Eraan herinnerende dat de Verenigde Naties in de UniverseleVerklaring van de Rechten van de Mens,
hebben verkondigd dat kinderen recht hebben op bijzondere zorg en bijstand,

Ervan overtuigd dat aan het gezin, als de kern van de samenleving en de natuurlijke omgeving voor de ontplooiing en het welzijn van al haar leden en van kinderen in het bijzonder, de nodige bescherming en bijstand dient te worden verleend opdat het zijn verantwoordelijkheden binnen de gemeenschap volledig kan dragen,

Erkennende dat het kind, voor de volledige en harmonische ontplooiing van zijn persoonlijkheid, dient op te groeien in een gezin, in een sfeer van geluk,liefde en begrip,

Overwegende dat het kind volledig dient te worden voorbereid op het leiden van een zelfstandig leven in de samenleving, en dient te worden opgevoed in de geest van de in het Handvest der Verenigde Naties verkondigde idealen, en in het bijzonder in de geest van
vrede, waardigheid, verdraagzaamheid, vrijheid,gelijkheid en solidariteit,

Indachtig dat, zoals aangegeven in de Verklaring van de Rechten van het Kind,

aangenomen door de Algemene Vergadering van 20 november 1959,

`het kind op grond van zijn lichamelijke en geestelijke onrijpheid bijzondere bescherming en zorg nodig heeft, met inbegrip van geëigende wettelijke bescherming, zowel vóór als na de geboorte,

zijn het volgende overeengekomen:

De Staten die partij zijn, eerbiedigen de verantwoordelijkheden, rechten en plichten van de ouders of, indien van toepassing, van de leden van de familie in ruimere zin of de gemeenschap al naar gelang het plaatselijk gebruik, van wettige voogden of anderen die wettelijk verantwoordelijk zijn voor het kind, voor het voorzien in passende leiding en begeleiding bij de uitoefening door het kind van de in dit Verdrag erkende rechten, op een wijze die verenigbaar is het de zich ontwikkelende vermogens van het kind.

Tom Roberts was prohibited from speaking his native Cree language at the Prince Albert Indian Residential School, but that wasn't the worst part.
Roberts and his siblings attended the school for years, but weren't allowed to speak to each other - in any language. They would pass by each other silently in the halls or school yard.
"If I got caught yelling to them, I'd get a lickin or get sent to the dorm," Roberts said.
"We'd only talk for two months when we went home in June and July."
Roberts, a former broadcaster who now works as a residential school support worker for the Lac la Ronge Indian Band, said Canadians need to know these stories. That's why it's vital for every shred of documentary evidence to be preserved, Roberts said.
"They should be preserved because in years to come, people have to realize, have to come to the reality that this really happened. It's not oral history. It's all documented."

Supreme Court to hear case today

The fate of tens of thousands of those stories is now in the hands of the Supreme Court of Canada.
Today, the country's highest court is set to hear arguments.
Many survivors did testify publicly at nation-wide events held by the Truth and Reconciliation Commission. The retention of those accounts is not in doubt.

What is at stake are the 35,000 accounts given to adjudicators for the Independent Assessment Process. The IAP hearings were set up to determine individual compensation. Nearly all of those cases have been concluded, with more than $3-billion paid to survivors in recognition of the social, cultural, physical and sexual damages.
The IAP hearings were confidential, but many are pushing for the records to be kept. Opinions vary wildly. Some say retaining the records would amount to the greatest privacy breach in Canadian history. Others say destroying them would be a whitewashing of one of the darkest chapters in Canadian history.

Some are suggesting compromises such as redacting names or contacting each individual to ask what they want done with their testimony. Others want the records simply sealed for decades for someone to decide in the future.

Opinions vary, even among First Nations groups

Even First Nations people and groups are divided, with groups such as the Assembly of First Nations pushing for destruction and the Federation of Sovereign Indigenous Nations advocating preservation.
Roberts said there are other ways to heal and to raise awareness. 
He's helped organize several events for northern Saskatchewan residents. They built and then burned a canoe modeled after the one that transported dozens of children to the schools. They erected a plaque on La Ronge's main street at the site of an old school. Roberts and others recently walked for six days from the Prince Albert. school back home to Stanley Mission north of La Ronge.
Roberts said these actions are helpful, but preservation of the IAP documents is central for both Canadians and for survivors themselves. He said some survivors are still hesitant to share such painful and often shameful memories, but it must be done.
"In order for them to heal, they must let that frustration and anger out."
The court is expected to hear submissions today. An official said it's unlikely a ruling will come today, with the average time to rulings running an average of four to eight months.

