben.”

Advocates warn deposition may spur ‘chilling effect of victims’

Kansas City, Mo. -- The leading advocacy group for child victims of clergy sex abuse may be compelled to turn over 23 years of internal documents, correspondence and email to the attorneys of an accused priest unless Missouri state courts act to quash a court-ordered deposition.

David Clohessy, head of the Survivors Network of those Abused by Priests, known as SNAP, has been ordered to appear for deposition in a county court case involving allegations of sexual misconduct against Kansas City diocesan priest Fr. Michael Tierney.

Victims’ advocates say if Clohessy is compelled to appear, it could have wide-ranging impact on the ability of victims of clergy sex abuse to identify their accusers and tell their stories without revealing their names in public.

Also at stake is the confidentiality of emails between reporters and victims’ advocates that may reveal sensitive information and names of sources. In a court filing, the Missouri Press Association said Clohessy’s deposition would “eviscerate the free-press guarantee” of journalists.

Clohessy has been ordered to turn over all documents and correspondence, including emails, from SNAP’s files referring to Tierney or the Kansas City-St. Joseph diocese. He is also ordered to submit all documents containing references to either Tierney or the diocese from:

Clohessy has also been ordered to submit:

  • Any documents or correspondence that “mention or refer to any priest currently or formerly” associated with the diocese;
  • Any correspondence with the victim named in the lawsuit;
  • Any correspondence from members of the public “that discuss or relates to repressed memory.”

According to court filings, defense lawyers for priests and former priests named in six other sex abuse lawsuits have requested to “cross-notice” Clohessy’s deposition in order to have access to his testimony.

Court records indicate that Clohessy and his group first attempted to quash the deposition by filing motions with Jackson County, Mo., Circuit Court Judge Ann Mesle, citing concerns of confidentiality for sex abuse victims and the rights of freedom of speech and assembly.

The records indicate Mesle overruled those concerns Wednesday, Dec. 28, ordering Clohessy to submit himself for deposition Monday, Jan. 2.

Clohessy and his group appealed Wednesday, Dec. 28, to Missouri’s Court of Appeals for the state’s Western District to try to quash the order. That appeal, court records indicate, was denied Thursday.

Following the denial by the appeals court, Clohessy’s lawyer said he and his client are “going to take every legal option we can” to prevent the deposition and are investigating filing for review with the Missouri Supreme Court.

Marci Hamilton, noted for her decades of work with clergy sex abuse victims, said the subpoena is “one of the uglier moves I’ve seen by any organization in these cases so far.”

Saying that SNAP “is the least” of the organizations that would be affected by Clohessy’s submission of documents, Hamilton, a professor at the Cardozo School of Law at New York’s Yeshiva University, said the “end result” of the order would be “a huge chilling effect on helping child sex abuse victims at every stage.”

Referencing attempts during the civil rights era to force the NAACP to release the names of its members, Hamilton said the U.S. Supreme Court had made clear in those cases that the government cannot force private organizations to release the names of its members.

“I think it’s plainly unconstitutional and, were I involved, I would be advising any organization faced with this kind of a subpoena to refuse to provide the information because it is unconstitutional, inappropriate and cruel,” said Hamilton, who is the author of Justice Denied: What America Must Do to Protect Its Children.

Asked whether Mesle’s allowing of certain SNAP documents to be read in private would protect victims, Hamilton said those revelations would still “send a really serious and sad message to victims that when they come forward…a judge may well read about the details of their abuse.”

A Polícia Federal prendeu em São Paulo um padre irlandês de 72 anos acusado perante a Justiça de Dublin em 55 processos penais por supostos abusos sexuais contra menores. Ele foi deportado sumariamente para a Irlanda na noite de segunda-feira, 26.

P. J. Kennedy foi localizado na manhã de segunda por agentes da PF que atuam no escritório da Interpol em São Paulo - a Interpol é a Polícia Internacional que reúne corporações de 190 países.

A ação foi discreta. Os policiais abordaram o acusado, que confirmou sua identidade e ouviu os motivos de sua detenção, expostos em mandado de prisão expedido pela Justiça irlandesa.

Kennedy, nascido em 2 de março de 1939, foi imediatamente conduzido ao Aeroporto Internacional de São Paulo, em Cumbica. Às 23h30 de segunda, sob escolta, ele partiu para Londres, onde autoridades irlandesas o aguardavam no aeroporto.

A Interpol informou que desde 2003 o alvo estava no Brasil. Ele fixou residência em Osasco, na Grande São Paulo, e depois mudou-se para a capital. Para se manter, dava aulas de inglês.

No início de 2004, a Interpol solicitou formalmente a localização do religioso ao lançar seu nome na difusão azul - lista de cidadãos contra os quais não há mandados de prisão nos países onde eles se ocultam.

Em janeiro de 2004, Kennedy foi citado em dossiê da Procuradoria de Dublin. O documento informa que, em agosto de 2003, o acusado se comprometeu a desembolsar “a mais alta compensação financeira em juízo” para indenização de uma vítima. Os crimes atribuídos a Kennedy ocorreram nos anos 80.

Depois do acordo judicial, Kennedy migrou para o Brasil com passaporte inglês.

A PF vigiava os movimentos do religioso havia quatro meses, mas aguardava a formalização de documentação para detê-lo.

O plano era embarcar Kennedy às 18h46 de segunda-feira em voo da British Airways. A operação foi adiada e o embarque ocorreu por outra companhia aérea.

O Brasil e a Irlanda não mantêm tratado de extradição. A Polícia Federal agiu com cautela e sigilo para evitar eventual recurso judicial de Kennedy que impedisse ou retardasse sua deportação.

A deportação é a devolução compulsória ao Estado de origem de estrangeiros que ingressam irregularmente em outro território. Ela pode ter amparo em casos de uso de documento falso, como visto de entrada, ou no exercício de atividade profissional não autorizada.

Quando pleiteou a transformação de provisório em definitivo do protocolo de permanência no Brasil, Kennedy assinou uma declaração alegando que não respondia a nenhuma acusação judicial em seu país. A PF cancelou a emissão do documento.

A falsa declaração do padre abriu caminho para a deportação sumária.

The priest at the centre of the 'Prime Time Investigates' controversy was yesterday mourning the death of his brother.

Fr Kevin Reynolds was among the chief mourners as the remains of his brother Sean Reynolds were removed to the Church of The Immaculate Conception in Tubberclaire, Co Westmeath, yesterday evening.

Mr Reynolds, who died on Thursday, had been ill for some time. Fr Reynolds had declined to make public comment on the fallout from his defamation by the RTE current affairs programme because of the family upset at the illness of his brother.