Anthony Foster died on Friday evening with his wife Chrissie by his side after suffering a stroke.
He died in a Melbourne hospital, aged 64, dedicated his life to seeking justice for victims of child sex abuse at the hands of the Catholic Church after two of his daughters were repeatedly raped by a priest, 




In a two decade-long quest to hold the Catholic Church accountable for crimes against children, Mr Foster and his wife Chrissie told the harrowing story of their family's treatment at the hands of the church to the media and the Royal Commission into Institutional Responses to Child Sexual Abuse.

OTTAWA — Prime Minister Justin Trudeau is expected to ask Pope Francis for a formal apology for the role of the Roman Catholic Church in the residential school system when the two meet during a private audience later this month.
The Truth and Reconciliation Commission included the demand for a papal apology — to survivors, their families and communities — among the 94 recommendations in its report on the dark history and legacy of residential schools.
Trudeau, who has promised to act on all 94 recommendations, has previously promised to speak to the Pope about an apology, but noted he could not compel him to agree.

"It is a conversation that is going to have to happen between the two gentlemen," said a federal government official, who spoke on the condition that sources not be named.
"Obviously, the Vatican is well aware of the TRC request and they know that's something that we will be raising, but in terms of advancing that conversation, I think it's going to have to happen in the room," the official said.
Canadian bishops have also raised the issue during visits to the Vatican over the past few months.
Trudeau is also bringing his wife, Sophie Grégoire Trudeau, to meet Pope Francis when he visits the Vatican May 29, but she and all others will remain outside the room when the prime minister and the religious leader hold their private conversation.
The visit will also involve a tour of the Vatican museum and the famed Sistine Chapel, where the ceiling was painted by Renaissance artist Michelangelo.
The Vatican stop comes during a trip to Europe for the NATO leaders summit in Brussels and the G7 gathering in Taormina, Italy.
There, the Liberal government is also hoping to get a bilateral meeting with U.S. President Donald Trump — who this week began the countdown to renegotiate the North American Free Trade Agreement — in order continue pressing him on the importance of the relationship between the two countries.
Trudeau will also visit Amatrice, Italy, the site of a devastating earthquake in August 2016, and spend time in Rome for an official bilateral visit including a meeting with Italian Prime Minister Paolo Gentiloni.
Former Conservative prime minister Stephen Harper, who issued a residential schools apology on behalf of the Canadian government in 2008, did not raise the issue directly during a 10-minute audience with Pope Francis two years ago, but did mention the report of the Truth and Reconciliation Commission.
That report documented abuse, illness and even deaths in the residential schools. More than 150,000 First Nations, Métis and Inuit children passed through the schools, which were largely operated by churches and funded by the federal government from the 1840s to 1996, when the last one closed.
The Catholic Church operated 64 of the 140 schools included in the settlement agreement.
The report noted that the United, Anglican and Presbyterian churches, which were also involved in operating residential schools, had their national leaders issue formal apologies on behalf of their churches.
The Roman Catholic Church in Canada, though, does not have one person who is authorized to speak on behalf of the whole church, which meant that apologies were left to individual religious orders and dioceses.
"The result has been a patchwork of apologies or statements of regret that few survivors or church members may even know exist," said the report.
In 2009, the previous pope, Benedict XVI, did express "sorrow" on behalf of the Catholic Church for the "deplorable conduct" by some members of the church in their treatment of indigenous children in residential schools.
"His Holiness emphasized that acts of abuse cannot be tolerated in society," said the statement.
The Truth and Reconciliation Commission report said this did not go far enough, especially since it was not made in public.
"A statement of regret that children were harmed in the schools is a far cry from a full and proper apology that takes responsibility for the harms that occurred," the report said.
The commission said the apology should be similar to the one that Benedict XVI delivered in Ireland in 2010 to victims of abuse by the church.

Het Liefdewerk voor Kinderbescherming te Amsterdam evenwel is een aparte koninklijke goedgekeurde vereniging met een eigen bestaan  en als zodanig ook afzonderlijk op de lijst geplaatst. 

De Vereniging werd na invoering der kinderwetten opgericht omdat de Vincentiusvereniging de "duurzame verzorging van minderjarigen" niet met zoveel woorden in haar doelomschrijving heeft vermeld en zij deswege geen voogdijvereniging in den zin der wet kon zijn.

Beide Comissies kunnen je heel simpel duidelijk maken hoe jij aan jouw (verdere) informatie kunt komen: daar hebben we wetgeving voor. Dáár is al voor betaald: kwestie van belasting en beschaving
